The Inter-American Court of Human Rights (IACtHR) resolved to archive the case of García Prieto et al. v. El Salvador, after deeming four of the five reparation measures ordered in the 2007 judgment fulfilled and concluding the supervision of the State’s obligation to investigate the homicide of Ramón Mauricio García Prieto and the threats against his parents.
The decision is set out in a resolution dated August 27, 2026, notified on October 28, in which the regional court determined that the Salvadoran State did not exercise due diligence to remedy the violations identified in the investigations related to the case.
The proceedings arose from the deficiencies in the investigations to identify the possible masterminds of García Prieto’s murder, as well as from the lack of investigation into the threats and harassment suffered by his parents, José Mauricio García Prieto Hirlemann and Gloria Giralt de García Prieto.
In its judgment of November 20, 2007, the IACtHR declared El Salvador internationally responsible for the violation of the right to personal integrity, in relation to judicial guarantees, judicial protection and the obligation to guarantee the rights of the victims.
As part of the reparations, the court ordered the State to conclude the pending investigations, publish certain sections of the judgment in the Official Gazette and in another newspaper with wide national circulation, provide medical, psychiatric or psychological care to the victim’s parents, and pay the compensation for non-pecuniary damage, as well as the reimbursement of costs and expenses.
During the supervision of compliance, the Court verified that El Salvador had complied with four of the five measures: the publication of the judgment, the assistance to the victims, the payment of the compensation and the reimbursement of costs and expenses.
But, with regard to the obligation to investigate, the court noted that the State did not act with due diligence. Furthermore, it considered that, due to the time elapsed since the events and to the State’s inactivity, it was possible to determine that the criminal statute of limitations had run in those investigations.
The Court also indicated that the case did not fall within the circumstances established by its case law to bar the invocation or application of the criminal statute of limitations. For that reason, it determined that the reparation measure relating to the investigations had not been fulfilled, although it decided to conclude its supervision.
Despite the archiving of the case file, the court clarified that García Prieto’s homicide was not in a situation of total impunity, because two people were convicted as direct perpetrators of the crime, as established in the 2007 judgment.
With this resolution, the IACtHR declared the case concluded and ordered that it be archived, more than 18 years after the issuance of the judgment that declared the Salvadoran State internationally responsible.
