The Government of Nayib Bukele awarded the agency OBERMET S.A. de C.V., a corporation linked to his immediate family, a contract for more than $108,000 for the design, production and dissemination of the Ministry of Health’s communication strategies, just three months after assuming the presidency of El Salvador.
According to the official notice of final award, hosted on the electronic public procurement system Comprasal, the Health Ministry granted the contract to the presidential family’s company on September 26, 2019.
The tender under the code DR-CAFTA (No. 06/2019) stipulated that the services would be financed entirely with resources from the General Fund of the State.
The contract’s terms of reference specify that the company OBERMET was hired to perform services of print advertising, aerial dissemination, media agency management, satisfaction monitoring and placement of commercial advertising in media outlets.

OBERMET, the Bukeles’ agency
The presidential family’s relationship with the company is long-standing. Founded in August 1978, OBERMET S.A. de C.V. has been under the direct control of the Bukeles and people they trust.
According to former magistrates of the Supreme Court of Justice, Nayib Bukele served as the agency’s representative from 2004 to 2012, then transferred his shares to his brother, Karim Bukele, in May of the last year of his tenure.
Currently, Karim Bukele operates as one of the president’s most trusted political strategists and advisers at the Presidential House, despite not holding a formal appointment or an official public post in the State’s organizational chart.
A contract without a public version
Despite the fact that public funds are involved, the Bukele administration has kept the file under a scheme of opacity.

Presidential House did not respond to a request for comment made by Infodemia, pointing out the conflict of interest. Nor was it possible to establish contact with OBERMET.

Partners, but public enemies
Although Nayib Bukele was expelled from the leftist Farabundo Martí National Liberation Front (FMLN) party in October 2017 for criticizing the Government of Salvador Sánchez Cerén (2014-2019) and for “sowing division” within the political institution, his family’s company continued to be favored with contracts, even after he had won the elections.
OBERMET S.A. de C.V. received a contract with the outgoing administration for more than $231,000 for services for the creation of communication strategies, design, production and dissemination for the Solidarity Fund for Health (FOSALUD).
The agreement with reference LP-08/2019 was signed on April 12, 2019, according to the documents reviewed in the electronic public procurement system, weeks after Bukele won the presidential election in February of that year.
The complementary part of this project was awarded to the company ANLE, S.A. de C.V. for an amount of $319,000, to reach a total of $551,000 between both firms.

38 tenders while he was mayor
However, this is not the first time that the company linked to the Bukele family has been questioned for allegedly benefiting from awards of contracts with public institutions.
The former magistrate of the Supreme Court of Justice, Sídney Blanco, said on the program Focos that, between 2012 and 2016, OBERMET S.A. de C.V. won 38 tenders with public institutions even though Nayib Bukele was mayor of San Salvador and the law prohibits a council member from bidding in public administration tenders.
The jurist said that Bukele allegedly committed fraud by carrying out a simulated act to comply with a legal mandate, since, in order to be able to bid, the current president had to be disassociated from the company in an objective, real and demonstrable way, but he did not do so, given that he received money as family donations that he neither declared nor paid taxes on.
In July 2018, the Attorney General, Douglas Meléndez, reported that he had opened an investigation against Nayib Bukele for failing to justify the origin of $846,000 in income.
The Prosecutor’s Office, now headed by Rodolfo Delgado, an official loyal to Bukele, did not respond to the inquiry about the progress of the investigation against the president.

La licitación bajo el código DR-CAFTA (No. 06/2019) estipulaba que los servicios serían financiados en su totalidad con recursos del Fondo General del Estado.
Los términos de referencia del contrato detallan que la empresa OBERMET fue contratada para ejecutar servicios de publicidad impresa, difusión aérea, gestión de agencias de medios, monitoreo de satisfacción e inserción de pauta comercial en medios de comunicación.

OBERMET, la agencia de los Bukele
La relación de la familia presidencial con la compañía es de larga data. Fundada en agosto de 1978, OBERMET S.A. de C.V. ha estado bajo el control directo de los Bukele y personas de su confianza.
Según exmagistrados de la Corte Suprema de Justicia, Nayib Bukele ejerció como representante de la agencia desde 2004 hasta 2012, luego traspasó sus acciones a su hermano, Karim Bukele, en mayo del último año de su gestión.
En la actualidad, Karim Bukele opera como uno de los estrategas políticos y asesores de mayor confianza del mandatario en la Casa Presidencial, a pesar de no ostentar un nombramiento formal ni un cargo público oficial en el organigrama del Estado.
Un contrato sin versión pública
Pese a tratarse de fondos públicos, la administración de Bukele ha mantenido el expediente bajo un esquema de opacidad.

Socios, pero enemigos públicos
Aunque Nayib Bukele fue expulsado del partido izquierdista Frente Farabundo Martí para la Liberación Nacional (FMLN) en octubre de 2017 por criticar al Gobierno de Salvador Sánchez Cerén (2014-2019) y por “sembrar división” al interior del instituto político, la empresa de su familia siguió siendo favorecida con contratos, incluso, después de haber ganado las elecciones.
OBERMET S.A. de C.V. recibió un contrato con la saliente administración por más de $231 mil para servicios de creación de estrategias de comunicación, diseño, producción y difusión para el Fondo Solidario para la Salud (FOSALUD).
El acuerdo con referencia LP-08/2019 fue suscrito el 12 de abril de 2019, según los documentos revisados en el sistema electrónico de compras públicas , semanas después de que Bukele ganó los comicios presidenciales en febrero de ese año.
El complemento de este proyecto fue adjudicado a la empresa ANLE, S.A. de C.V. por una cantidad de $319 mil, para alcanzar un total de $551 mil entre ambas firmas.

38 licitaciones mientras era alcalde
Sin embargo, no es la primera vez que la empresa vinculada a la familia Bukele es cuestionada por, supuestamente, ser beneficiada con adjudicaciones de contratos con instituciones públicas.
El exmagistrado de la Corte Suprema de Justicia, Sídney Blanco, comentó en el programa Focos que, entre 2012 y 2016, OBERMET S.A. de C.V. ganó 38 licitaciones con instituciones públicas pese a que Nayib Bukele era alcalde de San Salvador y la ley prohíbe a un miembro del consejo ofertar en licitaciones de administración pública.
El jurista dijo que Bukele habría cometido un fraude, al realizar un acto simulado para cumplir un mandato legal, ya que, para poder ofertar, el actual presidente debió estar desvinculado de la empresa de una forma objetiva, real y demostrable, pero no lo hizo, puesto que recibió dinero en concepto de donaciones familiares que no declaró ni pagó impuestos.
En julio de 2018, el Fiscal General, Douglas Meléndez, informó que había iniciado una investigación contra Nayib Bukele por no justificar el origen de ingresos por $846 mil.
La Fiscalía, ahora presidida por Rodolfo Delgado, un funcionario leal a Bukele, no respondió a la consulta sobre los avances de la investigación en contra del mandatario.
