The Court of Accounts of the Republic (CCR) raised four objections for a reported amount of $2,224,284.60 against officials and former officials of the San Miguel Mayor’s Office, among them former mayor José Wilfredo Salgado García, over alleged irregularities in the administration of funds allocated to the municipality’s patron saint festivities.
The allegations are contained in Statement of Objections No. CAM-V-JC-001-2026, issued this year by the Fifth Chamber of First Instance of the Court of Accounts, which examined the use of resources transferred by the municipality to the Organizing Committee of the Patron Saint Festivities of San Miguel in the period between May 1, 2021, and April 30, 2024.
The audit identified deficiencies in the processes for the acquisition of goods and services, payments that lacked documentation and authorizations, contracts without sufficient evidence of free competition, and remuneration paid without the corresponding work attendance controls.
The case file examines the actions of municipal officials, members of the organizing committee, and personnel responsible for financial administration, treasury, and accounting during the period under investigation.
Among the main individuals named is Salgado, who served as municipal mayor and president of the Organizing Committee of the Patron Saint Festivities, along with other public servants who performed administrative and supervisory functions.
The objections constitute allegations subject to a liability proceeding before the Court of Accounts and do not, in themselves, represent a final judgment, nor do they prove that the officials involved committed crimes or misappropriated the flagged funds.
Contracting and acquisitions under scrutiny
The first objection concerns deficiencies in the processes for the acquisition of goods and services, involving transactions totaling $1,190,492.60, according to the summary of the Chamber’s case file.
The audit detected purchases and contracts related to artistic shows, supplies, fireworks, and logistical services for the patron saint celebrations, without all the documentation required to support the procedures having been submitted.
Among the missing documents mentioned are purchase orders, contracts, receipt records, and appointments of contract administrators, which are necessary to verify compliance with the legal provisions.
Advance payments exceeding 30% of the value of some contracts were also observed without the guarantees of proper investment corresponding to 100% of the advance having been required.
In the transactions examined, the absence of this supporting documentation made it impossible to fully demonstrate that the contracting and acquisition procedures were carried out in accordance with legal requirements.
The lack of documentation does not necessarily mean that the contracted goods or services were not delivered, but rather that the audit questioned the administrative verification of the transactions.
Payments without required authorizations
The second objection relates to the lack of legalization of payment documents and covers transactions totaling $23,092.57.
The Court identified expenditures corresponding to acquisitions, payrolls, and withholdings whose vouchers did not meet all the authorization requirements established in the internal controls.
Among the deficiencies found were documents lacking the “DESE” stamp, which corresponds to the mayor or payment authorizing officer, and lacking the “Visto Bueno” (approval) of the syndic.
These controls were supposed to support the authorization of the expenditures before the funds were disbursed by those responsible for the treasury. The observations also extend to the supervisory and document-verification functions of the public servants who participated in the authorization and execution of the payments.
Nearly $1 million in contracts without demonstrated competition
The third objection concerns contracts totaling $992,460.90 in which, according to the audit, compliance with procedures that would guarantee free competition among suppliers was not demonstrated.
The questioned transactions include contracts for artistic services, rentals of stages and equipment used during the festive activities.
According to the case file, in the flagged processes only one supplier’s offer was received, without demonstrating that competitive mechanisms for price comparison or bidding had been applied.
The Court questioned the fact that these contracts were carried out without sufficient documentation to prove the existence of competitive conditions in the selection of the suppliers.
The finding relates to the administrative procedures used to contract goods and services with resources allocated to the patron saint celebrations of San Miguel.
Objections over salaries without attendance controls
The fourth objection concerns the payment of remuneration totaling $18,238.57 to workers of the Organizing Committee of the Patron Saint Festivities, without the required attendance controls having been demonstrated.
The audit pointed out the absence of employee entry and exit records, as well as of permissions, leaves of absence, or medical disability certificates that would justify certain absences from their posts.
According to the summary of the case file, these deficiencies resulted in payments being made without applying the corresponding deductions for absences during the workday.
Unlike the first three findings, which relate to alleged administrative liabilities, the fourth objection includes an express allegation of patrimonial liability for $18,238.57. The possible obligation to reimburse that amount will depend on what is decided in the corresponding proceeding.
Municipal officials included in the objections
The statement of objections identifies several members of the Organizing Committee of the Patron Saint Festivities and officials of the San Miguel Mayor’s Office who participated in the administration of the resources during the period examined.
Among them is José Wilfredo Salgado García, former president of the Committee and former municipal mayor, as well as Gilda María Mata, who performed the functions of syndic of the Committee and municipal syndic.
Also listed is Óscar Armando Ramírez Ramírez, who served as treasurer of the Committee and chief treasurer of the municipality, functions related to the handling of funds and the review of the documents that supported the disbursements.
The case file includes Edward Santiago Galeano Iglesias, identified as general accountant of the Committee, and Mercedes Margarita Lara de Gómez, who appears as ad honorem general manager of the body and twelfth principal councilor.
Also mentioned are Belinda del Carmen Romero Jiménez, secretary of the Committee and second alternate councilor; Denny Ernesto Garcilazo García, assistant secretary and municipal staff member; and Kriscia Abigail Ventura Blanco, first committee member and sixth principal councilor.
Other officials included are Elías Isaí García Villatoro, second committee member and first principal councilor; Mario Ernesto Portillo Arévalo, third committee member and second principal councilor; and Patricia Lissette Villafuerte Reyes, fourth committee member and general manager of the municipality.
The first three objections raise alleged administrative liabilities related to noncompliance with provisions on contracting, payment authorization, and internal controls. These observations could lead to administrative sanctions, including fines under Article 107 of the Law of the Court of Accounts, if the corresponding liability is determined.
In the case of the fourth objection, the observation includes a possible patrimonial liability for the payment of remuneration without the required attendance controls.
More than $2.2 million in questioned transactions
The four objections comprise transactions that exceed $2.2 million and cover different aspects of the administration of municipal resources allocated to the patron saint festivities of San Miguel.
The largest amount corresponds to the deficiencies in the processes for the acquisition of goods and services, followed by the contracts in which free competition among suppliers was not demonstrated.
The allegations involving smaller amounts are related to the legalization of payment documents and the remuneration paid without the corresponding work attendance controls.
