Assembly grants 56th extension of the state of exception

The Legislative Assembly approved, with 57 votes, extension number 56 of the state of exception; this measure has been in force since March 27, 2022.

Via a waiver of procedure (without discussion in committee), the legislators approved continuing the extraordinary security measures implemented by the Government to allegedly “combat head-on” the gangs in El Salvador. The state of exception suspends the rights related to the privacy of telecommunications, administrative detention for 72 hours, and the right to a defense and to be informed upon detention.

The Council of Ministers states that the regime is necessary due to the existence of terrorist groups, “which, if not completely eradicated, their actions would allow a setback to the achievements obtained.”

To date, 93,334 people have been detained under the state of exception, as reported by the extension decree. The extension of this measure will be in force from October 28 to November 26, 2026.

The Government states, in the recitals, that, as a result of the recent investigation, “it has made it possible to detect conduct aimed at the financing and logistical support of criminal structures, as well as communication and recruitment activities intended to preserve ties among their members, facilitate the commission of unlawful acts and generate conditions for their possible reorganization.”

Likewise, the Government stated that “isolated actions have been identified that reproduce practices characteristic of the gangs’ modus operandi, particularly those aimed at maintaining mechanisms of surveillance, identification and control over certain spaces or communities; therefore, these manifestations must be addressed through the tools granted by the state of exception.”

With the extension of the state of exception, the Government can make purchases outside the Public Procurement Law.

Under the state of exception, according to Socorro Jurídico Humanitario, at least 580 Salvadorans have died in the custody of the State, without having been convicted at trial and without due procedural guarantees; of these, 94% of the victims did not have gang-member profiles, “which reflects a pattern of arbitrary deaths and impunity in the context of mass trials,” the human rights organization highlighted.

VAMOS lawmaker Claudia Ortiz voted against, and the ARENA lawmakers were absent.
