With 60 votes in favor, the Legislative Assembly approved a new transitional law to grant a Tax Amnesty that would make it easier for taxpayers to pay the taxes and fines they owe to the Ministry of Finance.

It is the “Special and Transitional Law Granting Facilities for Voluntary Compliance with Tax, Customs, and Traffic Obligations and Other Fines,” which will be in effect until this coming December 11, and it is intended to benefit those who are carrying out proceedings at the Office of the Attorney General of the Republic (FGR), such as judicial collection proceedings, and those debts or surcharges on fines related to the Land Transport, Traffic and Road Safety Law, or who have surcharges on fines determined by any institution of the Public Administration, excluding municipalities.

With the tax amnesty, citizens will be able to regularize their debts at the General Directorate of Internal Taxes, at the General Directorate of Customs or at the Internal Taxes and Customs Appeals Tribunal, without having to pay interest, surcharges or late-payment fines.

Taxpayers will be able to access a financing plan that includes an initial payment equivalent to 10% of the debt and eight successive monthly installments. The same procedure would be followed for fines imposed for formal obligations. Those who fail to comply with said payment plans will lose the benefits, and their original surcharges will be proportionally reactivated.

In the plenary session, it was reported that in October of last year, lawmakers approved legislation with the same purpose, and it benefited 56,195 taxpayers. In percentage terms, 71% of the revenue that was collected corresponded to small taxpayers, 15% to medium-sized ones and 14% to large taxpayers.

Con 60 votos a favor, la Asamblea Legislativa aprobó una nueva ley transitoria para otorgar una Amnistía Fiscal que facilite a los contribuyentes el pago de los impuestos y las multas que le adeuden al Ministerio de Hacienda.

Es la “Ley Especial y Transitoria que Otorga Facilidades para el Cumplimiento Voluntario de Obligaciones Tributarias, Aduaneras, de Tránsito y Otras Multas”, que estará vigente hasta el próximo 11 de diciembre y se pretende beneficiar a quienes estén realizando diligencias en la Fiscalía General de la República (FGR), como procesos de cobro judicial y aquellas deudas o recargos sobre multas relacionadas con la Ley de Transporte Terrestre, Tránsito y Seguridad Vial o que posean recargos sobre multas determinadas por cualquier institución de la Administración Pública, excluyendo a las municipalidades.

Con la amnistía tributaria, la ciudadanía podrá regularizar sus deudas en la Dirección General de Impuestos Internos, en la Dirección General de Aduanas o en el Tribunal de Apelaciones de los Impuestos Internos y de Aduanas, sin tener que pagar intereses, recargos ni multas por mora.

Los contribuyentes podrán acceder a un plan de financiamiento que incluye un pago inicial equivalente al 10 % de la deuda y ocho cuotas mensuales y sucesivas. De la misma manera se procedería con las multas impuestas a obligaciones formales. Quienes incumplan dichos planes de pago perderán los beneficios y se les reactivarán los recargos originales proporcionalmente.

En la plenaria, se informó que en octubre del año pasado, los legisladores aprobaron una normativa con el mismo propósito y benefició a 56,195 contribuyentes. En porcentajes, el 71 % de la recaudación que se obtuvo correspondió a pequeños contribuyentes, el 15 % a medianos y el 14 % a grandes tributarios.
