Assembly again rejects creating a commission to review cases of innocent people under the state of exception
Lawmaker Francisco Lira, of the ARENA party, asked to incorporate the proposal submitted back in March 2025 to create an inter-institutional entity that would watch over innocent people deprived of liberty. The majority caucus of Nuevas Ideas and its allies once again closed the door to the discussion of an initiative aimed at creating a mechanism for the review and guarantee of human rights for people detained under the state of exception.

During the course of plenary session 130, the agenda modification request submitted by lawmaker Francisco Lira (ARENA) garnered only three votes in favor and one against, so it was discarded without debate.

The piece of correspondence, originally processed on March 5, 2025, sought to add Articles 3-A and 3-B to the State of Exception Law in order to bring into being a High-Level Commission.

That body would have as its mandate the adoption of measures to guarantee respect for human rights and to coordinate the prompt release of innocent female and male citizens who were arbitrarily arrested.

“This commission was going to have representation from the Ministry of Justice, the Office of the Attorney General of the Republic, the Office of the Procurator General of the Republic, the Office of the Human Rights Ombudsman, academia and civil society,” Lira stated before the plenary.

The parliamentarian argued for his request by pointing out that the Presidency of the Republic had hinted at a similar willingness to review detentions during President Nayib Bukele’s latest speech, and he therefore unsuccessfully urged the ruling party to back the bill.

Details of the discarded bill

According to the document submitted to the Assembly by the opposition caucus (in EDH’s possession), the initiative drew on statements made by President Nayib Bukele in international interviews, in which he asserted that the country’s security is sustainable even without the state of exception remaining continuously in force.

Likewise, it cited the calls by the Inter-American Commission on Human Rights (IACHR) to progressively restore constitutional guarantees and to establish processes of accountability and investigation of abuses.

Despite the technical justification and the signing of the reform decree, the vote in the Salón Azul did not reach the required resolution, with the file remaining shelved.

Opposition also sought to raise female participation quota

During the same plenary sitting, lawmaker Marcela Villatoro (ARENA) requested a second agenda modification with the aim of reforming the Political Parties Law to guarantee the representation of women on the electoral slates for lawmakers and municipal councils.

Villatoro warned that the transitional article that set a mandatory quota of 30% women expires with the upcoming February elections, which would leave the parties without the legal requirement to include female participation.

The legislator’s proposal sought to eliminate the transitional nature of the article and permanently set a minimum of 40% women’s participation in the candidacies of all political forces.

When the motion was put to the plenary, Villatoro’s initiative met the same fate as the one presented by Lira, obtaining only three votes in favor, and thus the legislative agenda continued without incorporating the opposition’s demands.
