In this Wednesday’s plenary session, the Legislative Assembly approved adding nine more institutions to the National Civil Protection Commission, expanding the powers of the National Center for Agricultural, Livestock and Forestry Technology (CENTA), and extending the Law for the legalization of properties awarded to FONAVIPO.
Civil Protection
With 59 votes, the Legislative Assembly amended paragraph 2 of Article 8 of the Civil Protection, Disaster Prevention and Mitigation Law, which has been in force since 2005. The modification will allow nine public institutions to join the National Commission for Civil Protection, Disaster Prevention and Mitigation, the entity responsible for coordinating risk prevention actions and acting in a concerted manner in the face of emergency or disaster situations in the national territory.
The aim of the measure is to adapt and update the work of this body. Currently, the commission is made up solely of the Minister of Governance (who also serves as its president) and the Director General of Civil Protection, Disaster Prevention and Mitigation.
The heads and representatives of the institutions that will be added to the commission are those of the ministries of Foreign Affairs; Housing; Health; Agriculture and Livestock; Environment and Natural Resources; Public Works and Transport; National Defense; and Education, Science and Technology, as well as the National Civil Police (PNC).
There will also be two representatives of the National Association of Private Enterprise (ANEP), who will be chosen by the President of the Republic from among two slates of three candidates proposed by the business association.
Likewise, to have representation from the western, central and eastern zones of the country, there will be three associations or foundations related to civil protection, disaster prevention and mitigation.
CENTA’s powers expanded
With 56 votes, the ruling party amended the Special and Transitional Provisions to Combat Inflation in the Prices of Agricultural and Livestock Inputs, with the objective of expanding the powers of the National Center for Agricultural, Livestock and Forestry Technology (CENTA) and facilitating producers’ access to inputs and tools necessary for their activities.
With the approval of these modifications, CENTA will be able to expand the options it currently offers producers through Agrocenta.
According to the ruling party, the purposes of amending these provisions, approved on June 21, 2022, are to confront the increase in the prices of agricultural and livestock inputs and guarantee their availability; that is, to provide producers with more alternatives to reduce costs and improve the efficiency of their work.
The amendments to the regulations will allow the institution to acquire, import, produce, store, distribute and market seeds, basic grains, agricultural machinery and equipment. In other words, it will be able to buy externally to sell locally.
Another of the measures contemplated in the modifications is that CENTA may act in situations of shortage, emergencies, impacts on production or extraordinary variations in market prices.
The institution will be able to create and manage strategic reserves of inputs, seeds, basic grains, machinery and other agricultural and livestock products, with the purpose of having stocks available when they are needed.
In addition, it will be able to use its own facilities or contract services to store, handle, distribute and market these products. For these activities, it may coordinate with the Ministry of Agriculture and Livestock (MAG) and other public institutions.
The amendments also empower CENTA to arrange financing with national banks and obtain resources from national and international sources. In other words, it will be able to request loans. These resources may be used to finance agricultural and livestock supply activities and strengthen the institution’s capacities, including the acquisition of machinery and equipment, infrastructure improvements and the hiring of personnel, when necessary.
Assembly extends law on PROCADES properties
In another item of this Wednesday’s plenary session, with 59 votes, the Legislative Assembly extended for five years the Special Law for the legalization of properties awarded, by judicial means, to the National Fund for Popular Housing (FONAVIPO) in the commercial enforcement proceeding brought against the Salvadoran Association for Promotion, Training and Development (PROCADES).
It should be recalled that in 1998, PROCADES received funds from the Government for a collective credit program for housing subdivisions, but it fell into default and a judicial process had to be carried out for the properties in the association’s name to be seized and then awarded to FONAVIPO. However, the association sold the properties to 245 families from different parts of the country, but did not hand over the property titles to them.
In October 2021, the Legislative Assembly approved the legislation that has served to help them resolve the problem. The legislation, which would be in force until this coming October 11, establishes a mechanism for the properties awarded to FONAVIPO to be transferred by donation to those who acquired them and paid all or part of their value to PROCADES.
In addition, it allows a request to be filed with the corresponding judge for the release from seizure of the plots of land that were not awarded to the institution. To date, of the 245 families, 149 have already received their deeds, duly registered in the Real Property and Mortgage Registry of the National Registry Center (CNR).
With the extension, the 96 that have pending procedures will be able to move forward with the legalization of the properties, since they will have until October 12, 2031, to do so.
The lots are located in Ayutuxtepeque, Ciudad Delgado, Cuscatancingo and Ilopango, in the department of San Salvador; in San Pablo Tacachico and San Juan Opico, in La Libertad; in El Rosario and Cuyultitán, La Paz; in Tecoluca, in San Vicente; and in Usulután and Puerto El Triunfo, in Usulután.

Asamblea integra nueve instituciones a Protección Civil, amplía facultades del CENTA

En la plenaria de este miércoles, la Asamblea Legislativa aprobó integrar nueve instituciones más a la Comisión Nacional de Protección Civil, ampliar las facultades del Centro Nacional de Tecnología Agropecuaria y Forestal (CENTA) y prorrogar, la Ley para la legalización de inmuebles adjudicados al FONAVIPO.
Protección Civil
Con 59 votos, la Asamblea Legislativa reformó el inciso 2 del artículo 8 de la Ley de Protección Civil, Prevención y Mitigación de Desastres, que está vigente desde 2005. La modificación permitirá que nueve instituciones públicas se sumen a la Comisión Nacional de Protección Civil, Prevención y Mitigación de Desastres, entidad encargada de coordinar las acciones de prevención de riesgos y actuar de manera articulada ante situaciones de emergencia o desastres en el territorio nacional.
Lo que se busca con la medida es adecuar y actualizar el trabajo de dicho organismo. Actualmente, la comisión la integra únicamente el ministro de Gobernación (quien también funge como presidente de esta) y el director general de Protección Civil, Prevención y Mitigación de Desastres.
Los titulares y representantes de las instituciones que se agregarán a la comisión son los de los ministerios de Relaciones Exteriores, de Vivienda, de Salud, de Agricultura y Ganadería; de Medio Ambiente y Recursos Naturales; de Obras Públicas y de Transporte; de Defensa Nacional, de Educación, Ciencia y Tecnología, así como la Policía Nacional Civil (PNC).
También, habrá dos representantes de la Asociación Nacional de la Empresa Privada (ANEP), quienes serán elegidos por el presidente de la República de entre dos ternas propuestas por la gremial.
Asimismo, para tener representación de la zona occidental, central y oriental del país habrá tres asociaciones o fundaciones relacionadas con la protección civil, prevención y mitigación de desastres.
Amplían facultades del CENTA
Con 56 votos, el oficialismo, reformó las Disposiciones Especiales y Transitorias para Combatir la Inflación en los Precios de los Insumos Agropecuarios, con el objetivo de ampliar las facultades del Centro Nacional de Tecnología Agropecuaria y Forestal (CENTA) y facilitar a los productores el acceso a insumos y herramientas necesarias para sus actividades.
Con la aprobación de estas modificaciones, el CENTA podrá ampliar las opciones que actualmente ofrece a los productores a través de Agrocenta.
Según el oficialismo, los propósitos de reformar estas disposiciones, aprobadas el 21 de junio de 2022, son para enfrentar el incremento en los precios de los insumos agropecuarios y garantizar su disponibilidad, es brindar a los productores más alternativas para reducir costos y mejorar la eficiencia de sus labores.
Las reformas a la normativa permitirán que la institución pueda adquirir, importar, producir, almacenar, distribuir y comercializar semillas, granos básicos, maquinaria y equipos agrícolas. Es decir, podrá comprar externamente para vender localmente.
Otra de las medidas contempladas en las modificaciones, es que el CENTA pueda actuar ante situaciones de desabastecimiento, emergencias, afectaciones a la producción o variaciones extraordinarias en los precios de los mercados.
La institución podrá crear y administrar reservas estratégicas de insumos, semillas, granos básicos, maquinaria y otros productos agropecuarios, con el propósito de contar con existencias disponibles cuando sean necesarias.
Además, podrá utilizar sus propias instalaciones o contratar servicios para almacenar, manejar, distribuir y comercializar estos productos. Para estas actividades podrá coordinarse con el Ministerio de Agricultura y Ganadería (MAG) y otras instituciones públicas.
Las reformas también facultan al CENTA para gestionar financiamiento con bancos nacionales y obtener recursos de fuentes nacionales e internacionales. Es decir, podrá solicitar préstamos. Estos recursos podrán utilizarse para financiar las actividades de abastecimiento agropecuario y fortalecer las capacidades de la institución, incluyendo la adquisición de maquinaria y equipo, mejoras en infraestructura y contratación de personal, cuando sea necesario.
Asamblea amplía ley de inmuebles de PROCADES
En otro de los puntos de la plenaria de este miércoles, con 59 votos, la Asamblea Legislativa prorrogó por cinco años la Ley Especial para la legalización de inmuebles adjudicados, vía judicial, al Fondo Nacional de Vivienda Popular (FONAVIPO) en el juicio ejecutivo mercantil promovido en contra de la Asociación Salvadoreña de Promoción, Capacitación y Desarrollo (PROCADES).
Es de recordar que en 1998, PROCADES recibió fondos del Gobierno para un programa de créditos colectivos para lotificaciones habitacionales, pero cayó en impago y se debió realizar un proceso judicial para que las propiedades a nombre de la asociación fueran embargadas y luego adjudicadas a FONAVIPO. Sin embargo, la asociación vendió los inmuebles a 245 familias de diferentes zonas del país, pero no les entregó los títulos de propiedad.
En octubre de 2021, la Asamblea Legislativa aprobó la normativa que ha servido para ayudarles a resolver el problema. La normativa, que estaría vigente hasta el próximo 11 de octubre, establece un mecanismo para que los inmuebles adjudicados al FONAVIPO sean transferidos en donación a quienes los adquirieron y pagaron total o parcialmente su valor a PROCADES.
Además, permite solicitar ante el juez correspondiente el desembargo de los terrenos que no fueron adjudicados a la institución. Hasta la fecha, de las 245 familias 149 ya recibieron sus escrituras, debidamente inscritas en el Registro de la Propiedad, Raíz e Hipotecas del Centro Nacional de Registros (CNR).
Con la prórroga, las 96 que tienen trámites pendientes podrán avanzar con la legalización de los inmuebles, ya que tendrán hasta el 12 de octubre de 2031 para eso.
Los lotes están situados en Ayutuxtepeque, Ciudad Delgado, Cuscatancingo e Ilopango, en departamento de San Salvador; en San Pablo Tacachico y San Juan Opico, en La Libertad; en El Rosario y Cuyultitán, La Paz; en Tecoluca, en San Vicente y en Usulután y Puerto El Triunfo, en Usulután.
