El Salvador’s Legislative Assembly, dominated by President Nayib Bukele’s Nuevas Ideas party, on Wednesday approved the 55th extension of the controversial state of exception, which suspends constitutional guarantees as part of the “war on gangs.”
The extension of the state of exception, for another 30 days, was approved with the votes of 57 of the 60 lawmakers in Congress, where only three legislators belong to the opposition.
“The complexity of the criminal activity carried out by the organizations and the criminal behavior they maintained in the country gave rise to the establishment of the state of exception, and to date, certain traits continue to be evident that demand a highly rigorous response from the State,” states the decree, which was passed without prior legislative debate.
The document argues that “behaviors persist” in the country, such as “certain actions linked to drug trafficking, which constitutes one of the means of financing for the gangs,” or the “attempt to replicate models for recruiting young people to join gangs and commit crimes.”
This state of exception, in effect since March 2022 and questioned by activists and human rights organizations, has left at least 93,162 people in detention whom the government accuses of belonging to or collaborating with gangs.
Meanwhile, humanitarian organizations have recorded more than 6,400 complaints of abuses and 570 deaths of people in state custody, most of them with signs of violence, according to the complaints.
The measure, which has also been used to try to silence voices critical of Bukele’s government, according to various analysts, will remain in effect until October 27 of this year.
The state of exception has become the government’s sole bet against the gangs, which also earned Bukele — who maintains high approval among Salvadorans — immediate reelection to a second term despite the constitutional prohibition at the time.
International organizations, such as Amnesty International (AI), have warned that under this provision, the Salvadoran state could be committing crimes against humanity.

La Asamblea Legislativa de El Salvador, dominada por el partido Nuevas Ideas del presidente Nayib Bukele, aprobó este miércoles la prórroga número 55 del polémico régimen de excepción que suspende garantías constitucionales en el marco de la “guerra contra las pandillas”.
La prórroga del régimen de excepción, por otros 30 días, fue aprobada con los votos de 57 de los 60 diputados del Congreso, donde únicamente tres legisladores pertenecen a la oposición.
“La complejidad de la actividad criminal desarrollada por las organizaciones y el comportamiento criminal que estas mantuvieron en el país, dieron lugar al establecimiento del régimen de excepción, y a la fecha, continúan evidenciándose ciertos rasgos que demandan de una respuesta con alto rigor por parte del Estado”, señala el decreto votado sin debate legislativo previo.
En el documento se argumenta que “persisten conductas” en el país como “determinadas acciones vinculadas al tráfico de drogas, que constituye uno de los medios de financiamiento de las pandillas”, o el “intento de replicar modelos de reclutamiento de jóvenes para integrar pandillas y ocasionar delitos”.
Este régimen, vigente desde marzo de 2022 y cuestionado por activistas y organizaciones de derechos humanos, ha dejado al menos 93,162 detenidos a los que el Gobierno acusa de pertenecer o colaborar con las pandillas.
En tanto, organizaciones humanitarias han registrado más de 6,400 denuncias de atropellos y 570 muertes de personas en custodia estatal, la mayoría con signos de violencia, según las denuncias.
La medida, que también se ha utilizado para tratar de acallar voces críticas del Gobierno de Bukele, según diversos analistas, continuará vigente hasta el 27 de octubre del año en curso.
El régimen de excepción se ha convertido en la única apuesta del Gobierno contra las pandillas, lo que también le granjeó a Bukele, que mantiene una alta aprobación entre los salvadoreños, su reelección inmediata para un segundo mandato pese a la prohibición constitucional en su momento.
Organizaciones internacionales, como Amnistía Internacional (AI), han alertado de que bajo esta disposición el Estado salvadoreño podría estar cometiendo crímenes de lesa humanidad.
