The Legislative Assembly on Wednesday approved, with 57 votes in favor, one against, and two absences, a new extension of the state of exception, which will remain in effect for another 30 days starting September 28.
With this decision, the measure that took effect on March 27, 2022, has now accumulated 55 consecutive extensions, according to the record of extensions approved by the Legislature.
The previous extension had been approved on August 26 and kept the state of exception in effect through September 27.
The measure was initially implemented after the escalation of homicides recorded in late March 2022, and since then, the government and the Legislative Assembly have presented it as one of the main tools of the security strategy.
Navarro defends continuation of the measure
During the debate, Nuevas Ideas lawmaker Caleb Navarro defended the continuation of the state of exception and argued that security results must be maintained through ongoing work.
“Only those who remember the past can gauge what the current results mean, but we must also understand that security is not a destination you reach just once,” he said.
Navarro added that security must be a constant task and questioned the criticism from those who point out that the Assembly is once again approving a new extension.
“Security is built every day, and that’s why the opposition makes me laugh when they come and say, ‘they’re going to approve the state of exception again,'” the lawmaker said.
The lawmaker argued that the State must continue strengthening its institutions, international cooperation, and its capabilities to confront organized crime and drug trafficking.
“Behind every statistic, there is a person”
Navarro also linked the security results to the impact that, he argued, they have on Salvadoran families.
“Because behind every statistic, there is a person; behind every homicide that doesn’t happen, there is a family that keeps one of its members,” he said.
He also mentioned drug seizures and police operations as part of the actions that, from the ruling party’s perspective, help keep communities away from criminal structures.
“And behind every successful operation, Salvadorans are living in complete peace,” he said.
The lawmaker concluded that the debate over the continuation of the state of exception should not focus solely on figures, but on the people and families who, he argued, benefit from the reduction in violence.
“So we’re not talking about numbers, we’re talking about lives, families, the present and the future of El Salvador,” he said.
More than four years under the state of exception
The state of exception was approved on March 27, 2022, and has been extended monthly since then. The Assembly has maintained that the measure has contributed to the security results achieved in the country.
The extension approved in August, the 54th, kept certain constitutional guarantees related to arrest and detention procedures suspended, including provisions of Articles 12, 13, and 24 of the Constitution.
Among the suspended guarantees are aspects related to the right of a detained person to know immediately the reasons for their arrest and to have the assistance of a defense attorney, as well as the standard timeframe for being brought before a judge. The guarantee regarding the inviolability of communications also remains suspended.
The prolongation of the measure has also been questioned by international human rights organizations, which have raised concerns about due process, the right to defense, and possible arbitrary detentions.
With the new approval, the state of exception will remain in effect for another 30 days, from September 28 through October 27, 2026.

Asamblea aprueba por 55.ª vez el régimen de excepción y lo extiende al 27 de octubre

La Asamblea Legislativa aprobó este miércoles, con 57 votos a favor, uno en contra y dos ausencias, una nueva prórroga del régimen de excepción, que continuará vigente durante otros 30 días a partir del próximo 28 de septiembre.
Con esta decisión, la medida que entró en vigencia el 27 de marzo de 2022 acumula ya 55 prórrogas consecutivas, de acuerdo con el registro de las extensiones aprobadas por el Legislativo.
La anterior extensión había sido aprobada el 26 de agosto y mantuvo vigente el régimen hasta el 27 de septiembre.
La medida fue implementada inicialmente después de la escalada de homicidios registrada a finales de marzo de 2022 y, desde entonces, el Gobierno y la Asamblea Legislativa la han presentado como una de las principales herramientas de la estrategia de seguridad.
Navarro defiende continuidad de la medida
Durante la discusión, el diputado de Nuevas Ideas Caleb Navarro defendió la continuidad del régimen y sostuvo que los resultados en materia de seguridad deben mantenerse mediante un trabajo permanente.
“Solamente quien recuerda el pasado puede dimensionar lo que significan los resultados actuales, pero también debemos entender que la seguridad no es un destino al que solo se llega una vez”, afirmó.
Navarro agregó que la seguridad debe ser una tarea constante y cuestionó las críticas de quienes señalan que la Asamblea vuelve a aprobar una nueva prórroga.
“La seguridad se construye todos los días, y por eso me da risa la oposición cuando viene a decir ‘ya van a aprobar otra vez el régimen de excepción’”, expresó el legislador.
El diputado sostuvo que el Estado debe continuar fortaleciendo sus instituciones, la cooperación internacional y las capacidades para enfrentar al crimen organizado y el narcotráfico.
“Detrás de cada estadística hay una persona”
Navarro también vinculó los resultados de seguridad con el impacto que, según sostuvo, tienen sobre las familias salvadoreñas.
“Porque detrás de cada estadística, hay una persona; detrás de cada homicidio que no ocurre hay una familia que conserva a uno de sus miembros”, manifestó.
También mencionó los decomisos de droga y los operativos policiales como parte de las acciones que, desde la perspectiva oficialista, contribuyen a mantener alejadas a las comunidades de las estructuras criminales.
“Y detrás de cada exitoso operativo los salvadoreños están viviendo en completa paz”, afirmó.
El diputado concluyó que el debate sobre la continuidad del régimen no debe centrarse únicamente en cifras, sino en las personas y familias que, según su argumento, se benefician de la reducción de la violencia.
“Así que no estamos hablando de números, estamos hablando de vidas, familias, del presente y el futuro de El Salvador”, dijo.
Más de cuatro años bajo régimen de excepción
El régimen de excepción fue aprobado el 27 de marzo de 2022 y desde entonces ha sido prorrogado mensualmente. La Asamblea ha sostenido que la medida ha contribuido a los resultados de seguridad alcanzados en el país.
La prórroga aprobada en agosto, la número 54, mantuvo suspendidas determinadas garantías constitucionales relacionadas con los procedimientos de captura y detención, entre ellas disposiciones de los artículos 12, 13 y 24 de la Constitución.
Entre las garantías suspendidas se encuentran aspectos relacionados con el derecho de una persona detenida a conocer inmediatamente las razones de su captura y contar con asistencia de un defensor, así como el plazo ordinario para ser puesta a disposición judicial. También permanece suspendida la garantía relativa a la inviolabilidad de las comunicaciones.
La prolongación de la medida también ha sido objeto de cuestionamientos por parte de organismos internacionales de derechos humanos, que han señalado preocupaciones sobre el debido proceso, el derecho de defensa y posibles detenciones arbitrarias.
Con la nueva aprobación, el régimen continuará vigente durante otros 30 días, desde el 28 de septiembre hasta el 27 de octubre de 2026.
