U.S. judge orders DHS to pay $164,527 for deportation of Venezuelan to Cecot

The U.S. Department of Homeland Security (DHS) must pay $164,527.70 in legal fees and expenses for the wrongful deportation of a Venezuelan migrant to the Terrorism Confinement Center (Cecot) in El Salvador in March 2025, federal judge Stephanie Gallagher of the District of Maryland ruled Tuesday.

The judge ordered DHS to cover litigation costs after concluding that the deportation of the young man, identified in court documents by the pseudonym “Cristian,” violated an agreement reached in a class-action lawsuit.

Gallagher found that the government was not “substantially justified” in labeling him a member of Tren de Aragua and removing him before his asylum claim could be resolved.

Cristian is part of a class-action lawsuit filed seven years ago on behalf of unaccompanied migrant minors who lack legal status and guardians. His membership in that class prevented him from being deported before the proceedings related to his asylum claim concluded.

The Venezuelan was sent to Cecot in March 2025, one day after President Donald Trump issued an executive order invoking the Alien Enemies Act to justify the removal of Venezuelans accused of belonging to Tren de Aragua. The State Department had recently designated that organization as a “foreign terrorist organization.”

In April 2025, Gallagher ruled that the deportation of the then-20-year-old was wrongful and ordered DHS to “facilitate” his return.

After spending several months in El Salvador, Cristian was transferred to Venezuela as part of a prisoner exchange. His lawyers temporarily lost contact with him, and when they managed to reach him again, the young man “never communicated a desire to return to the United States to receive his asylum adjudication.”

The U.S. government argued that the application of the Alien Enemies Act exempted it from complying with the obligations established in the class-action agreement, but Gallagher rejected that argument.

“The defendants’ decision to remove Cristian without prior notice, even after Cristian’s immigration attorney had notified them of his class membership, was unjustified and unreasonable,” the judge wrote.

The ruling awards $160,823.09 in attorney fees and $3,704.61 in expenses, for a total of $164,527.70.

“If we consider the totality of the circumstances, even if some of the government’s positions had been reasonable, its overall position in the litigation has not been substantially justified,” Gallagher noted.

El Departamento de Seguridad Nacional de Estados Unidos (DHS) deberá pagar $164,527.70 en honorarios y gastos legales por la deportación indebida de un migrante venezolano hacia el Centro de Confinamiento del Terrorismo (Cecot), en El Salvador en marzo de 2025, según resolvió el martes la jueza federal Stephanie Gallagher, del Distrito de Maryland.

La jueza ordenó al DHS cubrir los costos derivados del litigio después de concluir que la deportación del joven, identificado en los documentos judiciales con el seudónimo “Cristian”, incumplió un acuerdo alcanzado dentro de una demanda colectiva.

Gallagher consideró que el Gobierno no estuvo “sustancialmente justificado” al señalarlo como integrante del Tren de Aragua y expulsarlo antes de que pudiera resolverse su solicitud de asilo.

Cristian forma parte de una demanda colectiva presentada hace siete años en representación de menores migrantes no acompañados que carecen de estatus legal y tutores. Su pertenencia a ese grupo impedía que fuera deportado antes de que concluya el proceso relacionado con su petición de asilo.

El venezolano fue enviado en marzo de 2025 al Cecot, un día después de que el presidente Donald Trump emitiera una orden ejecutiva que invocó la Ley de Enemigos Extranjeros para justificar la expulsión de venezolanos acusados de pertenecer al Tren de Aragua. El Departamento de Estado había designado recientemente a esa organización como “organización terrorista extranjera”.

Gallagher determinó en abril de 2025 que la deportación del entonces joven de 20 años fue indebida y ordenó al DHS “facilitar” su regreso.

Después de permanecer varios meses en El Salvador, Cristian fue trasladado a Venezuela como parte de un intercambio de prisioneros. Sus abogados perdieron temporalmente el contacto con él y, cuando consiguieron comunicarse nuevamente, el joven “nunca comunicó su deseo de regresar a los Estados Unidos para recibir su adjudicación de asilo”.

El Gobierno estadounidense argumentó que la aplicación de la Ley de Enemigos Extranjeros lo eximía de cumplir las obligaciones establecidas en el acuerdo de la demanda colectiva, pero Gallagher rechazó ese planteamiento.

“La decisión de los acusados de expulsar a Cristian sin previo aviso, incluso después de que el abogado de inmigración de Cristian les había notificado de su pertenencia al grupo, fue injustificada y no razonable”, escribió la jueza.

La resolución establece el pago de $160,823.09 en honorarios de abogados y otros $3,704.61 en gastos, para un total de $164,527.70.

“Si consideramos la totalidad de las circunstancias, incluso si algunas de las posiciones del gobierno hubieran sido razonables, su posición general en el litigio no ha estado sustancialmente justificada”, señaló Gallagher.
