Lawmaker Claudia Ortiz (Vamos) questioned the option being considered to restructure El Salvador’s workday, because it increases the number of daily working hours, which currently cannot exceed eight daytime hours and 44 hours per week.

The restructuring of the workday has been under discussion since the second half of August at the Higher Labor Council, which is made up of representatives from the government, employer, and worker sectors. For now, the best-known option is to shift the workday to a four-days-on, three-days-off schedule without affecting the 44-hour weekly cap.

That option, however, would require amending the Constitution of the Republic, which stipulates in Article 38, Section 6, first paragraph, that the workday cannot exceed eight hours.

On this point, Ortiz noted that the issue requires public discussion and transparency so that citizens are aware of what the proposal entails. “I’ve talked about it with several people who ask. People are paying attention. Everyone asks if this means wages will go up or if it’s the same, because they already work more than eight hours anyway and don’t get paid for them,” the lawmaker said.

“The eight-hour workday is a right. A right that has been fought for over the years, and it’s in the Constitution of the Republic for that reason — because it should be very hard to touch,” Claudia Ortiz, Vamos lawmaker.

“The moment it comes to the Legislative Assembly, we already know what’s going to happen: we never see space given for people to weigh in and participate, for the labor sector and independent unions to give their opinion, or for technical bodies specializing in labor law to give their opinion. We already know they’re going to impose a decision, and simply, as the president of the Legislative Assembly said, they’re just waiting to push the button,” warned Ortiz, who stressed the effects that, she believes, an increase in daily working hours could cause.

“Is there going to be a consultation? Will people be able to express their opinion? This isn’t just about imposing what one economic class or one group in power wants; we’re talking about labor rights, about people’s lives, about their daily lives, about the hours people spend in traffic to get to work. And if they leave 11 hours later, what time are they going to get home?” asked Ortiz, raising the issues that, she believes, should be part of the discussion on this matter.

La diputada Claudia Ortiz (Vamos) cuestionó la opción que se baraja para reestructurar la jornada laboral en El Salvador, debido a que esta aumenta la cantidad de horas de trabajo por día, y que actualmente no puede pasar de ocho horas diurnas y 44 horas a la semana.

El tema de la reestructuración de la jornada laboral se encuentra en discusión desde la segunda quincena de agosto en el Consejo Superior del Trabajo, integrado por representantes de los sectores gobierno, empleadores y trabajadores. De momento, la opción más conocida es la de pasar la jornada laboral a un esquema de cuatro días trabajados y tres días libres, sin afectar el techo de 44 horas trabajadas a la semana.

Dicha opción, sin embargo, obligaría a realizar una reforma a la Constitución de la República, que es la que ordena, en su artículo 38, literal 6, inciso primero, que la jornada laboral no puede exceder las ocho horas.

Al respecto, Ortiz apuntó que el tema necesita discusión pública y transparencia para que la ciudadanía sea consciente de lo que implica la propuesta planteada. “Lo he hablado con varias personas que preguntan. La gente está atenta. Preguntan todos si eso significa que van a subir el salario o es lo mismo, porque de todas formas ya trabajan más de las ocho horas y no las pagan”, relató la legisladora.

“La jornada de ocho horas es un derecho. Un derecho por el que se ha luchado a lo largo de los años, y está en la Constitución de la República por eso, porque debe ser muy difícil de poderlo tocar”, Claudia Ortiz, diputada de Vamos.

“Al momento de que pueda venir a la Asamblea, ya sabemos lo que va a pasar: aquí no vemos en ningún momento que se da espacio para que la gente opine y participe, para que el sector laboral, sindicatos independientes puedan dar su opinión, o entidades técnicas en materia de derecho laboral puedan dar su opinión. Aquí ya sabemos que van a imponer una decisión y simplemente, como dijo el presidente de la Asamblea, están esperando para apretar el botón”, advirtió Ortiz, que insistió en los efectos que, considera, pueda provocar un aumento de horas en la jornada laboral diaria.

“¿Va a haber una consulta?, ¿La gente va a poder expresar su opinión? Aquí no se trata solo de imponer lo que una clase económica o un grupo en el poder quiera; estamos hablando de derechos laborales, de la vida de la gente, de su vida diaria, de las horas que la gente pasa en el tráfico para llegar a su empleo. Y si salen 11 horas después, ¿a qué hora va a llegar a su casa?”, cuestionó Ortiz los temas que, considera, deben ser parte de la discusión del tema.
