The Salvadoran State, through the Ministry of Foreign Affairs or the Constitutional Chamber of the Supreme Court of Justice, could intervene in the situation currently facing ten compatriots in Russia, where they remain missing after being taken to that country and forced to take part in the war against Ukraine.

Cases involving compatriots continue to come to light, and this outlet has documented at least ten involving men between the ages of 25 and 40 who received offers to travel to Russia to work as security guards and who, once on European soil, were forced to fight.

In most of these cases, the families of those affected have already sought help from the Ministry of Foreign Affairs (Cancillería), but they have been told that nothing can be done because “the Salvadorans left of their own free will.” However, Celia Medrano, an expert on migration and human rights, believes that is not entirely true.

“The State cannot completely wash its hands of this. It should investigate on its own initiative how the contracting entities have operated in El Salvador to make these offers, just as is done, for example, with online scams. There should also be state controls over this type of offer,” Medrano said.

“States not only have the duty to guarantee the enjoyment of human rights; they also have the duty to prevent violations committed by both state and non-state actors. Doing nothing is also a failure in human rights terms,” the expert added.

The constitutional route

LA PRENSA GRÁFICA learned that in two of the cases of Salvadorans trapped in Russia, habeas corpus petitions have been filed before the Constitutional Chamber of the Supreme Court of Justice so that the country’s highest court will request information about what has happened to these people.

Although these petitions have so far shown no progress, attorney Leonardo Gallegos, an expert in family law with knowledge of constitutional law, believes this is indeed an appropriate avenue for obtaining information about the Salvadorans in Russia.

“From the Chamber (the Constitutional Chamber), the justices could order the respective authorities to make all the necessary diplomatic, consular, and humanitarian contacts,” he explained.

Gallegos also noted that Salvadoran citizens have extraterritorial protection, which means every citizen of this country must be protected and that there must be a registry of Salvadorans who are abroad.

He further recalled that case law already exists on the return of Salvadorans for humanitarian reasons, and cited as examples the amparo petitions filed by compatriots during the COVID-19 pandemic who had been stranded in other countries, in which the Office of the President was ordered to draw up a “gradual repatriation plan.”

Viaje de salvadoreños a la guerra en Rusia debería ser investigado de oficio por el Estado, según expertos

El Estado salvadoreño, a través de Cancillería o de la Sala de lo Constitucional de la Corte Suprema de Justicia, podría interceder en la situación que actualmente atraviesan una decena de compatriotas en Rusia, donde permanecen desaparecidos tras ser llevados a ese país y obligados a participar en la guerra contra Ucrania.

Los casos de compatriotas siguen saliendo a la luz y este medio ha documentado al menos diez que implican a hombres entre los 25 y los 40 años, quienes recibieron ofertas para viajar a Rusia para trabajar como guardias de seguridad y que ya en suelo europeo les obligaron a combatir.

En la mayoría de estos casos las familias de los afectados ya pidieron ayuda al Ministerio de Relaciones Exteriores (Cancillería), pero les han dicho que no pueden hacer nada porque “los salvadoreños se fueron bajo su propia voluntad”. Sin embargo, Celia Medrano, experta en temas de migración y derechos humanos, considera que eso no es del todo cierto.

“El Estado no puede desligarse totalmente. De oficio debería investigarse cómo las instancias contratadoras han operado en El Salvador para ofertar, así como se hace, por ejemplo, con las estafas en línea. Tambien debe haber controles estatales sobre este tipo de ofertas”, analizó Medrano.

Los Estados no solo tienen el deber de garantizar el goce de derechos humanos, además tienen el deber de prevenir violaciones cometidas tanto por actores estatales como no estatales. El no hacer tambien es incumplimiento en materia de derechos humanos”, añadió la experta.

Por la vía constitucional

LA PRENSA GRÁFICA tuvo conocimiento que en dos de los casos de los salvadoreños atrapados en Rusia se han presentado recursos de habeas corpus ante la Sala de lo Constitucional de la Corte Suprema de Justicia, para que sea el máximo tribunal del país el que solicite información sobre lo que ha sucedido con estas personas.

Aunque por el momento estos recursos no han mostrado avances, el abogado Leonardo Gallegos, experto en derecho de familia y conocedor de derecho constitucional, considera que esta sí es una vía adecuada para obtener información de los salvadoreños en Rusia.

Desde la Sala (de lo Constitucional) los magistrados podrían ordenar a las autoridades respectivas que se efectúen todos los enlaces diplomáticos, consulares y humanitarios necesarios”, explicó.

Gallegos también señaló que los ciudadanos salvadoreños tienen protección extraterritorial, lo que implica que todo ciudadano de este país debe ser protegido y que debe existir un registro de los salvadoreños que se encuentran en el exterior.

Recordó además que ya existe jurisprudencia en relación al retorno de salvadoreños por razones humanitarias, y puso como ejemplos los amparos presentados por compatriotas durante la pandemia del covid-19, que habían quedado atrapados en otros países y donde se ordenó a Presidencia de la República que elaborara un “plan de repatriación gradual”.
