June 20 marked one year since the Constitutional Chamber of the Supreme Court of Justice (CSJ) admitted the habeas corpus petition filed by the family of lawyer Ruth López. However, they say that, to date, they have received no response.
The lawyers filed the petition on May 25, 2025, requesting a review of the legality of López’s detention. The Chamber admitted the petition and stated that it had appointed an executing judge who would serve notice on the named authorities. One year later, the family, through a human rights organization, stated that they have no information about any action taken.
“One year after it was admitted, the Chamber has issued no ruling. Habeas corpus must be processed expeditiously by its very nature, but in this case the process has lost all effectiveness in protecting her rights,” the family and the organization said.
The Salvadoran Constitution establishes the right to habeas corpus as an oversight mechanism that operates in cases of real threats to or violations of a person’s physical, bodily, psychological, and moral liberty. Given the nature of the rights it protects, it must be applied immediately.
Claudia López, Ruth’s sister, spoke about the judicial proceedings against her and lamented the information under seal in the case, which has prevented them from obtaining details about the process and her state of health.
“This month (June), Ruth’s hearing was supposed to be held, and so far no date has been set; we have no idea when it will take place. One question we keep asking ourselves as a family is: Why is the case kept under seal if Ruth has requested a public trial?” Claudia asked.
On May 16, López was transferred to a hospital in San Salvador for a procedure. Her family says they were not informed of the type of surgery performed or her current state of health, despite having requested that information from the authorities.
“Thirty-eight days after the procedure — which the family only learned about through the media because we were not informed, even though that is our right — we have requested information about the biopsy, and there has been no response from the state about the results, which should already be available,” she added.
Ruth López was arrested on Sunday, May 18, 2025, initially on embezzlement charges that were later changed to illicit enrichment.
Habeas corpus de Ruth López cumple un año sin resolución

El 20 de junio pasado se cumplió un año de que la Sala de lo Constitucional de la Corte Suprema de Justicia (CSJ) admitió la petición de habeas corpus presentada por la familia de la abogada Ruth López. Sin embargo, denuncian que, a la fecha, no han tenido ninguna respuesta.
Los abogados interpusieron el recurso el 25 de mayo de 2025, en el cual solicitaron que se revise la legalidad de la detención de López. La Sala admitió la petición y sostuvo que ha designado a un juez ejecutor que intimará a las autoridades demandadas. Un año después, la familia, a través de una organización de derechos humanos, indicó que no se tiene información sobre alguna diligencia realizada.
“A un año de su admisión, la Sala no ha emitido ningún fallo. El habeas corpus debe tramitarse de forma expedita por su propia naturaleza, pero en este caso el proceso ha perdido toda eficacia para proteger sus derechos”, expresaron familiares y la organización.
La Constitución de El Salvador establece el derecho al habeas corpus como un mecanismo de control que opera para amenazas o vulneraciones reales a la libertad física, integral, psíquica y moral de una persona. Por la naturaleza de los derechos que protege debe ser aplicado de manera inmediata.
Claudia López, hermana de López, brindó declaraciones sobre del proceso judicial en su contra y lamentó la reserva de información del caso, que les ha impedido obtener detalles del proceso y de su estado de salud.
“En el transcurso de este mes (junio) se debía realizar la audiencia de Ruth y, hasta el momento, no se ha fijado fecha, no tenemos conocimiento en qué momento se va a realizar. Una pregunta que constantemente nos hacemos como familia es ¿por qué el caso se mantiene bajo reserva si Ruth ha pedido un juicio público?”, cuestionó Claudia.
El 16 de mayo pasado, López fue trasladada a un centro hospitalario de San Salvador para una intervención de la cual, asegura su familia, no fue notificada el tipo de cirugía realizada, ni el estado de salud en que se encuentra, pese a que fue información que solicitaron a las autoridades.
“Después de 38 días de haber sido intervenida, en la que la familia tuvo que darse cuenta por medios de comunicación porque no fuimos informados el cual es un derecho, hemos solicitado que se nos informe acerca de la biopsia y no hay una contestación del Estado de ese resultado, el cual ya debería estar”, agregó.
Ruth López fue capturada el domingo 18 de mayo de 2025, inicialmente por el delito de peculado que después fue modificado a enriquecimiento ilícito.
