Former GANA lawmaker Romeo Auerbach is an employee of the Supreme Electoral Tribunal (TSE), even though he opted for the voluntary retirement decree in 2022, which bars him from working at the entity for a period of 5 years.

A photograph published by the official account of the Supreme Electoral Tribunal revealed that Romeo Auerbach, a former Legislative Assembly lawmaker for the Grand Alliance for National Unity (GANA) party, a Bukele ally, was participating in the “first Internal Test of the Election Monitoring Board (JRV) Transmission System,” conducted by the collegiate body.

According to sources consulted by La Prensa Gráfica, Auerbach has been serving as a coordinator in the TSE’s Electoral Organization Directorate since this past May. However, this appointment would be violating laws.

For context, on December 22, 2021, the Legislative Assembly approved the “Transitional Law on Economic Compensation for Services Rendered by Employees of the Supreme Electoral Tribunal” so that all TSE employees or officials who wished to voluntarily retire from the institution could do so to receive economic compensation.

Article 10 of Legislative Decree 258 establishes that “employees and officials who avail themselves of this law may not enter employment in Public Administration for a period of five years, counted from the date on which their separation begins.”

It is worth recalling that Auerbach left his position as deputy director of Electoral Logistics at the TSE on April 30, 2021, one day before taking office as a lawmaker of the Republic. As mentioned by LPG, Auerbach opted for the voluntary retirement decree in February 2022; therefore, his relationship with the TSE would have ended at that moment, and he would be barred from working at that same entity until February 2027.

In fact, that law is not the only one Auerbach would be violating, since the second paragraph of Article 184 of the Electoral Code establishes that “no public official or employee may use their position to engage in partisan politics.”

In his role as an “analyst,” after finishing his term as a legislator in 2024, he has openly supported Nuevas Ideas; a situation that contrasts with the work he does at the TSE, where, moreover, the ruling party sold the idea of “de-partisanizing” the TSE following a constitutional reform so that political parties would no longer propose shortlists for magistrates.

At the moment, former lawmaker Romeo Auerbach has not commented on the matter.

Romeo Auerbach regresa al TSE pese a prohibición tras retiro voluntario

El ex diputado de GANA, Romeo Auerbach, es empleado del Tribunal Supremo Electoral (TSE), a pesar que él en 2022 se acogió al decreto de retiro voluntario y la misma le imposibilita ejercer en la entidad por un periodo de 5 años.

Por medio de una fotografía publicada por la cuenta oficial del Tribunal Supremo Electoral, se dio a conocer que Romeo Auerbach, ex diputado de la Asamblea Legislativa por el partido Gran Alianza por la Unidad Nacional (GANA), aliado a Bukele, participaba en la “primera Prueba Interna al Sistema de Transmisión de JRV”, desarrollada por el organismo colegiado.

Según fuentes consultadas por La Prensa Gráfica, Auerbach funge como coordinador en la Dirección de Organización Electoral del TSE desde el pasado reciente mes de mayo. Sin embargo, este nombramiento estaría violentando leyes.

Es de contextualizar que el 22 de diciembre de 2021, la Asamblea Legislativa aprobó la “Ley Transitoria de Compensación Económica por Servicios Prestados por Empleados y Empleadas del Tribunal Supremo Electoral” para que todos aquellos empleados o funcionarios del TSE que querían retirarse voluntariamente de la institución podrían hacerlo para obtener una compensación económica.

El artículo 10 del decreto legislativo 258 establece que “los empleados y funcionarios que se acogieren a esta ley, no podrán ingresar a laborar en la Administración Pública durante un periodo de cinco años, contados a partir de la fecha en que inicie la cesantía”.

Es de recordar que Auerbach dejó de ejercer como subdirector de Logística Electoral en el TSE el 30 de abril de 2021, un día antes de ejercer su periodo como diputado de la República. Según lo menciona LPG, Auerbach se acogió al decreto de retiro voluntario en febrero de 2022; por lo que su relación con el TSE finalizaría en ese momento y estaría imposibilitado a trabajar en esa misma entidad hasta febrero de 2027.

De hecho, esa ley no es la única que se estaría violentado por parte de Auerbach, ya que el inciso segundo del artículo 184 del Código Electoral establece que “ningún funcionario o funcionaria, empleado o empleada público podrá prevalerse de su cargo para hacer política partidista”.

En su faceta como “analista”, luego de finalizar su periodo como legislador en 2024, ha brindado apoyo abiertamente a Nuevas Ideas; situación que contrasta con la labor que realiza en el TSE; donde, además, el oficialismo vendió la idea de “despartidizar” el TSE tras una reforma constitucional para que los partidos políticos ya no propongan las ternas a las magistraturas.

De momento el exdiputado Romeo Auerbach no se ha pronunciado sobre el tema.
