Various social and union organizations showed their support for the environmental leaders of Cabañas after the Third Section Appeals Chamber of the Center of San Vicente rejected the Attorney General’s Office’s (FGR) request to revive a trial.

It is worth recalling that, at the start of the week, the Santa Marta community and ADES directors held a press conference to announce the chamber’s ruling; they celebrated that the court adhered to the rule of law and did not allow a third trial against the environmental leaders. The FGR lost the trial twice.

Representatives of social and union organizations backed the Chamber’s decision and the environmental leaders, who have spent more than three years under judicial proceedings in which the FGR sought their conviction at all costs for a crime they did not commit, as demonstrated by the two trials in which they were acquitted.

Rafael Paz Narváez, of the University Movement for Critical Thought and the Popular Resistance and Rebellion Bloc (BRP), said the ruling is a “popular triumph,” arguing that “this is a popular struggle that has united the Salvadoran people and all its organizations around a just cause, and it has been proven after two trials that our environmentalist compañeros are completely innocent.”

The university professor stressed that the environmentalists “have set an example in the fight to defend the environment in the country and in the struggle against a project that is being reactivated,” referring to the mining projects where machinery has even been seen entering the territories.

“There are signs that after the 2027 elections, they plan to forcefully renew the implementation of metallic mining operations in the country. That is why they are leaving a pending threat against our environmentalist compañeros, because the government recognizes that the Salvadoran people and the vast majority of organizations are opposed to metallic mining exploitation in the country, and the government has mortgaged the country to foreign companies in an effort to implement metallic mining,” Paz Narváez added. The social leader emphasized that the BRP rejects the government’s attempt to reintroduce metallic mining in El Salvador. The ruling party approved the new General Law on Metallic Mining at the end of 2024, which eliminated the law that prohibited mining operations in El Salvador.

Friar Edison Zamora, of the Ecological Walk, Office of Justice, Peace and Integrity of Creation, said that, as the word of God states, “the truth will set you free,” the environmental leaders have proven their innocence and are therefore free.

“That struggle has been maintained all this time together with organizations and the Santa Marta compañeros, and we continue to reject everything that threatens life, that threatens those who defend the rights of our common home, that threatens those who also defend human rights,” Zamora stated.

The religious leader maintained that as a collective, they must continue the pursuit of the common good and the protection of “what little we have left of our natural goods.” He stressed that mining “is not an option,” and that “mining is not development, but the opposite; it creates an internal conflict within the nation that certainly brings us no benefits, but the opposite: persecution, death, and the destruction of life.”

Mirna Perla, of the “Herberth Anaya Sanabria” Human Rights Collective and former Supreme Court of Justice (CSJ) magistrate, called on the Court to respect the magistrates who, in this case, issued a ruling “in accordance with human rights.”

The attorney noted that the ruling issued in September 2024 is even “contradictory,” because “if there is no criminal liability that can be attributed to the members of the Santa Marta community,” why should they be held civilly liable; as it is worth recalling that some of the leaders were ordered to pay civil damages to the family of the alleged victim.

“This ruling is, in some way, the product of the effort this people achieved at a certain moment with the Peace Accords. That is why we are rejecting the General Law on Mining and the Reciprocal Trade Agreement with the United States,” Perla added.

Silvia Navarrete, of the Movement for the Defense of the Rights of the Working Class (MDCT), celebrated the Chamber’s ruling. “We celebrate a victory wrested from the system. We are equally moved by the fact that it has been proven that organization, that an organized people, has power.”

According to Navarrete, the justice system is “co-opted,” yet “a victory for this collective was achieved, demonstrating that through struggle, one can win.”

Organizaciones celebran fallo que ratifica inocencia de líderes ambientalistas de Cabañas

Diversas organizaciones sociales y sindicales mostraron su apoyo a los líderes ambientalistas de Cabañas luego que la Cámara de la Tercera Sección del Centro de San Vicente rechazara la solicitud de la FGR para reavivar nuevamente un juicio.

Es de recordar que, a inicios de la semana, la comunidad Santa Marta y directivos de ADES brindaron una conferencia de prensa en la que informaron la resolución de cámara; celebraron que la sede judicial se apegara al estado de derecho y no permitir un tercer juicio en contra de los líderes ambientalistas. La FGR perdió dos veces el juicio.

Representantes de organizaciones sociales y sindicales respaldaron esta decisión de la Cámara y a los líderes ambientalistas que han pasado más de 3 años bajo un proceso judicial, que, a toda costa, la FGR buscó su condena de un delito que no cometieron, según se interpreta luego de dos juicios donde han sido absueltos.

Rafael Paz Narváez, del Movimiento Universitario Pensamiento Crítico y del Bloque de Resistencia y Rebeldía Popular (BRP), señaló que la resolución es un “triunfo popular”, ya que consideró que “esta es una lucha popular que ha unido al pueblo salvadoreño y a todas sus organizaciones alrededor de una causa justa y que ha quedado demostrado después de dos juicios que los compañeros ambientalistas son completamente inocentes”.

El docente universitario enfatizó que los ambientalistas “han dado el ejemplo en la lucha por la defensa del medio ambiente en el país y en la lucha contra un proyecto que se está reactivando”, en referencia a los proyectos mineros donde incluso se ha presenciado el ingreso de maquinaria en los territorios.

“Hay indicios que después de las elecciones de 2027 se piensa renovar con fuerza la implementación de operaciones de minería metálica en el país. Por eso es que dejan pendiente una amenaza contra los compañeros ambientalistas, porque el Gobierno reconoce que el pueblo salvadoreño y la gran mayoría de organizaciones están en contra de la explotación minera en el país y el gobierno ha empeñado al país con compañías extranjeras para tratar de implementar la minería metálica”, agregó Paz Narváez. El líder social enfatizó que como BRP rechazan el intento gubernamental de reimplementar la minería metálica en El Salvador. El oficialismo aprobó a finales de 2024 la nueva Ley General de Minería Metálica, con la que se eliminó la ley que prohibía los trabajos mineros en El Salvador.

El fray Edison Zamora, de la Caminata Ecológica, Oficina de Justicia y Paz e Integridad de la Creación, consideró que como dice la palabra de Dios, ´la verdad los hará libres´, los líderes ambientalistas han demostrado su inocencia por ello están libres.

“Esa lucha se ha mantenido todo este tiempo juntamente con organizaciones con los compañeros de Santa Marta y seguimos en el rechazo de todo aquello que atente contra la vida, que atente contra los que defienden derechos de la casa común, que atente contra aquellos que defienden también derechos humanos”, planteó Zamora.

El líder religioso sostuvo que como colectivo, se debe seguir en la búsqueda del bien común, y de resguardar “lo poco que nos queda de los bienes naturales”. Enfatizó que la minería “no es opción”, “la minería no es desarrollo, sino al contrario; entra a un conflicto interno entre nación que ciertamente no nos trae beneficios, sino al contrario; persecución, muerte y destrucción de la vida”.

Mirna Perla, del colectivo Derechos Humanos “Herberth Anaya Sanabria” y ex magistrada de la Corte Suprema de Justicia (CSJ), hizo un llamado a la Corte para que respeten a los magistrados que, en este caso, han emitido un fallo “conforme a derechos humanos”.

La abogada señaló que el fallo emitido en septiembre de 2024, incluso es “contradictorio”, ya que “si no hay responsabilidad penal que se le pueda deducir a los integrantes de la comunidad de Santa Marta”, por qué habrían de ser acreedores una responsabilidad civil; ya que es de recordar que a algunos de los líderes fueron declarados a responder civilmente a la familia de la supuesta víctima por los daños ocasionados.

“Este fallo es producto, de alguna manera, de ese esfuerzo que, en un momento determinado, este pueblo logró con los Acuerdos de Paz. Por eso estamos rechazando esa Ley General de Minería y el Acuerdo de Comercio Recíproco con EUA”, agregó Perla.

Silvia Navarrete, del Movimiento para la Defensa de los Derechos de la Clase Trabajadora (MDCT), celebra el falló de la Cámara. “Celebramos una victoria arrancada al sistema. Igualmente nos emociona el hecho de que queda demostrado que la organización, que el pueblo organizado tiene poder”.

Lo anterior, según consideró Navarrete, el sistema judicial, “está cooptado”, a pesar de ello, se logró “una victoria de este colectivo en donde se ha demostrado que con lucha se puede ganar”.
