A proposed reform to the “Special Law on Statistics and Censuses” adds the Salvadoran Social Security Institute (ISSS) and the Lempa River Hydroelectric Executive Commission (CEL) to the institutions required to provide support for carrying out statistical and census functions, according to the bill.
The reforms were requested by Economy Minister María Luisa Hayem, on presidential instructions.
According to her letter addressed to the Legislative Assembly, the reform aims to “clarify concepts and assumptions for the application of its provisions in order to make possible their proper implementation across all statistical areas that make up the census round,” systematize the carrying out of special surveys, and “guarantee timely collaboration from different public entities and institutions.”
Article 10 currently establishes that municipalities, public institutions, autonomous institutions, and the Legislative and Judicial branches are “required to participate, provide support, and supply information” requested by the BCR to conduct censuses, statistics, or surveys. The proposal would add CEL and ISSS to that article.
The Special Law on Statistics and Censuses regulates El Salvador’s statistical and census activity and creates the National Statistical System.
The reform establishes that, within the “census round,” the Population and Housing, Economic, Agricultural, and Fisheries censuses will be located, and the National Household Income and Expenditure Survey is incorporated into that census round, according to the proposed Article 2.
However, in the reform to Article 14, the National Household Income and Expenditure Survey is removed from the census round carried out by the National Office of Statistics and Censuses. This survey would also be eliminated from Article 15, which regulates the 10-year census period.
The reform proposal introduces the category of special surveys, which will include those requested by the president of the Republic and others identified by other institutions and by the Central Reserve Bank itself. Presidential requests are removed from Article 14.
Article 52 would also add an exemption from all types of taxes for the salaries of people hired for temporary services for statistics and census functions.
The initiative was submitted to the Legislative Assembly at 8:30 a.m. on May 7 and was sent for study to the Committee on Salvadorans Abroad, Legislation, and Government.

Una propuesta de reforma a la “Ley especial de estadísticas y censos” agrega, dentro de las instituciones obligadas a brindar apoyo para la ejecución de la función estadística y censal, al Instituto Salvadoreño del Seguro Social (ISSS) y a la Comisión Ejecutiva Hidroeléctrica del Río Lempa (CEL) según el proyecto.
Las reformas fueron solicitadas por la ministra de Economía, María Luisa Hayem, por instrucciones presidenciales.
Según su carta dirigida a la Asamblea Legislativa, la reforma tiene por objeto “clarificar conceptos y supuestos de aplicación de sus disposiciones a efecto de viabilizar su adecuada implementación a todos los rubros estadísticas que conforman la ronda censal”, sistematizar la realización de encuestas especiales y “garantizar la oportuna colaboración de diferentes entidades e instituciones públicas”.
En el artículo 10, se estable actualmente que las alcaldías, instituciones públicas, autónomas y órganos Legislativo y Judicial están “obligados a participar, brindar apoyo y proporcionar información” solicitada por el BCR para realizar los censos, estadísticas o encuestas. A este artículo, se propone agregar a la CEL y al ISSS.
La Ley especial de estadística y censos regula la actividad estadística y censal de El Salvador y crea el Sistema Estadístico Nacional.
En la reforma se establece que, dentro de la “ronda censal”, se ubicarán los censos de Población y Vivienda, Económico, Agropecuario, Pesca y se incorpora en esta ronda censal a la Encuesta Nacional de Ingresos y Gastos de los Hogares, según la propuesta de artículo 2.
Sin embargo, en la reforma del artículo 14, se suprime la Encuesta Nacional de Ingresos y Gastos de la ronda censal realizada por la Oficina Nacional de Estadísticas y Censos. Esta encuesta también se eliminaría del artículo 15, que regula el plazo censal de 10 años.
La propuesta de reforma introduce la categoría de encuestas especiales, dentro de las cuales estarán las solicitadas por el presidente de la Repúblicas y otras identificadas por otras instituciones y el mismo Banco Central de Reserva. Las solicitudes presidenciales son suprimidas dentro del artículo 14.
En el artículo 52 también se agregaría la exención de todo tipo de tributos para los salarios de las personas contratadas por servicios eventuales para funciones sobre estadísticas y censos.
La iniciativa ingresó a las 8:30 a.m. del 7 de mayo a la Asamblea Legislativa y pasó a estudio de la Comisión de Salvadoreños en el Exterior, Legislación y Gobierno.
