Lawmaker Marcela Villatoro, of the opposition Nationalist Republican Alliance (Arena) party, argued yesterday that the redistribution of the 60 legislative seats contained in a proposed reform to the Electoral Code would violate Article 79 of the Constitution of the Republic.
The legislator responded that she does not believe the proposal maintains the proportional representation required by the second paragraph of Article 79, which reads: “For the election of lawmakers, the system of proportional representation shall be adopted.”
“In fact, it is violating the Constitution. Because Article 79 of the Constitution itself says that the number of lawmakers is based on population size to determine the number of seats — meaning they are leaving a large segment of the population without representation,” she said.
When asked if lawmakers should be reduced proportionally across all departments, she answered: “From no one. They should be added. And if that were the case, that they don’t want more than 60, they should take them from the departments where they migrated from, meaning where the majority were born, which is in the east of the country,” she suggested, pointing out that San Salvador and La Libertad are the departments with the lowest migration.
The lawmaker believes the redistribution was designed to take lawmakers away only from San Salvador and La Libertad, “because those are the departments where there is opposition.”
The Legislative Assembly ratified a reform to Article 79 of the Constitution on Thursday to assign legislative representation to Salvadorans abroad, who would become a 15th electoral district.
In a proposal sent yesterday by the Interior Ministry to reform the Electoral Code, 6 lawmakers are proposed for Salvadorans abroad, taking 5 from the department of San Salvador and 1 from the department of La Libertad. The rest of the departments would keep the same number of seats.
Lawmaker Ernesto Castro, of Nuevas Ideas, stated during the plenary session that the ratification of the constitutional reform is a separate issue from the Electoral Code reform that had to be done later.
The proposed reform to the Electoral Code has not yet been approved. It was sent to the Political Commission for review, which will meet on Monday, May 11.

La diputada Marcela Villatoro, del partido de oposición Alianza Republicana Nacionalista (Arena), consideró ayer que la redistribución de los 60 escaños legislativos contenida en una propuesta de reforma al Código Electoral violaría el artículo 79 de Constitución de la República.
La legisladora respondió que no cree que la propuesta mantenga la representatividad proporcional exigida por el inciso segundo del artículo 79, que reza: «Para elecciones de Diputados se adoptará el sistema de representación proporcional».
«De hecho está violando la Constitución. Porque él mismo artículo 79 de la Constitución dice que los diputados se basan en la cantidad de población para designar la cantidad de escaños, es decir que están dejando sin representante a un buen sector de la población», opinó.
Ante la pregunta si los diputados se deberían restar proporcionalmente a todos los departamentos, contestó: «A nadie. Deben sumarse. Y si fuera así, que no quieren más de 60, deben quitarle a los departamentos donde ellos han migrado es decir donde nacieron la mayoría, que es en el oriente del país», sugirió, señalando que San Salvador y La Libertad son los departamentos con menor migración.
La diputada cree que la redistribución fue diseñada para restar diputados únicamente de San Salvador y La Libertad, «porque son los departamentos donde hay oposición».
La Asamblea Legislativa ratificó el jueves una reforma al artículo 79 de la Constitución para asignar representación legislativa a los salvadoreños en el exterior, quienes serían una circunscripción electoral 15.
En una propuesta enviada ayer por el Ministerio de Gobernación para reformar el Código Electoral, se proponen 6 diputados para los salvadoreños en el exterior, quitando 5 al departamento de San Salvador y 1 al departamento de La Libertad. El resto de departamentos quedaría con la misma cantidad de escaños.
El diputado Ernesto Castro, de Nuevas Ideas, durante la sesión plenaria, aseguró que la ratificación de la reforma constitucional es un tema distinto a la reforma al Código Electoral que se debía hacer después.
La propuesta de reforma al Código Electoral aún no es aprobada. Pasó a estudio de la Comisión Política, que se reunirá el lunes 11 de mayo.
