Lawmaker Marcela Villatoro, of the Nationalist Republican Alliance (Arena), did not vote to ratify the reform to the first paragraph of Article 79 of the Constitution of the Republic because, she said, it is unknown how the Legislative Assembly will be structured after the redistribution of legislative seats.

“Taking lawmakers away from a department means leaving a group of that population without representation,” she warned.

The lawmaker fears that, in order to assign a certain number of seats to the Salvadoran diaspora, seats will be taken away from some departments.

According to Villatoro, they do not reject the content of the reform. “Knowing their maneuvering to manipulate the public, they’re going to say we’re against our brothers and sisters abroad, that we haven’t wanted them to have their representation, and that’s not true,” she said. She added that Arena is fielding diaspora candidates in the internal primaries ahead of the 2027 elections.

“It’s good and it’s necessary (the diaspora electoral district abroad), but I can’t cast a blind vote without knowing the secondary legislation, how it’s going to be drafted. It would be good to have the full picture clear before making a decision. We really don’t know how this Legislative Assembly is going to be structured,” she said. She noted that the opposition parties, “with or without the diaspora, we’re going to compete all the same.” “There will always be [competition] because people are a bit more critical of the decisions being made; many have already understood that there needs to be a balance of different political forces,” she said.

Article 79 of the Constitution, second paragraph, mandates that legislative representation be “proportional.” Although lawmaker Ernesto Castro, of Nuevas Ideas, has not announced which departments would have fewer seats, on Monday he said it would be unfair to take lawmakers away “from departments that have two” and that “obviously in San Salvador there are 16 of us.” Currently, the Electoral Code prohibits any department from having fewer than 2 legislative seats.

La diputada Marcela Villatoro, de Alianza Republicana Nacionalista (Arena), no votó por la ratificación de la reforma al primer inciso del artículo 79 de la Constitución de la República porque aseguró que se desconoce cómo quedará conformada la Asamblea Legislativa luego de la redistribución de los escaños legislativos.

“El quitarle diputados a un departamento es dejar sin representación a un grupo de esa población”, advirtió.

La legisladora teme que, para asignarle una cantidad de escaños a la diáspora salvadoreña, se reste escaños a algunos departamentos.

Según Villatoro, no rechazan el contenido de la reforma. “Conociendo esa maniobra de querer manipular a la población, van a decir que estamos en contra de que los hermanos en el exterior, que no hemos querido que ellos tengan su representación y no es cierto», indicó. Aseguró que Arena lleva candidatos de la diáspora en las elecciones internas de candidatos a los comicios de 2027.

“Es bueno y es necesario (la circunscripción de la diáspora en el exterior), sin embargo, no me puedo definir un voto a ciegas sin conocer la ley secundaria, cómo va a quedar plasmada. Sería bueno tener claro todo el panorama para poder tener una decisión. Desconocemos realmente cómo va a quedar conformada esta Asamblea Legislativa», expresó. Indicó que los partidos de oposición «con o sin la diáspora, igual vamos a competir”. «Siempre va a haber porque la gente está un poco más crítica de las decisiones, muchos ya entendieron que debe existir un balance de diferentes fuerzas políticas», afirmó.

El artículo 79 de la Constitución, inciso segundo, ordena que la representación legislativa sea «proporcional». Aunque el diputado Ernesto Castro, de Nuevas Ideas, no ha anunciado qué departamentos tendrían menos escaños, el lunes aseguró que sería injusto quitarle diputados «a departamentos que tienen dos» y que «obviamente en San Salvador somos 16”. Actualmente, el Código Electoral impide que un departamento tenga menos de 2 escaños legislativos.
