A 20-year-old Venezuelan who was allegedly tortured at the Terrorism Confinement Center (CECOT) has filed a personal injury claim against the U.S. government through a law firm in Utah.
According to attorneys at Parker & McConkie, Johnny Hernández entered the United States legally, has no criminal record, and spent four months inside CECOT, where he allegedly suffered beatings, isolation, and torture. They note that he was released in July 2025 and is still in the process of physical and mental recovery.
The attorneys explain that he was detained by Immigration and Customs Enforcement (ICE) in San Diego, and authorities claimed he was affiliated with the Venezuelan criminal organization Tren de Aragua — an affiliation Hernández denied. The young man was among the 238 migrants deported to El Salvador, most of them accused of belonging to the Venezuelan gang.
This second lawsuit comes after another Venezuelan, Neiyerver Adrián León Rengel, also filed a lawsuit against the United States government in federal court, as he claimed he was beaten by guards at CECOT and has denied any ties to gangs.
Rengel told the U.S. outlet CBS News that the months he spent inside CECOT were “total hell” and that “he and his fellow inmates were constantly beaten and mistreated by the guards.”
Rengel’s lawsuit, filed in the U.S. District Court for the District of Columbia, seeks $1.3 million in damages for unlawful detention and intentional infliction of emotional distress, CBS reported.

Un venezolano de 20 años que presuntamente fue torturado en el Centro de Confinamiento del Terrorismo (CECOT) denunció por daños personales al gobierno estadounidense por medio de una firma de abogados en Utah.
Según los abogados de Parker & McConkie, Johnny Hernández entró de forma legal a Estados Unidos y no tiene antecedentes penales, pasó cuatro meses dentro del CECOT, donde presuntamente sufrió palizas, aislamiento y tortura. Señalan que fue liberado en julio de 2025 y aún se encuentra en proceso de recuperación física y mental.
Los abogados explican que fue detenido por el Servicio de Inmigración y Control de Aduanas (ICE) en San Diego y las autoridades señalaron que estaba afiliado a la organización criminal venezolana Tren de Aragua, afiliación que Hernández negó. El joven formó parte de los 238 migrantes que fueron deportados a El Salvador, la mayoría acusados de pertenecer a la pandilla venezolana.
Esta segunda denuncia surge después de que otro venezolano, Neiyerver Adrián León Rengel, también interpusiera una demanda contra el gobierno de Estados Unidos ante un tribunal federal, pues afirmó que fue golpeado por guardias en el CECOT y ha negado cualquier vínculo con pandillas.
Rengel explicó al medio estadounidense CBS News que los meses en los que pasó dentro del CECOT fueron un “infierno total” y que “él y sus compañeros de prisión eran constantemente golpeados y maltratados por los guardias”.
La demanda de Rengel presentada al Tribunal de Distrito de Estados Unidos para el Distrito de Columbia solicita una indemnización de $1.3 millones de dólares, por detención ilegal y daño moral intencional, informó la CBS.
