On Tuesday, Nuevas Ideas, the PCN, and the PDC approved the 46th extension of the state of exception decree, which suspends constitutional guarantees for the population, consistently at the government’s request.
This extension will be in effect from January 1 to January 30, 2026, marking the approach of the fourth year of the measure, which the government presents as a core element of its anti-gang strategy.
As is customary, Nuevas Ideas caucus leader Christian Guevara requested a waiver of standard legislative procedure to approve the Council of Ministers’ request for another extension of the state of exception.
“As has been emphasized in security policies, particularly in the application of the State of Exception, these measures have fostered the population’s well-being and the country’s development, as well as the recovery of public spaces to encourage investment and enhance quality of life,” the decree’s recitals state.
It adds that more than 90,600 individuals allegedly linked to criminal structures have been captured under the state of exception, “including their principal leaders and a wide range of their members.”
Nevertheless, the government contends that “the persistence of transnational ties, attempts at reorganization, and lingering illicit activities necessitate the continuation of the State of Exception, with the aim of safeguarding the gains achieved, preventing the resurgence of violence, and ensuring comprehensive protection for the Salvadoran population.”
“For 46 consecutive months, we have succeeded in approving the state of exception through this vote, and because of it, lives have been saved,” asserted lawmaker Caleb Navarro.
He stated that, according to official data, October 2025 concluded with 24 homicide-free days, November with 26, and as of last Monday, December has recorded 19 days without homicides.
“These figures demonstrate that we have made the right choice by providing this tool to all security forces in our country,” he added.
Lawmaker Ernesto Castro noted that in previous years, gangs plagued communities and criticized those who highlight the abuses committed under the state of exception as adopting “a negative focus.”
“I have never been able to understand those stances. It is one thing to disagree politically or ideologically on certain points, but there are issues of common ground, of national interest, such as the results of the state of exception,” he stated.
Human rights organizations have reported abuses including arbitrary detentions, torture, and deaths of individuals in state custody.
Régimen de excepción se mantiene hasta enero de 2026
Nuevas Ideas, PCN y PDC aprobaron este martes la prórroga número 46 al decreto del régimen de excepción que suspende garantías constitucionales a la población, siempre a petición del gobierno.
Esta extensión del régimen estará vigente del 1 al 30 de enero de 2026, encaminándose así al cuarto año de la implementación de la medida que el gobierno presenta como parte de su estrategia de combate a las pandillas.
Como es costumbre, el jefe de fracción de Nuevas Ideas, Christian Guevara, solicitó la dispensa de trámites para que se aprobara la solicitud del Consejo de Ministros para otra prórroga al régimen de excepción.
«tal como se ha venido señalando en las políticas de seguridad, especialmente en la aplicación del Régimen de Excepción, estas han permitido un bienestar a la población y al desarrollo del país, así como la recuperación de espacios públicos para fomentar inversiones y mejorar la calidad de vida de la población», dice en los considerandos del decreto.
Añade que se han capturado en el marco del régimen más de 90,600 personas supuestamente vinculadas a estructuras criminales, «incluyendo sus principales líderes y una diversidad de sus miembros».
No obstante, el gobierno argumenta que «la persistencia de vínculos transnacionales, intentos de reorganización y actividades ilícitas remanentes demandan la continuidad del Régimen de Excepción, con el objetivo de preservar los avances alcanzados, evitar el resurgimiento de la violencia y garantizar la protección integral de la población salvadoreña».
«46 meses continuos que hemos logrado, a través de este voto, aprobar el régimen de excepción y por este se han salvado vidas», aseguró el diputado Caleb Navarro.
Afirmó que, según datos oficiales, octubre de 2025 cerró con 24 días sin homicidios, noviembre con 26 y hasta el pasado lunes, diciembre lleva 19 días sin homicidios.
«Estas cifras nos reflejan que hemos acertado al estar dando esta herramienta a todos los cuerpos de seguridad en nuestro país», añadió.
Por su parte, el diputado Ernesto Castro, mencionó que en años pasados las pandillas afectaban a las comunidades y criticó a quienes señalan las arbitrariedades cometidas en el régimen como «un enfoque negativo».
«Nunca he logrado entender esas posturas, porque una cosa es no coincidir políticamente o ideológicamente en algunos puntos; pero hay temas que son comunes, que son de país, como lo que es el fruto del régimen de excepción», expresó.
Organizaciones de derechos humanos han señalado abusos como detenciones arbitrarias y torturas y muertes de personas bajo custodia del Estado.
