With standard legislative procedures waived at the request of Nuevas Ideas—as occurs every month—the Legislative Assembly approved the request from the Council of Ministers for another extension of the state of exception decree on Tuesday. Nuevas Ideas, the PDC, and the PCN voted in favor, while Vamos voted against.
This marks the 45th extension of the state of exception, implemented since March 27, 2022, as a strategy to combat gangs. The measure suspends constitutional guarantees regarding the right to a defense, the duration of administrative detention, and the inviolability of correspondence and telecommunications.
The current extension expires on December 1, 2025. Under this new extension, the measure will remain in effect until December 31, 2025.
Although the government maintains its narrative regarding the reduction in homicides and improved security throughout the national territory—citing the capture of 90,200 individuals—it deems that the measure must remain in force “to continue operational security activities.”
The ruling party persists with the state of exception despite constant reports of arbitrary detentions, abuses, political persecution, and the deaths of at least 456 inmates while in State custody under the framework of the state of exception, according to data recorded by Socorro Jurídico Humanitario (Legal Humanitarian Aid, SJH). At least 183 of the deceased were held at the Izalco prison.
The government asserts that “remnants” of gangs persist without full dismantlement. It also notes that coordination is required to prevent the incorporation of deportees into these structures and the cross-border movement of their members.
“Nevertheless, active remnants of said groups persist in the national territory, along with their support networks and criminal practices for subsistence and financing that have not been completely dismantled. In this sense, it is fundamental to maintain the public security that has been built and to eradicate these criminal groups in their entirety; consequently, it is necessary to continue the forceful State action developed and sustained by the state of exception,” argues the note from the Council of Ministers.
It is worth noting that several penal reforms have also been approved enabling the Attorney General’s Office to file mass indictments, utilizing “faceless judges,” and extending provisional detention for up to two years. According to international bodies and human rights organizations, these reforms undermine due process.
Asamblea mantiene vigencia del régimen de excepción
Con dispensa de trámites solicitada por Nuevas Ideas, como cada mes, la Asamblea Legislativa aprobó este martes la petición del Consejo de Ministro de otra prórroga al decreto del régimen de excepción. Votaron a favor Nuevas Ideas, PDC y PCN y en contra Vamos.
Esta es la prórroga número 45 al régimen de excepción, que se implementa desde el 27 de marzo de 2022 como medida de combate a las pandillas, con la suspensión de garantías constitucionales que se refieren al derecho de defensa, el plazo de la detención administrativa y la inviolabilidad de la correspondencia y las telecomunicaciones.
La última prórroga vence el 1 de diciembre de 2025. Con esta nueva extensión, el régimen se mantiene hasta el 31 de diciembre de 2025.
Pese a que el gobierno mantiene el discurso del la reducción de homicidios y la mejora de la seguridad en el territorio nacional, con la captura 90,200 personas, considera que la medida debe continuar vigente, «para continuar las actividades operativas de seguridad».
El oficialismo continúa con el régimen pese a las constantes denuncias de detenciones arbitrarias, abusos, persecución política y hasta 456 reos que fallecieron estando bajo custodia del Estado, en el marco del régimen de excepción, según los datos que registra la organización Socorro Jurídico Humanitario (SJH). Al menos 183 de los fallecidos estaban en el penal de Izalco.
El gobierno afirma que «persisten remanentes» de pandillas que no han sido desarticuladas. También señala que se requiere coordinación para evitar la incorporación de deportados en estas estructuras y el desplazamiento transfronterizo de sus miembros.
«Sin embargo, persisten remanentes activos de dichos grupos en el territorio nacional, de sus redes de apoyo y de prácticas criminales para su subsistencia y financiamiento que no han sido completamente desarticuladas, en ese sentido, es fundamental mantener la seguridad pública construida y erradicar en su totalidad estos grupos criminales; en
consecuencia, es necesario continuar con la acción estatal contundente desarrollada y sustentada en el régimen de excepción», argumenta la nota del Consejo de Ministros.
Cabe señalar que también se han aprobado varias reformas de carácter penal que habilitan a la Fiscalía para hacer acusaciones judiciales masivas, se aplican jueces sin rostro y la detención provisional se extiende hasta dos años. Reformas que según organismos internacionales y organizaciones de derechos humanos atentan contra el debido proceso.
