This November 25 marks the deadline of seven days that the Inter-American Commission on Human Rights (IACHR) granted the Salvadoran State to report on the situation of Salvadoran national Élmer Escobar, who was deported on March 31 and whose family has had no news of him to date.
Élmer was deported on a second flight of Venezuelans who were sent to the Terrorism Confinement Center (CECOT); however, he appears to have been transferred to the Santa Ana Industrial Penitentiary and Rehabilitation Center, according to a government-released video in which his family identified him.
On November 18, the IACHR requested that El Salvador disclose Élmer’s location and health status.
“Indicate the official whereabouts of the proposed beneficiary and whether he is under State custody; if he is deprived of liberty, detail: the detention center where he is being held. His health status and conditions of detention, as well as the feasibility of visits from family members and trusted legal counsel,” the document states.
This letter is in response to a request for precautionary measures filed by Élmer’s family with the international body.
In early October, LA PRENSA GRÁFICA reported that Élmer’s family had filed a writ of habeas corpus before the Constitutional Chamber of the Supreme Court of Justice (CSJ) to ascertain the Salvadoran’s whereabouts. The court merely instructed them to better substantiate the claim, but no progress ensued, prompting them to turn to the IACHR.
Élmer migrated to the United States at the age of 13 and worked in a restaurant, leaving behind a partner and two children in that country.
LA PRENSA GRÁFICA contacted the press and communications office of the Salvadoran Ministry of Foreign Affairs for comment regarding the report requested by the IACHR, but received no response by press time.
CIDH da siete días al Estado salvadoreño para ubicar a un deportado que llegó junto a venezolanos en marzo
Este 25 de noviembre se cumple el plazo de siete días que la Comisión Interamericana de Derechos Humanos (CIDH) otorgó al Estado salvadoreño para que informara sobre la situación del salvadoreño Élmer Escobar, que fue deportado el pasado 31 de marzo y de quien hasta el momento su familia no sabe nada.
Élmer fue deportado en un segundo vuelo de venezolanos que fueron enviados al Centro de Confinamiento del Terrorismo (CECOT), pero al parecer a él lo enviaron al Centro Industrial de Cumplimiento de Penas y Rehabilitación de Santa Ana, según un video publicado del gobierno donde su familia lo reconoció.
La CIDH pidió el 18 de noviembre a El Salvador que informe dónde está Élmer y cuál es su estado de salud.
Indicar el paradero oficial del propuesto beneficiario y si se encuentra bajo la custodia del Estado; de encontrarse privado de su libertad, detallar: en qué centro de detención se encuentra recluido. Su estado de salud y cuáles son las condiciones de detención, así como las posibilidades de que tenga visitas de familiares y abogados de confianza”, dice el escrito.
Esta carta responde a una solicitud de medidas cautelares que interpuso la familia de Élmer ante dicho organismo internacional.
A inicios de octubre de este año, LA PRENSA GRÁFICA publicó que la familia de Élmer interpuso un habeas corpus ante la Sala de lo Constitucional de la Corte Suprema de Justicia (CSJ) para saber el paradero del salvadoreño, y solo les dijo que argumentaran mejor la demanda, pero no hubo avances, por ello, buscaron a la CIDH.
Élmer viajó a Estados Unidos a los 13 años y trabajaba en un restaurante. Dejó en el país norteamericano a su pareja con sus dos hijos.
LA PRENSA GRÁFICA buscó una versión de Cancillería salvadoreña sobre el informe que pidió la CIDH, a través de sus encargados de prensa y comunicaciones, pero al cierre de esta nota no hubo respuesta.
