The Attorney General’s Office (FGR) filed an indictment this Monday, November 24, against Armed Forces of El Salvador (FAES) soldier Derman Fernando Jorge Benítez, the alleged perpetrator of the homicide of Jessica Solís, which was committed on November 6 in front of the National Palace in San Salvador.
El Diario de Hoy made inquiries at the Isidro Meléndez Judicial Center, where judicial sources confirmed that the case was submitted this Monday morning before the Third Justice of the Peace Court of San Salvador.
However, upon requesting information regarding the specific crime for which the soldier was accused, officials stated that the case is under seal and they could not provide further details regarding the criminal proceedings.
The case is being handled with utmost secrecy. Inquiries were also made at the Third Justice of the Peace Court, but officials at that judicial venue denied that the indictment had been filed there and offered no additional details on the matter.
The Attorney General’s Office took 18 days to file charges against the soldier. The police announced on social media on November 6 the arrest of Derman Fernando, presenting him as the alleged perpetrator of Jessica Solís’s homicide. She died that same afternoon after sustaining a gunshot wound while walking past the National Palace.
Police authorities stated that, “after concluding forensic examinations and interrogations,” the soldier stationed in the Historic Center “accidentally discharged his firearm and struck the victim.” Furthermore, they mentioned that he would be prosecuted for the crime of negligent homicide, after he allegedly confessed to the events.
This news outlet also inquired this morning with the press officer of the Attorney General’s Office regarding the charge imputed to the soldier and the date of the initial hearing, but has not yet received a response.

La Fiscalía General de la República (FGR) presentó este lunes 24 de noviembre el requerimiento fiscal (acusación) en contra del soldado de la Fuerza Armada de El Salvador (FAES), Derman Fernando Jorge Benítez, supuesto responsable del homicidio de Jessica Solís, cometido el 6 de noviembre frente al Palacio Nacional de San Salvador.
El Diario de Hoy consultó en el Centro Judicial Isidro Meléndez, donde fuentes judiciales confirmaron que el caso fue presentado la mañana de este lunes ante el Juzgado Tercero de Paz de San Salvador.
Sin embargo, al solicitar información sobre el delito por el que fue acusado el militar, aseguraron que el caso tiene reserva y no podían brindar más detalles sobre el proceso penal.
El caso se está manejando con total hermetismo. También se consultó al Juzgado Tercero de Paz, pero en esta sede judicial negaron que el requerimiento fue presentado en este lugar y tampoco ampliaron sobre el caso.
La Fiscalía tardó 18 días para presentar la acusación en contra del militar. La Policía Nacional Civil (PNC) anunció en sus redes sociales el pasado 6 de noviembre la captura de Derman Fernand, quien fue presentado como el supuesto responsable del homicidio de Jessica Solís, quien murió la tarde de ese mismo día tras recibir un impacto de bala cuando pasaba frente al Palacio Nacional.
Las autoridades policiales aseguraron «tras concluir las pericias e interrogatorios» que el militar destacado en el Centro Histórico «accionó accidentalmente su arma de fuego e impactó a la víctima». Además, mencionaron que sería procesado por el delito de homicidio culposo, luego de que supuestamente confesó los hechos.
Este medio de comunicación también preguntó esta mañana a la encargada de prensa de Fiscalía sobre el delito imputado al militar y la fecha de la audiencia inicial, pero todavía no se ha recibido respuesta.
