The Legislative Assembly has received a proposal from the central government to dissolve the Consejo para la Inclusión de las Personas con Discapacidad (National Council for the Inclusion of Persons with Disabilities, CONAIPD) and the Consejo Nacional Integral de la Persona Adulta Mayor (National Comprehensive Council for Older Adults, CONAIPAM), citing the need to “optimize” state resources.
“The public-law entity known as the Consejo Nacional para la Inclusión de las Personas con Discapacidad, hereinafter CONAIPD, created in 2020, is hereby declared dissolved; accordingly, its liquidation shall be completed no later than within six months,” reads the proposal sent to the Comisión de Niñez e Integración Social (Committee on Children and Social Integration).
If approved, upon taking effect, the functions and responsibilities of CONAIPD set forth in the Special Law on the Inclusion of Persons with Disabilities, along with related duties, would be transferred to the Instituto Administrador de los Beneficios y Prestaciones Sociales de los Veteranos Militares de la Fuerza Armada y Excombatientes (Institute for the Administration of Social Benefits and Services for Military Veterans of the Armed Forces and Ex-Combatants, INABVE).
The dissolution of both institutions would be overseen by a liquidation commission, which will be tasked with the administration and legal representation of CONAIPD during the liquidation period. This commission will consist of the president of CONAIPD or their delegate, the president of INABVE’s Board of Directors or their delegate, and a representative from the Ministry of Finance.
Its duties will include conducting a comprehensive inventory of assets and another of judicial and administrative proceedings, as well as formulating and executing a work plan to carry out the liquidation of CONAIPD and the transfer of its functions and assets to INABVE.
All obligations arising from the liquidation process shall be covered by CONAIPD; any obligations not settled within the stipulated period shall become the responsibility of the Ministry of Finance. To that end, CONAIPD may request the corresponding supplementary budget allocations.
“Breaches of labor, contractual, or regulatory obligations, or those involving the delivery of products or services, or of any other nature by CONAIPD, shall not be transferred to INABVE under any circumstances,” the proposal stipulates.
CONAIPD was established in El Salvador in 1993 as the lead agency for the care and rights of persons with disabilities in the country. In 2020, a new Special Law for the Inclusion of Persons with Disabilities was approved, establishing a new CONAIPD vested with greater autonomy in its role as lead agency.
Council for Older Adults
The proposal to dissolve the National Comprehensive Council for Older Adults (CONAIPAM) also stipulates that its functions will be transferred to INABVE, with the distinction that this institution may establish a national roundtable for stakeholder discussions.
The Ministry of Finance must transfer CONAIPAM’s budget appropriations to INABVE as its budget allocation and must also transfer the appropriations earmarked for payment of the non-contributory pension for older adults referred to in the Special Law for the Protection of the Rights of Older Adults.
“In accordance with the provisions of the Special Law for the Protection of the Rights of Older Adults, the Ministry of Finance shall transfer to INABVE the funds obtained from pecuniary sanctions imposed for violations of said law; it must transfer them in full to INABVE to finance measures and actions that guarantee compliance with the rights of older adults,” the proposal states.
CONAIPAM was created in 2022 as part of the implementation of the Special Law for the Protection of the Rights of Older Adults in El Salvador.
Both draft decrees will be studied by the Committee on Children and Social Integration, which is scheduled to convene on November 17 at 2:30 p.m.
Gobierno busca disolver el CONAIPD y el Consejo de la Persona Adulta Mayor
La Asamblea Legislativa recibió la solicitud del gobierno central para disolver el Consejo para la Inclusión de las Personas con Discapacidad (CONAIPD) y el Consejo Nacional Integral de la Persona Adulta Mayor (CONAIPAM), bajo el argumento de “optimizar” recursos del Estado.
“Declárase disuelta la entidad de derecho público denominada Consejo Nacional para la Inclusión de las Personas con Discapacidad, en adelante CONAIPD, creado en 2020, en consecuencia, procédase a su liquidación a más tardar en el plazo de seis meses”, define la propuesta enviada a la Comisión de Niñez e Integración Social.
De aprobarse la medida, a partir de su entrada en vigencia, las funciones y responsabilidades del CONAIPD contempladas en la Ley Especial de Inclusión de las Personas con Discapacidad, así como otras relacionadas, serían transferidas al Instituto Administrador de los Beneficios y Prestaciones Sociales de los Veteranos Militares de la Fuerza Armada y Excombatientes (INABVE).
La disolución de ambas instituciones estaría a cargo de una comisión liquidadora, a la que le corresponderá la administración y representación legal del CONAIPD durante el plazo de la liquidación. Dicha comisión estará integrada por el presidente del CONAIPD o su delegado, el presidente de la Junta Directiva del INABVE o su delegado, y un representante del Ministerio de Hacienda.
Sus funciones serán hacer un inventario general de bienes y otro de los procesos judiciales y administrativos; formular y dar cumplimiento a un programa de trabajo para realizar la liquidación del CONAIPD y el traslado de las funciones y bienes al INABVE.
Todas las obligaciones derivadas del proceso de liquidación serán cubiertas por el CONAIPD, y en lo que no se logre cubrir en el plazo estipulado será responsabilidad del Ministerio de Hacienda. Para cumplir lo anterior, el CONAIPD podrá solicitar los refuerzos presupuestarios correspondientes.
“Los incumplimientos de obligaciones laborales, contractuales, normativas, de entrega de productos o servicios, o de cualquier otra índole por parte del CONAIPD no serán transferidas al INABVE bajo ninguna circunstancia”, contempla la propuesta.
El CONAIPD se creó en El Salvador en 1993 como el ente rector para la atención y los derechos de las personas con discapacidad en el país. En 2020 se aprobó la nueva Ley Especial de Inclusión de las Personas con Discapacidad, con la cual se creó un nuevo CONAIPD que tendría más autonomía en su papel como ente rector.
Consejo del adulto mayor
En el caso de la propuesta de la disolución del Consejo Nacional Integral de la Persona Adulta Mayor (CONAIPAM), también se establece que se transferirán sus funciones al INABVE, con la diferencia que esta institución podrá crear una mesa nacional en la que involucrados puedan involucrarse en discusiones.
Hacienda deberá realizar el traslado de las asignaciones presupuestarias del CONAIPAM como asignación presupuestaria al INABVE, deberá también trasladar las asignaciones contempladas para el pago de la pensión no contributiva destinada a la persona adulta mayor a que se refiere la Ley Especial para la Protección de los Derechos de la Persona Adulta Mayor.
“De conformidad con lo dispuesto la Ley Especial para la Protección de los Derechos de la Persona Adulta Mayor, Hacienda deberá trasladar al INABVE los fondos obtenidos por las sanciones pecuniarias impuestas por infracciones cometidas a dicha ley, deberá trasladarlos íntegramente al INABVE para financiar las medidas y acciones que garanticen el cumplimiento de los derechos de las personas adultas mayores”, se propone.
El CONAIPM fue creado en 2022 en el marco de la implementación de la Ley Especial para la Protección de los Derechos de las Personas Adultas Mayores en El Salvador
Ambos proyectos de decreto se estudiarán en la Comisión de Niñez e Integración Social, cuya sesión está programada para el 17 de noviembre a las 2:30 de la tarde.
