Attorney Alejandro Henríquez and Pastor José Ángel Pérez must remain in pretrial detention after a judge on October 29 denied their request for conditional release, a decision their defense team and civil society organizations describe as baseless, as they presented sufficient proof of community ties to secure their freedom.
The special hearing to review pretrial measures was held at the Centro Judicial Integrado de Santa Tecla (Integrated Judicial Center of Santa Tecla), where relatives of the detainees gathered to show support and demand their release.
However, after just over an hour of deliberation, the judge of the Second Investigating Court of Santa Tecla ruled that they must remain in custody until the next preliminary hearing, which is scheduled for December 2025.
“As the legal team, we had no doubt that they meet the conditions to avoid pretrial detention. A financial bond was offered for double the amount that had been proposed—and even more, had the judge suggested or required it. And despite all these conditions, the state of our justice administration system is truly regrettable. They have again denied Pastor Ángel and Alejandro their freedom, upholding the pretrial detention order. That is the outcome,” stated defense attorney Oswaldo Feusier upon leaving the courthouse.
Defense counsel also noted that Alejandro has “skin conditions” and that José has lost hearing in his left ear, as neither has received medical attention since their detention in May, despite repeated requests.
After the hearing, the judge granted time for the defendants’ families and attorneys to meet.
Regarding Their Arrests
José Ángel Pérez was arrested on the night of May 12 while participating in a peaceful protest with the El Bosque cooperative, whose residents were demanding not to be evicted from the land they inhabit.
Alejandro was also present at this protest, but although authorities attempted to take him into custody, they did not. It was not until the following day that police arrived at the offices of the Foro del Agua (Water Forum), of which he is a member, and arrested him there.
In July 2025, Amnesty International (AI) recognized Henríquez and Pérez as “prisoners of conscience,” as they are detained for defending human rights.
During the hearing, residents of the El Bosque cooperative, members of Foro del Agua, and the Movimiento Político Rebelión Verde (Green Rebellion Political Movement, REVERDES) gathered at the courthouse to show their support for the two defendants and demand their freedom.

El abogado Alejandro Henríquez y el pastor José Ángel Pérez deberán continuar en detención provisional luego que un juez rechazó este 29 de octubre otorgarles libertad con medidas sustitutivas, algo que su defensa y organizaciones de sociedad civil califican como una decisión sin fundamento, pues presentaron arraigos suficientes para recuperar su libertad.
La audiencia especial de revisión de medidas se realizó en el Centro Judicial Integrado de Santa Tecla, donde familiares de los capturados llegaron para dar muestras de apoyo y exigir que los dejen libres.
Sin embargo, tras poco más de una hora de deliberación, la jueza Segundo de Instrucción de Santa Tecla decidió que deben continuar detenidos hasta que se realice la próxima audiencia, la preliminar, que debería pautarse en el mes de diciembre de 2025.
“Como equipo de abogados no teníamos ninguna duda de que ellos están en condiciones para no estar en detención provisional. Se ofreció una caución económica que era el doble de lo que se había ofrecido, incluso más si la juzgadora lo proponía o lo establecía. Y a pesar de todas las anteriores condiciones es lamentable realmente la situación en la que se encuentra nuestro sistema de administración de justicia, nos han negado nuevamente que el pastor Ángel y que Alejandro puedan seguir en libertad, confirmando la detención provisional. Ese es el resultado”, indicó Oswaldo Feusier, abogado defensor, al salir del juzgado.
Los defensores también mencionaron que Alejandro tiene “afecciones en la piel” y que José ha perdido la audición en su oído izquierdo, pues desde que fueron detenidos en mayo no han recibido atención médica, a pesar que sí la han solicitado.
Luego de la audiencia, la jueza otorgó un espacio para que la familia y abogados de los imputados se reunieran.
Sobre sus capturas
José Ángel Pérez fue capturado en la noche del 12 de mayo cuando participaba en una protesta pacífica de la cooperativa El Bosque en la cual sus habitantes pedían no ser desalojados de las tierras donde habitan.
En esta protesta también estuvo Alejandro, pero aunque las autoridades también intentaron llevárselo no lo hicieron. Fue hasta el día siguiente que los policías llegaron a las oficinas del Foro del Agua, del cual es miembro, y ahí lo capturaron.
En julio de 2025 Amnistía Internacional (AI) reconoció a Henríquez y Pérez como “presos de conciencia”, ya que están detenidos por defender derechos humanos.
Durante la audiencia, habitantes de la cooperativa El Bosque, miembros del Foro del Agua y el Movimiento Político Rebelión Verde (REVERDES) llegaron a las instalaciones a mostrar el apoyo a los dos procesados y pidieron su libertad.
