Kevin Balmore Valencia Guillén, 28, died in the early hours of Friday, October 24, after suffering an electric shock on Monday, October 20, while working for the Programa Cero Ocio (Zero Idleness Program) of the Dirección General de Centros Penales (General Directorate of Penal Centers, DGCP). He had been captured under the state of exception, and his family learned of the accident through social media.
The young man’s father, who requested anonymity for fear of reprisal, recounted that on Monday, October 20, they saw their son’s face in a social media post alerting them to a prisoner who had suffered a workplace accident. They confirmed that Kevin was collaborating on the construction of a kindergarten in Ayutuxtepeque as part of the Zero Idleness Program. The day before, his father had dropped off a $100 package for him.
Kevin had been arbitrarily captured in May 2022, and since then his family had had no contact with him. They had seen him in videos from the Zero Idleness Program and thus learned that the young man was participating in construction work. He had not yet received a conviction.
After learning of the accident, they discovered that the young man had been taken to Hospital Zacamil and was in intensive care. But on the morning of Friday, October 24, a funeral home notified them that he had died. After that, someone from the Penal Centers called to inform them that they needed to go to the Institute of Legal Medicine to retrieve the body.
“He was my youngest son. I saw him in TikTok videos and never imagined anything would happen to him. He was fine; we had been told that in the hospital he had been stable, but later they told us they had intubated him, and now they come out and tell us that he is already dead,” said his father, who traveled from Izalco, where they are from.
Kevin’s older brother was also notified of his death while he was working and traveled from Izalco to accompany his father.
“As a family, we are devastated by my brother’s death. He was captured, but he was innocent. He leaves behind an eight-year-old boy, and we do not know how to tell him that his father has died. We demand justice and for the state of exception to end because it is leaving deep mourning in the families of detainees who are innocent,” he stated.
According to the death certificate given to his father by the Institute of Legal Medicine, the cause of death was pulmonary edema, pending further investigation.
They Demand Justice
Kevin’s family denounces the young man’s arbitrary capture and assures that the police report contained several falsehoods, since the police stated that he was arrested on May 20 on the street with another gang member, when in fact he was arrested the day before at the family home.
“It is a feeling of anguish we have as a family. He (Kevin) leaves an abandoned child, who loved him more than anything, and that is what the government does not see—the suffering of innocent people,” his brother asserted.
The family emphasized that more than three years had already passed for authorities to investigate Kevin and substantiate the charges. They had documentation attesting to his community ties to demonstrate his innocence and said there had been ample time to show he had committed no crime, but there was never any progress in the judicial process. Now they lament that they are seeing him again only to hold a wake and lay him to rest.
“Under the state of exception my son has died. I leave things to God because I cannot ask for other things, that God hold them to account for what they have just done to my son, which is an injustice,” his father said.
In June of this year, LA PRENSA GRÁFICA reported that, according to criminal lawyers, it is “unconstitutional” to use detainees on government construction projects. A month earlier, this media outlet published a field report documenting that detainees were being used to build several schools in San Salvador.
LA PRENSA GRÁFICA requested comment from the communications office of Centros Penales regarding the young man’s death and how the accident occurred, but as of publication there was no response.
Joven capturado en régimen de excepción y que laboraba en Programa Cero Ocio murió por una descarga eléctrica
Kevin Balmore Valencia Guillén, de 28 años, murió a tempranas horas de este viernes 24 de octubre luego de sufrir una descarga eléctrica el pasado lunes 20 de octubre, cuando trabajaba para el Programa Cero Ocio, de la Dirección General de Centros Penales (DGCP). Él había sido capturado en el marco del régimen de excepción y su familia se enteró del accidente por redes sociales.
El padre del joven, que pidió anonimato por temor a represalias, contó que el lunes 20 de octubre vieron el rostro de su hijo en una publicación de redes sociales donde se alertaba de un privado de libertad que había sufrido un accidente laboral. Según constataron, Kevin colaboraba en la construcción de un kínder en Ayutuxtepeque, como parte del Plan Cero Ocio. Un día antes, su padre le había ido a dejar un paquete de $100.
Kevin había sido capturado en mayo de 2022 de forma arbitraria y desde entonces su familia no tenía contacto con él. Lo habían visto en videos del programa Cero Ocio y así conocieron que el joven participaba en labores de construcción. Él no había recibido aún una condena.
Tras enterarse del accidente se enteraron que el joven había sido llevado al Hospital Zacamil y que estaba en cuidados intensivos. Pero la mañana de este viernes 24 de octubre una funeraria les avisó que él había fallecido. Después de eso le llamó alguien de Centros Penales para informarles que debían pasar por Medicina Legal a retirar el cuerpo.
“Era mi hijo menor. Yo lo veía en los videos de Tiktok y jamás pensé que le pasaría algo. Él estaba bien, nos habían contado que en el hospital había estado estable, pero después nos contaron que lo habían entubado y ahora nos salen con que ya está muerto”, dijo su padre, que viajó desde Izalco, de donde son originarios.
El hermano mayor de Kevin también fue avisado de su muerte mientras estaba trabajando y viajó desde Izalco para acompañar a su papá.
“Como familia estamos destrozados con la muerte de mi hermano- Él fue capturado pero era inocente. Deja a un niño de ocho años que no sabemos cómo decirle que su papá murió. Pedimos justicia y que el régimen de excepción termine porque está dejando mucho luto en las familias de capturados qué son inocentes”, expuso.
Según la esquela entregada por el Instituto de Medicina Legal a su padre, la causa de su muerte fue un edema pulmonar, a espera de más investigación:
Piden justicia
La familia de Kevin denuncia la captura arbitraria del joven y aseguran que la ficha policial tenía varias mentiras, pues los policías pusieron que él fue detenido el 20 de mayo en la calle junto a otro pandillero, cuando la captura fue un día antes y en la casa de su familia.
“Es una consternación que sentimos como familia. Él (Kevin) deja un niño abandonado, que lo amaba más que cualquier cosa y eso es lo que el gobierno no ve, el sufrimiento de las personas inocentes”, aseguró su hermano.
La familia hizo énfasis en que ya habían pasado más de tres años para que investigaran a Kevin y demostraran los cargos. Ellos tenían los arraigos para demostrar su inocencia y manifestaron que hubo tiempo suficiente para demostrar que no había cometido ningún delito, pero nunca hubo avances en el proceso judicial. Ahora lamentan que se reencuentran con él para velarlo y enterrarlo.
“Bajo el régimen de excepción ha muerto mi hijo, le dejo las cosas a Dios porque no puedo pedir otras cosas, que Dios les pase factura por lo que acaban de hacer con mi hijo que es una injusticia”, dijo su padre.
En junio de este año LA PRENSA GRÁFICA publicó que, según abogados penalistas, es “inconstitucional” utilizar a privados de libertad en construcciones promovidas por el gobierno. Un mes antes, este medio publicó un reportaje sobre el recorrido que se realizó para comprobar que privados de libertad eran ocupados para la construcción de varias escuelas en San Salvador.
