A group of victims of the embezzlement at the Cooperativa Santa Victoria (COSAVI) appeared this Friday at the Procuraduría para la Defensa de los Derechos Humanos (Office of the Human Rights Ombudsman, PDDH) to demand a response from Ombudsman Raquel Caballero to the petition they filed in September 2024.
During the gathering, they denounced that to date, seven depositors have died since the cooperative was placed under administrative intervention in May 2024 over a multimillion-dollar embezzlement, and were unable to recover their funds.
In May 2024, the Fiscalía General de la República (Office of the Attorney General) disclosed a $35 million financial fraud affecting the cooperative’s depositors and announced that 32 individuals are implicated and under prosecution in the case.
The seventh fatality was a 90-year-old individual who, according to group spokesperson Juan José Ortiz, had $1.8 million in savings at the cooperative. “Unfortunately, the gentleman passed away last Monday, leaving his children as beneficiaries of this $1.8 million,” he stated.
“In September 2024, we came here to file a complaint denouncing the violation of several human rights as victims of COSAVI, most importantly the right to life. Today, we wish to report the death of the seventh victim in this case,” Ortiz stated.
A little over a year ago, when the group of victims submitted the complaint to the PDDH, the death toll was three. A year later, this figure has risen to seven. “How many more people must die before the ombudsman attends to us?” Ortiz questioned.
“The death of Mr. Campos exemplifies that people aged 80 or 85 cannot endure waiting two or three years for their money to be returned. The sole resolution for the COSAVI case is a trust fund, so the one with the power and resolve to address this is President (Nayib) Bukele,” he added.
Another factor prompting the COSAVI victims to appear before this institution was that the recently reelected human rights ombudsman stated before the Legislative Assembly’s Political Commission that she was “on the verge of issuing a resolution on this case.”
This Friday, two representatives from the group were received by Rosa Sandoval, deputy ombudsman for the defense of economic, social, cultural, and environmental rights, who requested “a vote of confidence” in this new administration.
“As we anticipated, the head ombudsman did not meet with us; she dispatched the deputy ombudsman. The conversation was quite cordial, yet left a bitter taste. The Ombudsman’s Office is trying to give us explanations that lack any substance,” Ortiz asserted.
Furthermore, the group considers the role the PDDH might play in the current context alarming, as they assert that no institution has received or attended to them. They cite as examples Casa Presidencial, the Legislative Assembly, the Superintendency of the Financial System, and the Office of the Attorney General. “What makes us think the Ombudsman’s Office will be any different?” Ortiz emphasized.
Judges to Be Denounced
The spokesperson for the COSAVI victims announced that next week they will file a new complaint with the PDDH to denounce violations of the right of access to justice.
Ortiz affirmed that to date, they have filed 109 lawsuits before civil and commercial courts, and none has been admitted. “Next week, we will submit a letter denouncing by full name the 15 judges who have rejected the 109 lawsuits we have filed regarding our case,” he said.
He added that some of the arguments judges have used to deny the lawsuits include requesting COSAVI’s articles of incorporation or the original credential authorizing the Superintendency of the Financial System to place the cooperative under intervention.
“These 15 judges will face accusations both nationally and internationally. It is untenable: 109 lawsuits filed, and none has advanced. We are witnessing complicit conduct from the judicial branch,” he concluded.
Afectados de COSAVI confirman muerte de séptimo ahorrante de la cooperativa
Un grupo de afectados del desfalco en la Cooperativa Santa Victoria (COSAVI) se presentó este viernes a la Procuraduría para la Defensa de Derechos Humanos (PDDH) para pedirle a la procuradora Raquel Caballero una respuesta a la solicitud que presentaron en septiembre de 2024.
En la concentración denunciaron que hasta la fecha ya van siete ahorrantes que han fallecido desde que la cooperativa fue intervenida por un desfalco millonario, en mayo de 2024, y que no pudieron recibir su dinero.
En mayo de 2024, la Fiscalía General dio a conocer el fraude financiero de 35 millones de dólares de los ahorrantes de la cooperativa e informaron que 32 personas están involucradas y procesadas por este caso.
La séptima víctima mortal fue una persona de 90 años, quien, según Juan José Ortiz, vocero del grupo, tenía $1.8 millones de ahorros en la cooperativa. “Lamentablemente el señor falleció el lunes de la semana pasada y quedan como beneficiarios de estos 1.8 millones sus hijos”, mencionó.
“En septiembre de 2024 vinimos a dejar un escrito denunciando la violación de varios derechos humanos como afectados de COSAVI, el más importante el derecho a la vida, este día queremos informar el fallecimiento de la séptima víctima del caso”, informó Ortiz.
Hace un poco más de un año, cuando el grupo de afectados presentó el escrito ante la PDDH, la cantidad de fallecidos era de tres. Luego de un año esta cifra aumentó a siete. “¿Cuántas personas más tienen que fallecer para que la procuradora nos atienda?”, cuestionó Ortiz.
“La muerte del señor Campos es una muestra que personas de 80 u 85 años no podemos estar esperando dos o tres años a que nos devuelvan el dinero, la única solución que tiene el caso COSAVI es el fideicomiso, entonces quien tiene la decisión y voluntad de resolver esto es el presidente (Nayib) Bukele”, añadió.
Otro aspecto que motivó a los afectados de COSAVI a presentarse ante esta institución fue que la recién reelecta procuradora de derechos humanos dijo ante la Comisión Política de la Asamblea Legislativa que estaba “por emitir una resolución de este caso”.
Este viernes, dos representantes del grupo fueron atendidos por Rosa Sandoval, procuradora adjunta para la defensa de los derechos económicos, sociales, culturales y ambientales, quien les pidió “un voto de confianza” en esta nueva administración.
“Tal como lo esperábamos no nos atendió la titular, nos envió a la procuradora adjunta. La plática ha sido muy cordial, sin embargo con sinsabores, la Procuraduría nos quiere dar explicaciones que no tienen ningún sentido”, aseguró Ortiz.
Además, el grupo considera alarmante el rol que podría jugar la PDDH en el contexto actual, ya que desde el grupo aseguran que en ninguna institución han sido recibidos o atendidos. Ponen de ejemplo Casa Presidencial, la Asamblea Legislativa, la Superintendencia del Sistema Financiero y la Fiscalía General de la República. “¿Qué nos hace pensar que la procuraduría si lo va hacer?”, recalcó Ortiz.
Denunciarán a jueces
El vocero de los afectados de COSAVI adelantó que la próxima semana presentarán un nuevo escrito ante la PDDH para denunciar vulneración de derechos a la justicia.
Ortiz aseguró que hasta la fecha han presentado 109 demandas ante juzgados de lo civil y mercantil y ninguna ha sido admitida. “La próxima semana vamos a dejar una carta denunciando a los 15 jueces con sus nombres y apellidos que han rechazado las 109 demandas que hemos presentado con respecto a nuestro caso”, dijo.
Agregó que algunos de los argumentos utilizados por los jueces para denegar la demanda es que solicitan el acta de constitución de COSAVI o la credencial original que faculta a la Superintendencia del Sistema Financiero a intervenir esta cooperativa.
“Estos 15 jueces van a ser denunciados nacional e internacionalmente. No es posible, 109 demandas presentadas y ninguna ha prosperado. Estamos viendo un acto cómplice de parte del Órgano judicial”, concluyó.
