On September 2, the Inter-American Commission on Human Rights (IACHR) declared a petition admissible against the Salvadoran State over the May 2021 removal of the justices of the Sala de lo Constitucional (Constitutional Chamber) of the Corte Suprema de Justicia (Supreme Court of Justice, CSJ), the country’s highest court.
On May 1, 2021—the day Nuevas Ideas debuted its absolute majority in the Legislative Assembly—the Assembly ousted, without due process, justices Armando Pineda Navas, Carlos Avilés, Carlos Sánchez, Marina de Jesús Marenco, and Aldo Enrique Cáder, who had issued rulings unfavorable to the government. Following the removal, the ruling party seized control of all three branches of government.
Civil society organizations filed a petition with the IACHR alleging that the removal was unlawful.
Supreme Court justices are elected to nine-year terms. The terms of those removed were not set to expire until 2027.
Before admitting the petition, the Commission received a submission from the Salvadoran State asking that the case be ruled inadmissible on the ground that the former justices had not exhausted domestic remedies. The IACHR dismissed that argument and will proceed to consider the petition on the merits, which was signed by a group of attorneys.
CIDH admite demanda contra El Salvador por destitución de jueces constitucionales
La Comisión Interamericana de Derechos Humanos (CIDH) admitió este 2 de septiembre una demanda contra el Estado salvadoreño por la destitución de los magistrados de la Sala de lo Constitucional de la Corte Suprema de Justicia (CSJ), el máximo tribunal de justicia, ocurrida en mayo de 2021.
El 1 de mayo de 2021, en día que Nuevas Ideas estrenó la mayoría absoluta en la Asamblea Legislativa, destituyó, sin seguir un proceso, a los magistrados: Armando Pineda Navas, Carlos Avilés, Carlos Sánchez, Marina de Jesús Marenco y Aldo Enrique Cáder, quienes habían emitido resoluciones incómodas para el Gobierno. Tras la remoción, el partido de Gobierno tomó el control de los tres poderes de Estado.
Organizaciones sociales presentaron una demanda ante la CIDH en la que señalaron que la destitución fue ilegal.
Los magistrados de la Corte Suprema son electos para nueve años. Los que fueron destituidos finalizaban su período hasta 2027.
Antes de admitir la demanda, la Comisión recibió un informe del Estado salvadoreño que pidió que no se admitiera el proceso porque los exmagistrados no agotaron las vías para apelar dentro del país. La CIDH desestimó ese argumento y entrará a conocer a fondo la demanda firmada por un grupo de abogados.
