Pedro Cruz, the defense attorney for the Santa Marta environmentalists, declared that “justice has triumphed” upon learning of the ruling from the Tribunal de Sentencia de San Vicente (San Vicente Trial Court), which acquitted the defendants of the crimes of murder and illicit associations.
Cruz stated that the Fiscalía General de la República (FGR) failed to establish the defendants’ guilt and stressed that it is important to make known that the defendants “are innocent” in this new trial.
“It is now clear that the defendants are innocent. We have been vindicated: the evidence was insufficient, the prosecution’s evidence is irrelevant, and it failed to establish their guilt. We leave satisfied with the acquittal of all the defendants,” he said.
The FGR accused Alejandro Laínez, Antonio Pachecho, Saúl Agustin Rivas, Fidel Recinos, José Eduado Castaneda, Pedro Rivas, Miguel Angel Gámez, and Arturo Serrano of the murder of María Inés Alvarenga Leiva, allegedly committed on August 22, 1989, which it failed to prove.
“We are entirely satisfied with the resolution. We congratulate those on trial. We stand in solidarity with them through this entire ordeal they have endured during these years of detention. We commend the defense team for their commendable work in consistently dismantling the prosecution’s evidence. Justice and legality have triumphed today, and we have won this trial for the second time,” Cruz added.
Families Express Relief
For Vanesa Laínez, daughter of Alejandro Laínez, one of the defendants, the acquittal holds profound significance for her family, as they have lived under immense strain throughout a process spanning more than two years, following the environmentalists’ arrest on January 11, 2023.
“It has been difficult. We have been fighting for over two years, and it has been anything but easy for our family to go through this process. Not knowing how they are or where they are has been hard. I am so emotional that the outcome was favorable for us. I have so many mixed feelings, but I feel very happy,” she said.
The environmentalists and their families had also denounced the economic hardships they have faced, as they have been unable to work during this entire period, and many community projects were paralyzed. They now hope to resume them.

El abogado defensor de los ambientalistas de Santa Marta, Pedro Cruz, dijo que “ha triunfado la justicia” tras conocer el fallo del Tribunal de Sentencia de San Vicente que absolvió a los acusados de los delitos de asesinato y asociaciones ilícitas.
Cruz indicó que la Fiscalía General de la República (FGR) no pudo determinar la culpabilidad de los imputados y aseguró que es importante dar a conocer que los imputados “son inocentes” en este nuevo juicio.
Queda claro que los imputados son inocentes, hemos tenido razón de que las pruebas eran insuficientes, que las pruebas de cargo son irrelevantes y no lograron establecer la culpabilidad de ellos y nos vamos satisfechos con la absolución para todos los procesados”, expuso.
La Fiscalía acusó a Alejandro Laínez, Antonio Pachecho, Saúl Agustin Rivas, Fidel Recinos, José Eduado Castaneda, Pedro Rivas, Miguel Angel Gámez y Arturo Serrano del asesinato de María Inés Alvarenga Leiva, presuntamente ocurrido el 22 de agosto de 1989, algo que no logró demostrar.
“Completamente satisfechos con la resolución. Felicitamos a los procesados. Somos solidarios de todo este calvario que han tenido estos años detenidos. Felicitamos al equipo de defensores con su trabajo encomiable tratando siempre de desbaratar las pruebas acusatorias. Hoy ha triunfado la justicia, la legalidad y hemos ganado por segunda vez este juicio”, agregó Cruz.
Familia contenta
Para Vanesa Laínez, hija de Alejandro Laínez, uno de los imputados, la absolución es importante para su familia pues han vivido con mucha preocupación en un proceso de más de dos años, tras la captura de los ambientalistas el 11 de enero de 2023.
“Ha sido difícil. Hemos venido luchando desde hace más de dos años y no ha sido nada fácil como familia pasar este proceso y más en este tiempo donde los compañeros decidieron retirarse, El no saber cómo están, ni dónde están ha sido difícil. Me emociona mucho que la respuesta haya sido favorable para nosotros. Hay muchos sentimientos encontrados, me siento muy contenta”, indicó.
Los ambientalistas y sus familias habían denunciado las afectaciones que han tenido también a nivel económico, pues durante todo este tiempo no han podido laborar y muchos proyectos en la comunidad se paralizaron. Ahora esperan retomarlos.
