On September 22, 2025, the Inter-American Commission on Human Rights (IACHR) issued Resolution 66/2025, granting precautionary measures for Ruth Eleonora López Alfaro after finding her to be in a serious and urgent situation, given that her rights to life, personal integrity, and health face a risk of irreparable harm in El Salvador.

According to the request, the beneficiary is head of the Justice and Anti-Corruption Unit at the Cristosal Foundation. She was deprived of her liberty on May 18, 2025, and since her admission on July 4, 2025, to the Women’s Penitentiary Center at the Izalco Farm, she has been held incommunicado, without contact with her family or legal representatives. Given her absolute incommunicado detention, her current situation and health status are uncertain, particularly in light of her chronic health conditions.

The State, for its part, reported that the beneficiary was receiving personal hygiene packages and food provided by her family and was integrated into general activities and programs within the penitentiary center. It also stated that it had adopted measures to guarantee the beneficiary’s right to health, including her transfer to a penitentiary center with appropriate conditions and all necessary health care. Finally, it added that, to date, no evidence had been presented to show that she is not receiving adequate medical care for her condition or that the system is incapable of providing it in a timely manner.

In its analysis of the request, the Commission considered the alleged facts in light of the context and assessed the actions taken by the State in this matter. Nevertheless, it observed that the beneficiary, as a human rights defender, has pursued legal actions and filed complaints on matters of high public interest and has been the target of monitoring and surveillance.

Furthermore, she is reportedly deprived of liberty under a provisional detention measure for an indefinite period and in a state of absolute incommunicado detention, without contact with her family and legal representatives, who lack any means to directly ascertain her current situation, health status, and detention conditions, despite internal actions pursued on her behalf. Therefore, in accordance with Article 25 of its Rules of Procedure, the Commission requests that the State of El Salvador:

1. Adopt the necessary measures to protect the rights to life, personal integrity, and health of Ruth Eleonora López Alfaro;
2. Adopt the necessary measures to ensure that the beneficiary’s detention conditions comply with international standards. In particular, it must immediately end her prolonged incommunicado detention; guarantee regular contact and access to her family, lawyers, and representatives as a means of safeguarding her rights; and, considering the exceptional nature of pretrial detention and the risk to her life, personal integrity, and health assessed in this resolution, review the continued use of pretrial detention in light of applicable standards, including the possibility of alternative measures;
3. Agree on the measures to be adopted with the beneficiary and her representatives; and
4. Report on the actions taken to investigate the alleged events that gave rise to this resolution, including their connection to her work as a human rights defender, and thus prevent their recurrence.

The granting of this precautionary measure and its adoption by the State do not constitute a prejudgment of any potential petition before the Inter-American system alleging violations of the rights protected in the American Convention on Human Rights and other applicable instruments.

The IACHR is a principal and autonomous organ of the Organization of American States (OAS), whose mandate stems from the OAS Charter and the American Convention on Human Rights. The Inter-American Commission is mandated to promote the observance and defense of human rights in the region and serves as a consultative body to the OAS on these matters. CIDH otorga medidas cautelares a la defensora Ruth López en El Salvador

La Comisión Interamericana de Derechos Humanos (CIDH) emitió el 22 de septiembre de 2025 la Resolución 66/2025, mediante la cual otorgó medidas cautelares a favor de Ruth Eleonora López Alfaro, tras considerar que se encuentra en una situación de gravedad y urgencia toda vez que sus derechos a la vida, integridad personal y salud enfrentan un riesgo de daño irreparable en El Salvador.

Según la solicitud, la beneficiaria es jefa de la Unidad de Justicia y Anticorrupción de la Fundación Cristosal. El 18 de mayo de 2025 fue privada de libertad y, desde su ingreso el 4 de julio de 2025 al Centro Penitenciario para Mujeres, Granja de Izalco, se encuentra en estado de incomunicación sin contacto con sus familiares ni representantes legales. Ante la situación de incomunicación absoluta, no se tendría certeza sobre su situación actual ni su condición de salud considerando sus padecimientos crónicos.

Por su parte, el Estado informó que la beneficiaria recibiría paquetes de higiene personal, alimentos proporcionados por sus familiares y estaría integrada actividades y programas generales dentro del centro penitenciario. También señaló que habría adoptado medidas para garantizar el derecho a la salud de la beneficiaria, incluyendo su traslado a un centro penitenciario con condiciones apropiadas y todos los cuidados de su salud. Por último, agregó que, a la fecha, no se habría presentado evidencia de que no esté recibiendo la atención médica adecuada para su condición o que el sistema sea incapaz de proveerla de manera oportuna.

Al momento de analizar la solicitud, la Comisión tomó en cuenta los hechos alegados a la luz del contexto, y valoró las gestiones realizadas por el Estado en el presente asunto. No obstante, observó que la beneficiaria, como defensora de derechos humanos, ha impulsado acciones y denuncias sobre temas de alto interés público y fue objeto de eventos de seguimiento y vigilancia.

Asimismo, estaría privada de libertad bajo medida provisional de detención, sin plazo definido, y en estado de incomunicación absoluta, sin contacto con sus familiares y representantes legales, quienes no tendrían posibilidades de conocer en directo su situación actual, estado de salud y condiciones de detención, pese a las acciones internas impulsadas a su favor. Por consiguiente, en los términos del Artículo 25 del Reglamento, se solicita al Estado de El Salvador que:

1. adopte las medidas necesarias para proteger los derechos a la vida, integridad personal y salud de Ruth Eleonora López Alfaro;
2. adopte las medidas necesarias para asegurar que las condiciones de detención de la beneficiaria sean conforme a los estándares internacionales. En particular, que inmediatamente cese la situación de incomunicación prolongada; se garantice el contacto regular y acceso con sus familiares, sus abogados y representantes como medio para salvaguardar sus derechos; y, considerando la excepcionalidad de la prisión preventiva, y la situación de riesgo a la vida, integridad personal y salud valorada en la presente resolución, se proceda con revisar la continuidad de la prisión preventiva a la luz de los estándares aplicables, incluyendo la posibilidad de otras medidas alternativas a la detención preventiva;
3. concierte las medidas a adoptarse con la beneficiaria y sus representantes; y
4. informe sobre las acciones adelantadas a fin de investigar los presuntos hechos que dieron lugar a la presente resolución, incluyendo su relación con su actividad como defensora de derechos humanos, y así evitar su repetición.

El otorgamiento de la medida cautelar y su adopción por el Estado no constituyen prejuzgamiento sobre una eventual petición ante el sistema interamericano en la que se aleguen violaciones a los derechos protegidos en la Convención Americana y otros instrumentos aplicables.
