Acción Ciudadana (Citizen Action), a watchdog organization monitoring government institutions, announced on September 1 that it has been registered in the Registro de Agentes Extranjeros (Registry of Foreign Agents, RAEX) and will face a 30% tax on the donations it receives.
Donations received from abroad will be subject to the tax stipulated in the Ley de Agentes Extranjeros (Foreign Agents Law, LAEX), which came into effect on June 7 and established a 90-day deadline for organizations to register with the Ministerio de Gobernación (Ministry of the Interior).
The organization stated that the tax will affect its operations, but that registration will nevertheless allow it to continue operating “for the time being.”
“Although we have complied with the legal requirement to register, we maintain our firm stance that the LAEX is authoritarian and confiscatory, as it seeks to curtail civic space,” stated Acción Ciudadana in a video statement.
Acción Ciudadana asserted that the law violates fundamental rights, including freedom of association and organization, freedom of expression, and property rights, among others.
The organization noted that it has always been transparent about the origin of its funds and the nature of its work agenda, long before the LAEX was in effect.
“We reiterate that our organization’s sole objective is to help ensure that in El Salvador there is a genuine democracy and that the rule of law becomes a reality. We will remain steadfast in fulfilling this commitment despite the constraints imposed by the law,” the statement reads.
According to the LAEX, the tax will apply not only to cash contributions but also to in-kind contributions or material goods of any type, when the official Registry so determines.
The civic organization stated that, if necessary, it will inform the public about any application of the law that makes it “more burdensome than it already is.”

Acción Ciudadana, una organización contralora de las instituciones gubernamentales, anunció este 1 de septiembre que fue inscrita en el Registro de Agentes Extranjeros (RAEX) y que se les cobrará el 30 % a las donaciones que reciban.
Las donaciones que reciban del exterior estarán sujetas al impuesto contemplado en la Ley de Agentes Extranjeros (LAEX), que entró en vigencia el 7 de junio y dio un plazo de 90 días a las organizaciones para que se inscriban ante el Ministerio de Gobernación.
Con el impuesto, la organización manifestó que se verán afectados en sus operaciones, pero que aún así, la inscripción les permitirá seguir operando “de momento”.
“Pese a que cumplimos la obligación legal de inscripción, mantenemos nuestra firme postura de que la LAEX es de naturaleza autoritaria y confiscatoria, pues busca restringir el espacio cívico”, manifestó Acción Ciudadana, a través de un comunicado audiovisual.
Acción Ciudadana expuso que la ley violenta derechos fundamentales como el de libre asociación y organización, la libertad de expresión y el patrimonio, entre otros.
La organización mencionó que siempre ha sido transparente en el origen de sus fondos y en la naturaleza de su agenda de trabajo sin nunca antes haber estado vigente la LAEX.
“Reiteramos que el único objetivo de nuestra organización es contribuir a que en El Salvador exista una verdadera democracia y se haga real el Estado de Derecho. Nos mantendremos firmes cumpliendo este compromiso pese a las limitaciones que implica la ley”, señala el comunicado.
Según la LAEX, el impuesto no solo se aplicará a las importaciones en efectivo, sino también, a las de especie o bienes materiales de cualquier tipo, cuando así lo determine el Registro oficial.
La organización ciudadana adelantó que de ser necesario, informarán a la opinión pública sobre cualquier aplicación de la ley que la haga “más gravosa de lo que ya es”.
