In just over five hours—between 4:34 p.m. and 9:57 p.m. on 31 July—Nuevas Ideas both approved and ratified the constitutional amendment that clears the way for indefinite presidential re-election.
“Mr. President, I hold in my hands the Diario Oficial certifications of publication for constitutional amendment agreements two and three that were recently approved by this Legislative Assembly. Here is certification No. 20,980, attesting to amendment agreement No. 2, and certification No. 20,981, attesting to amendment agreement No. 3,” said lawmaker Christian Guevara, the caucus leader for Nuevas Ideas, as he justified his request that the amendments be ratified mere hours after their approval.
On the night of Thursday, 31 July, the Legislative Assembly convened its 67th plenary session, where the ruling party introduced motions to enact amendments that enable immediate presidential re-election, extend the presidential term to six years, abolish the electoral runoff, and eliminate Salvadoran seats in the Central American Parliament (PARLACEN).
For a constitutional amendment to take effect, it must first be adopted in a plenary session by a simple majority and later be ratified. The amendment to Article 248, ratified on 28 January 2025, abolished the safeguard requiring approval in two consecutive legislatures. From that point on, the same legislature could both approve and ratify an amendment, giving Nuevas Ideas carte blanche to alter the Constitution at will, as it did on Thursday night.
Lawmaker Guevara defended the use of certifications of publication as fulfilling the legal requirement of prior publication, even though the Diario Oficial website had not been updated and its most recent edition available was dated 24 July 2025.
“Some in the opposition may say, ‘Ah, these are printouts they just prepared.’ They can verify the publications on the official Diario Oficial website as well as on the Legislative Assembly’s website and social media,” Guevara asserted.
By midday on Friday, 1 August, however, the site still had not been updated to include the publications.
Displaying the certifications, Guevara continued, “These documents empower me, procedurally and in accordance with Article 248 of the Constitution, to request that these constitutional amendment agreements be taken up in this plenary session and be approved with a waiver of ordinary procedure.”
According to the motions presented in that plenary session, the agreements were supposedly published in Diario Oficial No. 143, Volume No. 448, dated 31 July 2025.
Once each waiver was approved, the Assembly proceeded to vote on the substance of the motions without a single intervention from ruling-party lawmakers.
The reforms targeted Articles 75, 80, 152, and 154. A transitory provision was also added to Article 154:
“The presidential term that began on 1 June 2024 and was to conclude on 1 June 2029 shall end early, on 1 June 2027, for the purpose of synchronizing the elections of President and Vice President of the Republic, lawmakers to the Legislative Assembly, and municipal councils. Elections for President and Vice President of the Republic, lawmakers to the Legislative Assembly, and municipal councils shall therefore be held in that year.”
Civil society has sounded the alarm, warning that the reforms pave the way for indefinite re-election and could allow Nayib Bukele and his inner circle to remain in power indefinitely.
Nuevas Ideas usó constancias del Diario Oficial para ratificar reformas constitucionales el mismo día
En un poco más de cinco horas, desde las 4:34 de la tarde hasta las 9:57 de la noche del 31 de julio, Nuevas Ideas aprobó y ratificó la reforma a la Constitución de la República que permite la reelección presidencial indefinida.
“Señor presidente, tengo en mis manos las constancias de publicación en el Diario Oficial de los acuerdos de reformas dos y tres que fueron aprobados recientemente por esta Asamblea Legislativa. Aquí está la constancia número 20980, que hace constar sobre el acuerdo de reforma constitucional número dos; y la constancia número 20981, que hace constar que el acuerdo de reforma constitucional número tres”. Así fue como justificó el diputado Christian Guevara, jefe de fracción de Nuevas Ideas, la petición de que se ratificaran las reformas a la Constitución de la República que se aprobaron apenas unas horas antes.
La noche del jueves 31 de julio, la Asamblea Legislativa convocó a la sesión plenaria número 67 en la que se introdujeron las piezas de correspondencia del partido oficial para que las reformas que permiten la reelección presidencial inmediata, la ampliación del periodo presidencial a seis años, la eliminación de la segunda vuelta electoral y la eliminación de diputaciones del Parlamento Centroamericano (PARLACEN).
Para que una reforma a la Constitución sea efectiva, primero se debe acordar en una sesión plenaria con el voto de la mayoría simple y debe ser ratificada posteriormente. Con la reforma al artículo 248 que se ratificó el 28 de enero de 2025, los cambios pueden aprobarse en una misma legislatura, quitando el candado que exigía las dos legislaturas para hacerlo y abriendo las puertas a Nuevas Ideas a modificarla en cualquier momento, como ocurrió la noche del jueves.
El diputado Guevara defendió el uso de constancias como una forma de cumplir con el requisito legal de su publicación, aunque el sitio web del Diario Oficial no estaba actualizado y su última edición disponible corresponde a la del 24 de julio de 2025.
“Algunos en la oposición podrán decir ‘ah, son impresiones que acaban de sacar’. Pueden verificar las publicaciones tanto en la página oficial del Diario Oficial como en la página y en las redes sociales de la Asamblea Legislativa”, dijo Guevara.
De hecho, hasta el medio día de este viernes 1 de agosto no había sido actualizada la página para dar cumplimiento a las publicaciones.
Y Guevara afirmó que al mostrar las constancias de publicación, “me faculta para solicitar procesalmente y de conformidad al artículo 248 de la Constitución, que dichos acuerdos de reformas constitucionales sean conocidos en esta plenaria y se aprueben con dispensa de trámite”, expuso.
Según las piezas de correspondencia presentadas en esa plenaria, los acuerdo estarían publicados en Diario Oficial N° 143, Tomo N° 448 de fecha 31 de julio de 2025.
Luego de aprobada las dispensas de trámite por cada una, se procedió a la votación del fondo de los solicitado sin ninguna intervención de los diputados oficialistas.
Las reformas fueron a los artículos 75, 80, 152 y 154. Y se aprobó una disposición transitoria al 154, así:
“El período presidencial iniciado el primero de junio del año dos mil veinticuatro y que concluiría el primero de junio del año dos mil veintinueve, finalizará anticipadamente, el primero de junio del año dos mil veintisiete, con el propósito de unificar las elecciones de Presidente y Vicepresidente de la República, Diputados a la Asamblea Legislativa y Concejos Municipales, debiendo realizarse en ese año, elecciones para Presidente y Vicepresidente de la República, Diputados a la Asamblea Legislativa y Concejos Municipales.”
Las reformas generan preocupación en la sociedad civil al abrir el camino a la reelección indefinida y la posibilidad de que Nayib Bukele y su círculo se perpetúen en el poder.
