The Institute for the Rule of Law of the International Union of Lawyers (UIA), a network of jurists from 110 countries, expressed its concern over the arrest of constitutional lawyer Enrique Anaya and anti-corruption lawyer Ruth López, and demanded the release of both.
Anaya, who was accused of money laundering last Saturday, faces his initial hearing this Tuesday at the Seventh Peace Court of San Salvador, a court that has already placed the case under seal.
The UIA stated that it “has learned with deep concern of the detention of lawyer Salvador Enrique Anaya Barraza, who is a prestigious constitutionalist and academic and who in recent days had appeared on national television, expressing his opinion regarding the unconstitutionality of the reelection process that took place in El Salvador in February 2024.”
Anaya, like López, the Anti-Corruption Chief at Cristosal, has been one of the most critical voices of the Nayib Bukele administration. In fact, in 2023, he filed a petition with the Supreme Electoral Tribunal (TSE) pointing out the unconstitutionality of Bukele’s registration for a second term.
The organization said that Anaya is being denied the right to a legitimate defense. “While he has been able to receive short visits from family and his lawyers, the latter have not yet been able to meet with him under conditions that respect the guarantee of confidentiality of communications,” the UIA noted.
The Attorney General’s Office (FGR) has requested that the proceedings against the two critics of the Bukele administration be placed under seal. This prevents the public and the media from knowing what the lawyers are accused of. This Monday, in fact, some media outlets reported that press access to the Isidro Menéndez Judicial Center, where Anaya’s initial hearing will be held this Tuesday, was being restricted.
“The UIA-IROL, reaffirming its mandate to defend the rights of all lawyers to practice their profession with full freedom and their freedom of expression, recalls that the latter is protected by international instruments ratified by the Republic of El Salvador,” the organization stated, referring to Article 19 of the International Covenant on Civil and Political Rights and Article 13 of the American Convention on Human Rights.
The International Union of Lawyers also called on the Salvadoran state to guarantee lawyer Anaya’s health and ensure his life is not endangered.
More than 400 people have died in Salvadoran prisons while in state custody since the state of exception began, according to human rights organizations.
“The UIA-IROL stands with the families and organizations working in El Salvador in their demand for the release of these two legal professionals and will monitor the course of events,” the organization warned.
Unión Internacional de Abogados exige liberación de Enrique Anaya y Ruth López
El Instituto para el Estado de Derecho de la Unión Internacional de Abogados (UIA), una red de juristas en 110 países del mundo, expresó su preocupación por la captura del abogado constitucionalista Enrique Anaya y de la abogada anticorrupción Ruth López, y exigió la liberación de ambos.
El abogado Anaya, quien el pasado sábado fue acusado de lavado de dinero, enfrenta este martes la audiencia inicial en el Juzgado Séptimo de Paz de San Salvador, tribunal que ya le impuso reserva al caso.
UIA expuso que “ha tomado conocimiento con profunda preocupación de la detención del abogado Salvador Enrique Anaya Barraza, quien es un prestigiado constitucionalista, académico y que en días recientes se había expresado en televisión nacional, manifestando su opinión respecto a la inconstitucionalidad del proceso de reelección habido en El Salvador en el mes de febrero de 2024”.
Anaya, al igual que López, jefa Anticorrupción de Cristosal, ha sido una de las voces más críticas del Gobierno de Nayib Bukele. De hecho, en 2023, presentó un recurso en el Tribunal Supremo Electoral (TSE) señalando la inconstitucionalidad de la inscripción de Bukele para un segundo mandato.
La organización dijo que se le está impidiendo a Anaya el derecho a una legítima defensa. “Si bien ha podido recibir cortas visitas de familiares y de sus abogados, estos últimos no han podido aún reunirse con él en condiciones que respeten la garantía de confidencialidad de las comunicaciones”, señaló el UIA.
La Fiscalía General de la República (FGR) ha solicitado imponer reserva a los procesos contra los dos críticos del Gobierno de Bukele. Esto impide que la ciudadanía y medios de comunicación sepan de qué se acusa a los abogados. Este lunes, de hecho, algunos medios denunciaron que se estaba restringiendo el ingreso a la prensa al Centro Judicial Isidro Menéndez, donde este martes se celebrará la audiencia inicial de Anaya.
“El UIA-IROL, reafirmando su mandato de defensa de los derechos que tienen las y los abogados de ejercer con plena libertad su profesión y su libertad de expresión, recuerda que esta última está protegida por instrumentos internacionales ratificados por la República de El Salvador”, se pronunció la organización, en referencia al artículo 19 del Pacto Internacional de Derechos Civiles y Políticos y al artículo 13 de la Convención Americana sobre Derechos Humanos.
La Unión Internacional de Abogados también pidió al Estado salvadoreño que garantice la salud del abogado Anaya y que no se ponga en peligro su vida.
Más de 400 personas han muerto en las cárceles salvadoreñas, estando bajo custodia del Estado, desde que inició el régimen de excepción, según organizaciones que defienden derechos humanos.
“El UIA-IROL acompaña a los familiares y a las organizaciones que trabajan en El Salvador en su exigencia para la liberación de estos dos profesionales de la abogacía y dará seguimiento al curso de los acontecimientos”, alertó la organización.
