The Oficina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos (Office of the United Nations High Commissioner for Human Rights, OHCHR) urged El Salvador to refrain from arbitrary detentions and to comply with “international standards,” according to which “any person criminally charged can be tried while free if they do not pose a flight risk.”

“Regarding the recent detentions of human rights defenders, the OHCHR recalls that any pre-trial restriction on liberty must be based on the criteria of strict necessity and proportionality, thus preventing the detention from becoming arbitrary (CCPR/C/GC/35),” the office stated on X.

This Wednesday, the same day Ruth López was brought before the courts for an initial hearing, the United Nations Special Rapporteur on Human Rights Defenders, Mary Lawlorhrds, said she is “closely following the hearing against lawyer and human rights defender Ruth López in El Salvador.”

“The State must guarantee her right to due process. She must be released,” the representative of the international organization’s office requested on X.

The UN Human Rights Office stated that according to international standards, the freedom of a defendant who does not pose a flight risk can be subject to measures that ensure their appearance in court and compliance with any sentence.

Seventeen days after her arrest, Ruth López faces an initial hearing this Wednesday at the 12th Peace Court of San Salvador for the crime of illicit enrichment. López, head of the Anti-Corruption Unit at the Cristosal association and a critic of the current government, was arrested on the night of Sunday, May 18, and accused of embezzlement by the Attorney General’s Office on X. The court has placed the case under a total seal.

According to sources close to the case, the Attorney General’s Office has requested a formal investigation with six months of pre-trial detention for López.

On June 1, Salvadoran President Nayib Bukele addressed the arrest of human rights defenders in El Salvador, arguing that they cannot have impunity.

“They say we imprison human rights defenders, dissidents, opponents of the regime. I start to think, how can we fight corruption if the entire opposition is guaranteed impunity? They can’t be touched. Any corrupt opponent who is taken to jail is politically persecuted. They spent 15, 20 years profiting from the state, but now they’ve put on the badge of the politically persecuted. Working for an NGO is now synonymous with impunity,” Bukele stated in his speech marking the first year of his second term in office.

During her arrest, López told the arresting police officers, “Have some decency. This will end one day.” In his speech, Bukele referred to social organizations in El Salvador that receive foreign funding: “And on top of paying taxes, we tell them: Have some decency and stop blatantly lying to the Salvadoran people.”

In his address, Bukele also accused “traditional media” of deploying “activists disguised as journalists to spread lies.” Bukele rejected reports of an alleged pact between his government and gangs, following an interview published by El Faro.

La Oficina del Alto Comisionado de las Naciones Unidas para los Derechos Humanos (OACNUDH) exhortó a El Salvador a que no realice detenciones arbitrarias en El Salvador y cumpla los “estándares internacionales” según los cuales “toda persona imputada penalmente puede ser procesada en libertad si no representa un riesgo de evasión de la justicia”.

“Sobre las recientes detenciones de personas defensoras de derechos humanos, la OACNUDH recuerda que cualquier restricción a la libertad previa al juicio debe estar basada en los criterios de estricta necesidad y proporcionalidad, evitando así que la detención pueda llegar a ser arbitraria (CCPR/C/GC/35)”, indicó en X.

Este mismo miércoles, día en que Ruth López fue llevada a los tribunales para enfrentar una audiencia inicial, la relatora especial de las Naciones Unidas sobre los defensores de los derechos humanos, Mary Lawlorhrds, dijo que está “siguiendo de cerca la audiencia contra la abogada y defensora de derechos humanos Ruth López, en El Salvador”.

“El Estado debe garantizar su derecho al debido proceso. Debe ser liberada”, solicitó en X la representante de la oficina de la organización internacional.

La Oficina de Derechos Humanos de la ONU indicó que según estándares internacionales la libertad de un imputado que no representa un riesgo de evasión a la justicia puede estar sujeta a medidas que aseguren su comparecencia y el cumplimiento de la sentencia.

Diecisiete días después de su arresto Ruth López enfrenta este miércoles una audiencia inicial en el Juzgado 12 de Paz de San Salvador por el delito de enriquecimiento ilícito. López, jefa de la Unidad de Anticorrupción de la asociación Cristosal, crítica al gobierno actual, fue arrestada la noche del domingo 18 de mayo y señalada en X por la Fiscalía del delito de peculado. El Juzgado decretó reserva total al caso.

Según fuentes cercanas al caso, la Fiscalía ha solicitado instrucción formal con detención provisional por seis meses contra López.

El 1 de junio, el presidente salvadoreño, Nayib Bukele, se refirió a la captura de defensores de derechos humanos en El Salvador y argumentó que no pueden tener impunidad.

“Dicen que encarcelamos defensores de derechos humanos, disidentes, opositores al régimen. Yo me pongo a pensar, ¿cómo podemos combatir la corrupción sí toda la oposición tiene la impunidad garantizada? No se pueden tocar. Cualquier opositor corrupto que se lleve a la cárcel es un perseguido político. Estuvieron 15, 20 años lucrándose del Estado pero ahora se pusieron el carnet de perseguido político. Trabajar en una ONG ahora es sinónimo de impunidad”, expresó Bukele en su discurso de primer año de su segundo periodo de gobierno.

Durante su captura, López dijo a los agentes policiales captores “Tengan decencia, esto algún día se va a acabar”. En su discurso, Bukele se refirió a las organizaciones sociales que en El Salvador reciben financiamiento extranjeros: “Y además de pagar impuestos, les decimos: Tengan decencia y dejen de mentirle descaradamente al pueblo salvadoreño”.

En su informe, Bukele también señaló los “medios tradicionales” de desplegar “activistas disfrazados de periodistas para difundir mentiras”. Bukele rechazó publicaciones de un supuesto pacto de su gobierno con las pandillas, luego de una entrevista publicada por El Faro.
