On the afternoon of June 4, the Twelfth Peace Court of San Salvador decided to order the pre-trial detention of renowned lawyer, human rights defender, and head of anti-corruption for Cristosal, Ruth Eleonora López Alfaro, who is accused of the alleged crime of illicit enrichment. The details of the accusation are inaccessible, as the Office of the Attorney General requested the case be placed under a total seal, which the court granted. This means the judicial process will be conducted confidentially, and there will be no public way of knowing the arguments and evidence the Attorney General’s Office has to prove unjustified wealth.

That seal even prevented Ruth López’s lawyers from receiving a copy of the formal accusation with enough time to prepare their defense strategy. The only thing they knew initially was that the crime she was charged with at the time of her capture was changed from embezzlement to illicit enrichment. Likewise, through the Attorney General’s Office’s own social media posts, they knew she was accused in an investigation related to the case of Eugenio Chicas, who is being prosecuted for illicit enrichment allegedly committed when he was a magistrate and president of the Supreme Electoral Tribunal and Secretary of Communications for the Presidency of the Republic during the term of former president Salvador Sánchez Cerén. According to the public ministry, Ruth López was Chicas’s “right-hand woman” and “collaborated in the embezzlement of public funds” while she was an advisor to the Salvadoran Social Security Institute (ISSS).

Lawyer Pedro Cruz called the court’s decision to send Ruth López to a penitentiary center for at least six months while the case moves to the investigation phase a “legal aberration.” Cruz also noted that the prosecutor’s indictment lacks legal foundation and that placing the case under a total seal is ridiculous.

“The case is under a total seal: What are they afraid of? What do they fear? Having made an unfounded accusation? Having filed a baseless indictment? Are they afraid of what the defendant has been working on and saying in her professional capacity? Are they afraid of the defense because of the evident superiority of the technical, ethical, and legal strategy for this case? The case should not be under seal (…) I believe they are afraid that the ridiculousness of what they have presented will become known, and they will appear before the nation as an incompetent public ministry that fabricates cases against citizens instead of building them,” questioned lawyer Cruz.

Lawyer Luis Rivera, who arrived outside the “Isidro Menéndez” Judicial Center to support Ruth López’s family and friends demanding her release, and who is also the defender of two other political prisoners, told GatoEncerrado that the change in crime is because the Attorney General’s Office failed to conduct a proper investigation and could not gather irrefutable evidence to sustain the embezzlement charge.

“The only thing it shows is that the Attorney General’s Office doesn’t have enough evidence to sustain a charge. That’s why initially, at the time of her capture, she was told she was being arrested for embezzlement and today for illicit enrichment. The embezzlement charge was definitely impossible to sustain over time,” commented Rivera.

“I am a political prisoner”

Ruth López could not give statements to the national and international journalists who came to the courthouse to cover the initial hearing. The police officers transferring her pushed her to walk quickly through the corridors of the “Isidro Menéndez” Judicial Center to the court offices. Holding a green Bible in her handcuffed hands and dressed in the white clothes that inmates are forced to wear in the cells, she raised her voice during the 36 seconds the police dragged her past the cameras and microphones.

“They weren’t bringing me because I wouldn’t change my clothes. They wanted me to come in a suit,” she said, explaining why she was brought to court almost two hours after the hearing was scheduled to begin.

“They won’t shut me up! I want a public trial! The people deserve to know. If you have nothing to hide, you have nothing to fear!” was what she managed to shout before reaching the courtroom.

While the hearing was underway, two police officers remained outside the courtroom, one on each side of the door, deciding who could and could not enter. They took control of the court. There was a shift change every hour, but two officers always remained in the same spot.

Lawyer Mirna Perla approached the court in the afternoon, as she explained, to register as a party to the proceedings and ask Ruth López to sign a power of attorney for her. When she arrived, a police officer told her she could not enter or complete the necessary paperwork.

“We are here demanding that the judge truly assume her authority, her judicial independence, that she lift the seal on this case, that she stand up to the power of Nayib’s military boot, and not allow the police to be the ones in charge of her court. A police officer told me he had orders not to allow any filings, and the court clerk herself also said that the police were in charge right now. It’s a disgrace,” explained lawyer Perla after being turned away by the agents.

After 4:00 p.m., the decision to send Ruth López to a penal center to await the next phase of the judicial process was already public knowledge. At that moment, the prosecutors handling the case left the courtroom and ignored journalists’ questions about why the charge was changed and why they requested the case be placed under a total seal. They left quickly and in silence.

In the hallway outside the courtroom, a group of police officers arrived to obstruct the journalists’ work. They formed a security cordon to quickly remove Ruth López and take her down to a pickup truck with Guatemalan license plate number P514JNW, thus avoiding photographs and questions from the press.

As she did upon entering the court, while being pushed by the police, Ruth once again raised her voice to say that she is innocent and that in El Salvador, there are no public institutions that guarantee human rights.

“I am a political prisoner. All the charges are because of my legal work, for my calling out of the corruption of this government (of Nayib Bukele),” she managed to shout, before the police took her down an emergency staircase of the courthouse building and whisked her away in the vehicle.

Who is Ruth López?

She is currently the head of Cristosal’s Anti-Corruption and Justice Unit, from where she has led more than 15 investigations and reports revealing various cases of corruption in the Nayib Bukele government, and from where she has also called out the torture in prisons and serious human rights violations under the state of exception that has been in effect in El Salvador since March 2022.

She is an expert in electoral law and one of the critical voices of the Bukele administration. Her work for transparency and human rights was recognized internationally by the English newspaper BBC Mundo, which included her in its list of the 100 most influential women in the world.

“Soy una presa política”: Ruth López, la abogada que denunció corrupción en el Gobierno de Bukele

El Juzgado Décimo Segundo de Paz de San Salvador decidió, la tarde del 4 de junio, enviar a prisión preventiva a la reconocida abogada, defensora de derechos humanos y jefa anticorrupción de Cristosal, Ruth Eleonora López Alfaro; quien es acusada de supuestamente haber cometido el delito de enriquecimiento ilícito. Los detalles de la acusación son inaccesibles, ya que la Fiscalía General de la República pidió la reserva total del caso y el tribunal se la concedió; lo que significa que el proceso judicial se realizará de forma confidencial y no habrá forma de saber públicamente cuáles son los argumentos y evidencias de la Fiscalía para demostrar riqueza injustificada.

Esa reserva impidió, incluso, que los abogados de Ruth López tuvieran —con suficiente tiempo de antelación— una copia de la acusación formal para preparar su estrategia de defensa. Lo único que conocieron inicialmente fue que el delito que se le imputaba al momento de su captura fue cambiado de peculado a enriquecimiento ilícito. Asimismo, por publicaciones de la misma Fiscalía en redes sociales, sabían que fue acusada por una investigación relacionada con el caso de Eugenio Chicas, quien es procesado por enriquecimiento ilícito presuntamente cometido cuando fue magistrado y presidente del Tribunal Supremo Electoral y secretario de comunicaciones de la Presidencia de la República en el periodo del exmandatario Salvador Sánchez Cerén. Según el ministerio público, Ruth López era “mano derecha” de Chicas y “colaboró en la sustracción de fondos públicos” mientras era asesora del Instituto Salvadoreño del Seguro Social (ISSS). 

El abogado Pedro Cruz calificó de “aberración jurídica” la decisión del juzgado de enviar preventivamente a Ruth López hacia un centro penitenciario por al menos seis meses, mientras el caso avanza a la fase de instrucción. Además, Cruz señaló que el requerimiento fiscal carece de fundamento jurídico y que la reserva total del caso es ridícula. 

“Hay una reserva total del caso: ¿A qué le temen? ¿A qué le tienen miedo? ¿A haber hecho una acusación infundada? ¿A haber hecho un requerimiento infundado? ¿Le temen a lo que la imputada ha venido trabajando y diciendo en su quehacer profesional? ¿Le temen a la defensa por la superioridad evidente de la estrategia técnica, ética y jurídica para este caso? No debería tener reserva el caso (…) Opino que tienen miedo a que se sepa lo ridículo que han presentado y quedar ante la faz de la nación como un ministerio público incompetente y que arma tamales en contra de ciudadanos y no procesos”, cuestionó el abogado Cruz.

El abogado Luis Rivera, quien llegó a las afueras del Centro Judicial “Isidro Menéndez” para apoyar a familiares y amigos de Ruth López que estaban exigiendo su liberación y quien además es el defensor de otros dos presos políticos, dijo a GatoEncerrado que el cambio de delito obedece a que la Fiscalía no hizo la debida investigación y no logró juntar evidencias irrefutables para sostener la acusación de peculado. 

“Lo único que demuestra es que no tiene suficientes pruebas la Fiscalía para sostener un delito. Por eso fue que inicialmente, a la hora de la captura, se le mencionó que estaba siendo detenida por peculado y hoy por enriquecimiento ilícito. Definitivamente, el delito de peculado era imposible de sostener en el tiempo”, comentó Rivera.

“Soy una presa política”

Ruth López no pudo dar declaraciones a los periodistas nacionales e internacionales que llegaron a los tribunales para cubrir la audiencia inicial. Los policías que la trasladaban, la empujaron para que caminara rápido por los pasillos del Centro Judicial “Isidro Menéndez” hasta las oficinas del juzgado. Sosteniendo una biblia verde en sus manos esposadas y vestida con las ropas blancas que los privados de libertad son obligados a utilizar en las celdas, alzó su voz durante los 36 segundos que los policías la arrastraron frente a las cámaras y micrófonos. 

“No me traían, porque no me cambiaba de ropa. Querían que viniera con traje”, dijo, para explicar por qué fue trasladada al juzgado casi dos horas después de la convocatoria para la audiencia. 

“¡No me van a callar! ¡Un juicio público quiero! La gente merece saber. El que nada debe, nada teme”, fue lo que alcanzó a gritar antes de llegar al juzgado.

Mientras la audiencia se realizaba, dos policías permanecieron afuera del juzgado, uno de cada lado de la puerta y eran ellos quienes decidían quién entraba y quién no. Tomaron el control del juzgado. Cada hora había relevo, pero siempre se quedaban dos policías en el mismo lugar.

La abogada Mirna Perla se acercó por la tarde al juzgado, según explicó, para mostrarse parte del proceso y pedirle a Ruth López que le firmara un poder. Cuando llegó, un policía le dijo que no podía entrar ni hacer el trámite que necesitaba. 

“Estamos aquí exigiendo a la jueza que realmente asuma su autoridad, su independencia judicial, que levante la reserva de este caso, que se imponga al poder de la bota militar de Nayib y que no permita que la Policía sea la que mande en su tribunal. Un policía me dijo que tenía órdenes de no permitir ningún escrito y la misma secretaria del juzgado también dijo que ahorita mandaba la Policía. Es una vergüenza”, explicó la abogada Perla, tras haber sido rechazada por los agentes.

Pasadas las 4:00 de la tarde, la decisión de enviar a Ruth López a un centro penal, para esperar la siguiente fase del proceso judicial, ya era de conocimiento público. En ese momento, los fiscales que llevan el caso salieron del juzgado e ignoraron las preguntas de los periodistas sobre el por qué del cambio de delito y por qué pidieron la reserva total del caso. En silencio se retiraron apresuradamente. 

En el pasillo, afuera del juzgado, un grupo de policías llegó para entorpecer el trabajo de los periodistas. Hicieron un cordón de seguridad para sacar rápidamente a Ruth López y bajarla hasta un vehículo, tipo pick up con placas guatemaltecas número P514JNW, y así evitar fotografías y preguntas de los periodistas.

Como lo hizo en la entrada al juzgado, mientras era empujada por los policías, Ruth volvió a alzar su voz para decir que es inocente y que en El Salvador no hay instituciones públicas que garanticen los derechos humanos.

“Soy una presa política. Todas las imputaciones son por mi actividad jurídica, por mi denuncia en contra de la corrupción de este gobierno (de Nayib Bukele)”, alcanzó a gritar, antes de que los policías la bajaran por unas gradas de emergencias del edificio de tribunales y se la llevaran en el vehículo.

Quién es Ruth López?

Actualmente es la jefa de la Unidad Anticorrupción y Justicia de Cristosal, desde donde ha liderado más de 15 investigaciones e informes que revelan distintos casos de corrupción del Gobierno de Nayib Bukele y desde donde también ha denunciado las torturas en cárceles y graves violaciones a derechos humanos bajo el régimen de excepción que sigue vigente en El Salvador y que fue aprobado desde marzo del año 2022. 

Es experta en derecho electoral y una de las voces críticas de la administración Bukele. Su trabajo por la transparencia y los derechos humanos fue reconocido internacionalmente por el periódico inglés BBC Mundo, que la incluyó en su lista de las 100 mujeres más influyentes en el mundo.
