The arrest and transfer procedure for human rights defender Ruth Eleonora López, director of Cristosal’s Anti-Corruption and Justice Unit, revives a pattern from El Salvador’s civil war, according to Abraham Ábrego, a lawyer and Director of Strategic Litigation for Cristosal.
In an interview on radio YSUCA Tuesday morning, the director analyzed the irregular mechanisms of the detention, which took place Sunday around 11:00 p.m. at the activist’s home.
For Ábrego, moving López from one location to another in a short period is a strategy used by security forces in the 1980s to prevent people from knowing the detainee’s whereabouts.
“These transfers that have occurred, from some detention centers to others in a few hours, is a practice we observed in the 1980s by the former security forces; it was a tactic of moving the person so that their location would not be known. We are seeing it here,” Ábrego stated.
Ábrego noted that if there is an administrative arrest warrant from the Fiscalía General de la República (Attorney General’s Office, FGR), the detainee can be held at a police station while awaiting presentation before a court. However, “it is irregular for them to be moving her from one place to another,” he said.
In the morning, he stated that the whereabouts of López, who is also a professor, were still uncertain, and this could not be verified because authorities were not allowing lawyers or family members to see her.
The family first visited the Sub-Directorate of Investigations of the National Civil Police, where they presumed she was and where medicine and food were accepted for her. However, it was not until midday Tuesday, a day and a half after the arrest, that it was confirmed Ruth López is being held at the Land Transit Division of the National Civil Police in San Salvador.
Her mother, Eleonora Alfaro, confirmed that she brought her food, was able to see her, and spoke with her.
Irregularities
The first irregularity of the detention, according to Ábrego, began when police officers visited her residence late at night, a time when it is difficult to “mount a defense reaction,” and asked her to come outside, claiming her vehicle was involved in a traffic accident.
According to the lawyer, the Attorney General’s Office perhaps did not have a judicial search warrant to enter the home and execute the arrest, so they resorted to deception to make López come out.
“When the Attorney General’s Office is going to make an arrest, sometimes it must have a judicial search warrant to enter the house. They probably didn’t have one, so they make her come out.”
Upon exiting, the lawyer was notified of her detention without her charges or rights being read to her, and she was not allowed to change her clothes inside her house, which constitutes an abuse of authority, Ábrego says, because there was no resistance from the detainee.
“Authority can restrict a person’s mobility when there is resistance, and that was not the case,” the lawyer specified.
Other irregularities include Ruth López being transported in a civilian vehicle, and later, authorities not confirming her place of detention and obstructing access for her defense lawyers.
The detainee’s incommunicado status and the lack of confirmation of her whereabouts constituted a short-term forced disappearance, according to Cristosal.
“When they went to check the location, they didn’t say where she was, they didn’t confirm, they didn’t allow information to the defense lawyers. So they obstruct her defense, which is her right, and they also don’t facilitate the possibility for her family to see her, because they restrict the possibility of family visits.”
Embezzlement
Ábrego stated that the public accusation of embezzlement is the only information they have about the case against her. He also pointed out that cases against defenders are usually “fabricated and unfounded,” lacking evidence, and are often linked to previous cases.
In this case, the Attorney General’s Office accuses López of “collaborating in the misappropriation of state funds” in her role as an advisor to Eugenio Chicas during his two terms at the Tribunal Supremo Electoral (Supreme Electoral Tribunal, TSE), as magistrate and president, and during his tenure as Secretary of Communications for the Presidency.

El procedimiento de captura y traslado de la defensora de derechos humanos y directora de la Unidad Anticorrupción y Justicia de Cristosal, Ruth Eleonora López, revive un patrón del conflicto armado de El Salvador, según Abraham Ábrego, abogado y director de Litigio Estratégico de Cristosal.
En entrevista en radio YSUCA la mañana de este martes, el directivo analizó los mecanismos irregulares de la detención, efectuada el domingo al filo de las 11:00 p.m. en el domicilio de la activista.
Para Ábrego, la movilización de López de un sitio a otro en un corto periodo de tiempo obedece a estrategia de las fuerzas de seguridad de la década de 1980, para impedir conocer la ubicación del capturado.
“Esas movilizaciones que ha habido, de algunos lugares de detención a otros en pocas horas, es una práctica que podíamos observar nosotros en la década de los 80, de las fuerzas de seguridad anteriores, que era una táctica de mover a la persona, a efectos de que no se supiera donde está. La vemos acá”. Abrego.
Ábrego señaló que si hay una orden administrativa de captura de la FGR, el detenido puede estar en una delegación policial mientras transcurre el término para presentarlo ante un tribunal. Sin embargo, “es irregular que la estén moviendo de un lado a otro”, dijo.
En la mañana, aseguró que todavía se desconocía con certeza el paradero de la también docente, y no se podía constatar porque las autoridades no permitían verla a abogados y familiares.
La familia visitó primero la Subdirección de Investigaciones de la PNC, donde suponían que estaba y donde les recibieron medicamentos y alimento, pero hasta al mediodía de este martes, un día y medio después del arresto, se confirmó que Ruth López guarda prisión en la División de Tránsito Terrestre de la PNC, en San Salvador.
Su madre, Eleonora Alfaro, aseguró que le llevó alimentos, pudo verla y conversar con ella.
Irregularidades
La primera irregularidad de la detención, según Ábrego, empieza cuando los agentes policiales visitan su residencia a altas horas de la noche, cuando es difícil ejercer “reacción de defensa”, y le piden salir argumentando que su vehículo estaba involucrado en un accidente de tránsito.
De acuerdo al jurídico, la Fiscalía quizá no tenía orden judicial de allanamiento para entrar a la vivienda y ejecutar el arresto, por lo que se optó por el engaño para hacer que López saliera.
“Cuando la Fiscalía va a hacer una detención, a veces debe tener una orden judicial de allanamiento para entrar a la casa. Probablemente no la tenían, entonces hacen que ella salga”.
Al salir, a la abogada le notificaron la detención sin leerle los cargos y los derechos, y no le permitieron cambiarse de ropa dentro de su casa, lo cual constituye abuso de autoridad, dice Ábrego, porque no hay resistencia del detenido.
“La autoridad puede restringir la movilidad de una persona cuando hay resistencia, y no es el caso”, precisó el notario.
Las otras irregularidades surgen en que Ruth López fue trasladada en una patrulla particular, y luego, no confirman su sitio de detención y obstaculizan el acceso a sus abogados defensores.
La situación de incomunicación de la capturada y la ausencia de confirmación de su ubicación constituyó una situación de desaparición forzada de corta duración, según Cristosal.
“Cuando ya se fue a ver el lugar, no dijeron donde está, no ratifican, no permiten información a los defensores. Entonces obstaculizan su defensas, que es un derecho que tiene, y también no propician la posibilidad de que los familiares puedan verla, porque restringen la posibilidad de visita familiar”.
Peculado
Ábrego precisó que la acusación pública de peculado es la única información que disponen del proceso en su contra. Señaló además que los procesos contra defensores usualmente son casos “levantados e infundados” donde no hay prueba, y se vinculan a otros casos anteriores.
En este caso, la Fiscalía acusa a López de “colaborar en la sustracción de fondos de las arcas del Estado” en su rol como asesora de Eugenio Chicas en sus dos periodos en el Tribunal Supremo Electoral, como magistrado y presidente, y en su gestión como secretario de Comunicaciones de la Presidencia.
