After the National Civil Police (PNC) arrested five public transportation businessmen for the alleged crimes of breach of duty, denial of aid, and extortion, female criminal lawyers assert that these crimes are not linked to the actions taken by the businessmen and that the arrests are arbitrary. They add that if the businessmen breached any decree, it should result in an administrative sanction.
For Jayme Magaña, a criminal lawyer, the detention of the businessmen is “arbitrary,” as they did not breach their duties—one of the crimes they are accused of—because they were meeting to finalize payments the government was to make to them. Therefore, there is no “denial of aid,” as there was no earthquake or similar phenomenon, which is the scenario where such a charge might apply.
“From the moment they are told it is for breach of duty—because they are not public officials, though they do perform a public function by providing public transportation on routes conceded to them—it will be necessary to see where this breach is established and what document supports what is being demanded of them, because a tweet is not a way to order compliance. That is informal, as we are talking about concessions the State has granted to private enterprise to manage public transportation, and that implies formal communication through the Ministry of Transportation,” Magaña stated.
Regarding the crime of extortion, the transport operators have not asked for money for fares and are indeed providing the service requested of them.
“There is no extortion because this charge does not fit, as they have not collected fares. Furthermore, they themselves say, given the time the news broke, that they did not expect it; they tried to communicate with everyone. It is indeed concerning because, on one hand, the transport operators are willing to help the government solve a problem that the government itself has caused through poor development,” the lawyer asserted.
She added that it would be necessary to know if the businessmen were legally notified through an executive order based on online permits, the concession granted to them, and how they would be compensated for these 7 days of service.
For her part, criminal lawyer Roxana Cardona stated that breaches of a concession contract lead to “administrative sanctions,” such as revoking their routes, but should not be criminal penalties. She also said a “decree for free transportation” was lacking.
According to publicly available information about Sunday’s meeting between transport operators and the government, which was to discuss the costs to be covered for trips this week, Cardona says it is unknown if an agreement was reached that the transport operators “disobeyed,” but in any case, it would have been an administrative omission.
“This sends a bad message to private companies that hold concessions with the government. A decree should have existed, just as they do for elections, creating temporary provisions, and it should be in the transportation law. In this case, there was no specific decree to classify such an action as a crime,” she asserted.
In addition to these arrests in San Salvador, Alejandro Arriaza, vice president of the Asociación de Transportistas Ahuachapanecos (ASOTRA S.A de C.V.) (Ahuachapanecan Transporters Association), was also arrested and accused of breach of duty. Apparently, route 202, which he manages, only operated partially today.
Transport Operators Call for Release of Businessmen
In the afternoon, transport operators from the Mesa Nacional de Transporte (MNT) (National Transport Board) stated their support for the arrested businessmen and called for their release.
“As the National Transport Board, we are supporting colleagues who unfortunately have been arrested today. We do not understand why, as we have been providing service since early this morning, since it was announced to us yesterday,” explained Lucio Vásquez.
He said that yesterday morning they had a meeting with officials, who did not inform them “that this level of logistics was going to be implemented,” and the announcement took them “by surprise.”
“We call on the authorities to release our colleague Alexander Sorto, as well as Mr. Alejandro Arriaza and Nelson Moreno, who are an essential part and an important link in the coordination to continue providing service to the population. We kindly ask the authorities to recognize the work of our colleagues,” Vásquez asserted.
Luis Regalado, who is also part of the Board, said they are still unclear why their colleagues were arrested. He added that in yesterday’s meeting, where some of those arrested were present, an agreement had only been reached regarding transportation in the western part of the country. However, they realized it was nationwide after President Bukele’s announcement.
“In the case of the colleagues who have been detained, some were present that day (Sunday) at the meeting. We still do not have truly reliable information as to why they were detained, so we are waiting to see what will happen and where these detentions are leading,” he asserted.
This Monday, May 5, in the morning, President Nayib Bukele ordered the PNC to arrest the businessmen who did not provide free public transportation services.
Penalistas aseguran que capturas de empresarios de transporte público son “arbitrarias”
Luego que la Policía Nacional Civil (PNC) capturara a cinco empresarios del transporte público por los delitos de incumplimiento de deberes, denegación de auxilio y extorsión, abogadas penalistas aseguran que estos delitos no están vinculados con las acciones tomadas por los empresarios, y que son capturas arbitrarias. Y que si incumplieron con algún decreto, debería ser una sanción administrativa.
Para Jayme Magaña, abogada penalista, la detención de los empresarios es “arbitraria”, ya que ellos no incumplieron deberes, que es uno de los delitos que les imputan, ya que ellos estaban reunidos para afinar los pagos que les iba a hacer el gobierno, y por ende, no hay “denegación de auxilio”, porque no hay un terremoto o algún fenómeno parecido, y es el caso que podría aplicar.
“Desde el momento en que les están diciendo que es por incumplimiento de deberes, porque ellos no son funcionarios públicos, pero sí ejercen una función pública al dar transporte público a través de vías que se les han concesionado, habrá que ver dónde se establece ese incumplimiento y cuál es el documento que respalda eso que les están exigiendo, porque un tweet no es una manera para decir que se va a acatar una orden. Eso es informal ya que estamos hablando de concesiones que el Estado le ha entregado a la empresa privada que es administrar el transporte público y eso implica que haya una comunicación formal a través del Ministerio de Transporte”, aseguró Magaña.
Sobre el delito de extorsión, los transportistas no han pedido dinero en los pasajes y que sí están prestando el servicio que les pidieron.
“No hay extorsión porque esta figura no cabe, ya que no han cobrado pasaje. Además, ellos mismos dicen por la hora en la que se dieron las noticias que no se lo esperaban, ellos intentaron comunicarse con toda la gente. Sí es preocupante porque por un lado los transportistas están en la buena voluntad de ayudar al gobierno a resolver un problema que el mismo gobierno ha ocasionado por el mal desarrollo”, aseveró la abogada.
Dijo además, que sería necesario saber si a los empresarios les comunicaron de manera legal a través de una orden ejecutiva basados en los permisos en línea, la concesión que les han dado y cómo les iba a retribuir el pago de estos 7 días.
Por su parte, la penalista Roxana Cardona, que las faltas ante un contrato de concesión conlleva a “sanciones administrativas”, como quitarles la línea, pero no deben ser sanciones penales. Además, dice que faltó un “decreto de gratuidad del transporte”.
Según la información pública que se conoce sobre la reunión del domingo entre transportistas y el gobierno que era para ver los costos a cubrir para los viajes que realizarán esta semana, Cardona dice que se desconoce si hubo un acuerdo, el cuál “desobedecieron” los transportistas, pero en todo caso hubiera sido una omisión administrativa.
“Esto es un mal mensaje a la empresa privada que concesiona con el gobierno. Debió existir un decreto tal como lo hacen con las elecciones, crear unas disposiciones transitorias y debe ir en la ley de transporte. En este caso no existió un decreto específico para poder acumular dicha acción como delito”, aseguró.
A estas capturas de San Salvador se suma la captura de Alejandro Arriaza, vicepresidente de la Asociación de Transportistas Ahuachapanecos (ASOTRA S.A de C.V.), quien fue acusado de incumplimiento de deberes. Al parecer, la ruta que administra que es la 202 solo trabajó de manera parcial este día.
Transportistas piden liberación de empresarios
Por la tarde, transportistas que conforman la Mesa Nacional de Transporte (MNT) manifestaron que apoyan a los empresarios que fueron capturados y piden su liberación.
“Como Mesa Nacional de Transporte estamos respaldando a compañeros que este día lamentablemente han sido capturados. No entendemos el por qué si hemos venido prestando el servicio desde buenas horas de la mañana, desde que se nos anunció el día de ayer”, expuso Lucio Vásquez.
Dijo que ayer por la mañana tuvieron una reunión con los funcionarios, estos no les avisaron “que ese nivel de logística se iba a realizar”, y el anuncio los tomó “por sorpresa”.
“Nosotros le hacemos un llamado a las autoridades a que el compañero Alexander Sorto, también el señor Alejandro Arriaza y Nelson Moreno que son parte esencial y un eslabón importante de la coordinación, para seguir dando servicio a la población, que sean liberados. Le pedimos de favor a las autoridades que reconozcan la labor de los compañeros”, aseveró Vásquez.
Luis Regalado, quien también forma parte de la Mesa, dijo que aún no tienen claro por qué sus compañeros fueron capturados. Y que en la reunión de ayer donde algunos de los capturados estuvieron presentes, solo se había acordado sobre el transporte de occidente. Sin embargo, se dieron cuenta que era a nivel nacional, luego del anuncio del presidente Bukele.
“En el caso de los compañeros que han sido detenidos, algunos estuvieron presentes ese día (domingo) en la reunión. Aún no tenemos una información tan verídica a qué se debe la detención de ellos, por lo cual estamos a la expectativa de lo que va a suceder y hacia dónde vamos con estas detenciones”, aseveró.
Este lunes 5 de mayo, en la mañana, el presidente Nayib Bukele dio la orden a la PNC de capturar a los empresarios que no brindaron el servicio de transporte público de manera gratuita.
