The organization Cristosal filed a criminal complaint this morning with the Attorney General’s Office (Fiscalía General de la República, FGR) for the alleged crimes of forced disappearance, torture, and aggravated homicide against Jorge Alejandro Muyshondt Álvarez, former national security advisor, who died in state custody.
“In the criminal complaint, we are pointing out the evidence we have found, and we are telling the Attorney General’s Office to investigate this; noting that up to this moment, it has failed in its duty to investigate because this event should have been investigated from the moment Mr. Muyshondt’s death occurred,” declared Zaira Navas, a lawyer for Cristosal.
Muyshondt died on February 7, 2024, allegedly due to health complications, after being under arrest for six months. He was accused of revealing information to the late former President Mauricio Funes.
Cristosal representatives indicated that the security advisor was held incommunicado, without access to private counsel, and suffered serious head injuries “probably from torture,” which led to aseptic meningitis, a stroke, and the loss of mobility and speech.
“The family never received formal information about the reasons for his detention, nor the exact location where he was detained; they did not have access to Mr. Muyshondt. He was also not provided with medication or clothing, and he did not have access to a private lawyer,” Navas explained.
Furthermore, the lawyer added that the family members were not informed about the detainee’s admission to hospitals; they learned about it through media reports.
On October 16, 2023, El Diario de Hoy revealed that Muyshondt was hospitalized at the Saldaña National Hospital. It was later known that he had been admitted to that health center since September 28, after spending two weeks at the Psychiatric Hospital.
Navas explained that the presidential advisor was healthy when he was detained, but his health became critical while deprived of liberty.
Cristosal representatives asserted that there is sufficient evidence to presume that Muyshondt was subjected to torture through physical and mental punishment. They also noted that his death constitutes a probable aggravated homicide due to the possible participation of state agents.
On October 15, 2024, the International Rehabilitation Council for Torture Victims (Consejo Internacional para la Rehabilitación de las Víctimas de la Tortura, IRCT) published a report highlighting the absence of laboratory and radiological tests in Muyshondt’s medical record. The IRCT stressed that although the hospital admission was recorded due to a cerebral hemorrhage, there are no radiological images to determine the origin of the head trauma.
The Case Before the U.N.
Furthermore, Cristosal representatives pointed out that the state’s response to three requests from the United Nations (Organización de Naciones Unidas) for information on Muyshondt’s death is still unknown.
The requests were made by the U.N. Special Rapporteur on Extrajudicial, Summary or Arbitrary Executions in July of last year. “No response is known; this is unusual. Communications from U.N. human rights mechanisms or entities of the Inter-American human rights system usually receive a response from the State of El Salvador, even on issues related to the state of exception,” stated David Morales, a lawyer for Cristosal.
However, the Presidential Commissioner for Human Rights and Freedom of Expression, Andrés Guzmán Caballero, asserted that El Salvador provided the required information on September 5, 2024, and reaffirmed it, including technical and expert reports, later on January 10, 2025.
“Regarding the press conference given by the organization Cristosal on the case of Mr. Jorge Alejandro Muyshondt Álvarez, I clarify that the Salvadoran State has indeed formally responded to the joint communication SLV2/2024 issued by United Nations working groups and rapporteurs. This response was sent on September 5, 2024, and subsequently reaffirmed on January 10, 2025, as documented in note B052-2025 sent and received with the requested information, including technical and expert reports,” the commissioner assured in a message to this newspaper.
Guzmán added that this information cannot be disclosed because it contains sensitive clinical and medical data protected by the Public Information Access Law and the Patients’ Rights Law.
Cristosal pide a Fiscalía investigar posible tortura de Alejandro Muyshondt
La organización Cristosal presentó esta mañana un aviso penal ante la Fiscalía General de la República (FGR) por los presuntos delitos de desaparición forzada, tortura y homicidio agravado en contra de Jorge Alejandro Muyshondt Álvarez, exasesor de seguridad nacional, quien murió bajo custodia del Estado.
“En el aviso penal estamos señalando los indicios que hemos encontrado, y estamos diciendo a la Fiscalía que investigue esto; con la observancia que hasta este momento ha incumplido su deber de investigar porque este hecho debió ser investigado desde el momento que se produjo la muerte del señor Muyshondt”, declaró Zaira Navas, abogada de Cristosal.
Muyshondt murió el 7 de febrero de 2024, presuntamente por complicaciones de salud, luego de permanecer seis meses bajo arresto. Lo acusaron de revelar información al ya fallecido expresidente Mauricio Funes.
Los representantes de Cristosal señalaron que el asesor de seguridad estuvo incomunicado, sin acceso a defensa particular y sufrió graves lesiones en la cabeza “probablemente por tortura”, que derivaron en una meningitis aséptica, un accidente cerebrovascular y la pérdida de la movilidad y el habla.
“La familia nunca tuvo información formal de las razones por las que había sido detenido, ni del lugar exacto de donde estaba detenido, no tuvo acceso al señor Muyshondt. Tampoco le fue entregado medicamento, ropa y no tuvo acceso a abogado particular”, explicó Navas.
Por otra parte, la abogada agregó que los familiares no fueron informados sobre el ingreso del detenido a los centros hospitalarios, sino que lo supieron por lo que salió en los medios de comunicación.
El 16 de octubre de 2023, El Diario de Hoy reveló que Muyshondt se encontraba internado en el Hospital Nacional Saldaña. Posteriormente se supo que había sido ingresado a ese centro de salud desde el 28 de septiembre, luego de permanecer dos semanas en el Hospital Psiquiátrico.
Navas explicó que el asesor presidencial estaba sano cuando fue detenido, pero estando privado de libertad entró en una condición crítica de salud.
Los representantes de Cristosal aseguraron que existen elementos suficientes para presumir que Muyshondt fue sometido a tortura, mediante castigos físicos y mentales. Por otra parte, señalaron que su fallecimiento configura un probable homicidio agravado por la posible participación de agentes de autoridad.
El 15 de octubre de 2024, el Consejo Internacional para la Rehabilitación de las Víctimas de la Tortura (IRCT) publicó un informe recalcando la ausencia de pruebas de laboratorio y radiológicas en el expediente médico de Muyshondt. El IRCT recalcó que aunque el ingreso hospitalario se registró por una hemorragia cerebral, no existen imágenes radiológicas que determinen el origen del traumatismo craneoencefálico.
El caso ante la ONU
Por otra parte, los representantes de Cristosal señalaron que hasta ahora no se conoce la respuesta del Estado a tres peticiones de la Organización de Naciones Unidas para que brinde información sobre la muerte de Muyshondt.
Las solicitudes fueron realizadas por el Relator Especial Sobre Ejecuciones Extrajudiciales, Sumarias o Arbitrarias de Naciones Unidas, en julio del año pasado. “No se conoce respuesta alguna, esto es inusual, las comunicaciones de los mecanismos de derechos humanos de la ONU o de las entidades del sistema interamericano de derechos humanos recogen usualmente respuesta por parte del Estado de El Salvador, aún en los temas relacionados al régimen de excepción”, afirmó David Morales, abogado de Cristosal.
Sin embargo, el Comisionado Presidencial para los Derechos humanos y Libertad de Expresión, Andrés Guzmán Caballero, aseguró que el El Salvador entregó la información requerida, el 5 de septiembre de 2024, y que fue reafirmada, incluyendo informes técnicos y periciales, posteriormente el 10 de enero de 2025.
“Con relación a la conferencia brindada por la organización Cristosal sobre el caso del señor Jorge Alejandro Muyshondt Álvarez, aclaro que el Estado salvadoreño sí ha dado respuesta formal a la comunicación conjunta SLV2/2024 emitida por grupos de trabajo y relatores de Naciones Unidas. Esta respuesta fue enviada en fecha 5 de septiembre de 2024 y reafirmada posteriormente el 10 de enero de 2025, tal como consta en la nota B052-2025 enviada y recibida con la información solicitada, incluidos informes técnicos y periciales”, aseguró el comisionado en un mensaje a este periódico.
Guzmán agregó que esa información no puede ser divulgada, porque contiene datos sensibles de carácter clínico y médico protegidos por la Ley de Acceso a la Información Pública y la Ley de Derechos de los Pacientes.
