The Legislative Assembly has not yet studied the proposal by the Catholic Church to repeal the General Law on Metal Mining, a request submitted on March 18 accompanied by 150,000 signatures from citizens supporting the petition.
The Assembly’s Board of Directors has not addressed the request in its meetings, confirmed Reynaldo López Cardoza, the second secretary of the Legislative Assembly and a lawmaker from the National Coalition Party (PCN), to El Diario de Hoy.
The petition has not been included in the list of correspondence to be distributed to the committees, even though an ordinary plenary session was underway on the date it was submitted, and two other plenaries have since occurred (March 25 and April 1). There is also no mention of it even being pending.
“What we ask of the honorable Legislative Assembly is the repeal of the metal mining law. We do this without any political interest, without any ideological or economic interest, or interest from power groups. We do it for the good of the people, for the common good,” said Monsignor José Luis Escobar Alas, Archbishop of San Salvador, at the time.
Furthermore, on the day the documents were submitted, Escobar Alas, on behalf of Catholic leaders and parishioners, as well as other citizens who joined in signing, stated he had faith they would be heard by the primary branch of government.
“We come representing 150,000 people, and I would hope they take it into account. Not only that, but it is for the good of everyone, even those who haven’t signed,” added the bishop, reiterating that the call was for all lawmakers.
Lawmakers from Nuevas Ideas have also made no comment on the proposal. In fact, they have remained silent on social media for over a month. And since the last legislative term, they have not advanced proposals that do not originate from the ruling party.
For her part, lawmaker Marcela Villatoro of the Nationalist Republican Alliance (ARENA) does not believe the request will be accepted.
“It is also a call to the Board of Directors to forward the request we made on January 14 to the corresponding committees, which asked for the repeal of the mining law. Now, with the signatures presented by the Church, there is sufficient basis for it to be studied by the committee,” she asserted.
Lawmaker Claudia Ortiz, from the Vamos party, said she was unaware if the legislative Board of Directors had discussed the proposal.
“You should ask those who have the authority to define the work agenda,” she expressed.
Given the lack of study of the petition, Ortiz stated that she has available the draft constitutional reform bill to guarantee the right to water and prohibit metal mining.
“Seeing the people’s outcry in the signatures brought by the Catholic Church, I decided to take action, not just wait for others to make decisions. This is so that no Legislative Assembly can ever approve it again,” Ortiz argued.
Ortiz already tried to present this reform in the plenary session, but she did not meet the requirement of having the minimum of ten lawmaker signatures.
For the diocesan priest, Vicente Chopin, the Church should insist on the petition, for example, by re-reading the note that accompanied the delivery of the signatures, which calls for the repeal of the law, pointing out the medical and social implications that such practices would bring to the country.
“If it requests the repeal of the law and it is not carried out, the archbishop could take other actions,” the clergyman considered.
Asamblea ignora propuesta de la Iglesia sobre derogar minería
La Asamblea Legislativa aún no estudia la propuesta de la Iglesia Católica para que derogue la Ley General de Minería Metálica, solicitud que entregó el pasado 18 de marzo acompañado de 150,000 firmas de ciudadanos y ciudadanas que acompañan la petición.
La Junta Directiva de la Asamblea no ha tratado el tema de la solicitud en sus reuniones, confirmó a El Diario de Hoy el segundo secretario de la Asamblea Legislativa, diputado Reynaldo López Cardoza (PCN).
La petición no ha sido incluida en el lista de correspondencia a distribuir a las comisiones, pese a que en la fecha en que se entregó se desarrollaba sesión plenaria ordinaria y ya ocurrieron otras dos plenarias (25 de marzo y 1 de abril) y tampoco se menciona siquiera de que esté en espera.
“Lo que pedimos a la honorable Asamblea Legislativa es la derogación de la ley de la minería metálica, lo hacemos sin ningún interés político, sin ningún interés ideológico o económico, de grupos de poder, no lo hacemos por el bien del pueblo, por el bien común”, dijo para entonces Monseñor José Luis Escobar Alas, arzobispo de San Salvador.
Además, el día en que presentaron los documentos, Escobar Alas, en nombre de los líderes y feligreses católicos, así como de otros ciudadanos que se unieron a las firmas, aseguró que tenía fe de que serían escuchados por el primer Órgano de Estado.
“Venimos a dejar en representación de 150,000 personas y yo esperaría que lo tomen en cuenta y no solo eso, es que es el bien de todos, hasta de los que no han firmado”, añadió el obispo quien reiteró que el llamado fue para todos los diputados.
Diputados de Nuevas Ideas tampoco han expresado comentario alguno sobre la propuesta. De hecho, desde hace más de un mes que guardan silencio en redes sociales. Y desde la legislatura pasada no dan paso a propuestas que no sean oficialistas.
Por su parte, la diputada Marcela Villatoro, de ARENA, no cree que se acepte la solicitud.
“También es un llamado a la Junta Directiva que anexen a las comisiones correspondientes la solicitud que nosotros hicimos el 14 de enero, en donde se pedía que se derogara la ley de minería y ya con las firmas que presentó la Iglesia es un expediente suficiente para que fuese estudiado por la comisión”, aseveró.
La diputada Claudia Ortiz, del partido Vamos, dijo desconocer sobre si se ha tratado en la Junta Directiva legislativa la propuesta.
“Deberían de preguntarlo a los que tienen los que tienen la potestad de definir cuál es la agenda de trabajo que se da”, expresó.
Ante la falta de estudio de la petición, Ortiz afirmó que tiene a la disposición el proyecto de ley de reforma constitucional para garantizar el derecho al agua y la prohibición a la minería metálica.
“Al ver el clamor de la gente en las firmas que trajo la Iglesia Católica decidí activarme, no solo estar esperando a que sean otros los que tomen decisiones, esto para que ninguna Asamblea Legislativa en ningún momento pueda volverla a aprobar”, argumentó Ortiz.
Ortiz ya intentó presentar esa reforma en el pleno, pero no cumplió con el requisito de contar con el mínimo de diez firmas de diputados.
Para el sacerdote diocesano, Vicente Chopin, la Iglesia debiera insistir en la petición, por ejemplo, volver a leer la nota que acompañó la entrega de las firmas en la que piden la derogación de la ley señalando las implicaciones médicas y sociales que dicha práctica traería para el país.
“Si en ella piden la derogación de la ley y no se lleva a cabo, el arzobispo podría realizar otras acciones”, consideró el religioso.
