Organizations searching for disappeared persons and working in human rights submitted two written requests on February 18 to the director of Centro Penal La Esperanza (La Esperanza Prison), better known as Mariona: one to allow family visits for individuals deprived of liberty and another to confirm whether the missing young man, Carlos Ernesto Santos Abarca, is in that facility.
Eneida Abarca, Carlos’s mother, asks the director of that prison to confirm whether her son was ever held there, after anonymous sources told her they had seen him detained.
“We demand the right to access information, truth, and justice (…) People are saying that Carlos has entered this prison—we don’t know, and that’s why we’ve filed a formal request for them to check the records to see whether Carlos is here or was here. We haven’t found him in the search route we’ve carried out in more than 40 municipalities,” Eneida said.
The mother explained that an anonymous individual reached out to her directly, stating Carlos is being held in Mariona prison. “We want to verify if this is true, given the lack of responses from the police and the Prosecutor’s Office amid my three years of suffering. They are negligent,” she stated.
Mariona is the third penitentiary facility that Eneida has visited, after checking the Centro Penal de Quezaltepeque (Quezaltepeque Prison) in La Libertad, as well as El Penalito, the detention cells located in downtown San Salvador.
Carlos disappeared on January 1, 2022, and since then his mother has been searching for him, also denouncing the lack of support from State institutions such as the Policía Nacional Civil (PNC) (National Civil Police) and the Fiscalía General de la República (FGR) (Attorney General’s Office).
They call for enabling family visits
Attorney and spokesperson for the movimiento Justicia Social y Contraloría Ciudadana (Social Justice and Citizen Oversight Movement), Roxana Cardona, mentioned that the director of the Mariona prison recently stated there were no longer gang members there. Because of this, they are requesting that family members of those deprived of liberty be allowed to enter so they can verify the inmates’ conditions.
“We ask that the individuals deprived of liberty who are among the collateral victims of the state of exception have their families see them. A reasonable period of three years has already passed. Why don’t they let families visit them? What’s going on, what are they hiding? There is a great deal of jurisprudence and international treaties ensuring that families can see them. The director of this prison said there are no gang members here, so they should lift the extraordinary measures,” Cardona said.
The attorney adds that in light of complaints regarding torture and deaths inside the prisons under the state of exception, it is crucial that inmates be allowed visits, and that this is a right to which they are entitled.
The documents were received without a signature or seal from the penitentiary, which Cardona described as “informal.” Personnel at that facility excused themselves by saying they do not use signatures or institutional seals.
LA PRENSA GRÁFICA requested information from the Dirección General de Centros Penales (DGCP) (General Directorate of Prisons), through its communications department, regarding the two documents submitted to the director of the Mariona prison; however, by the time this article was closed, their response was still pending.
Piden a director del penal Mariona confirmar si Carlos Santos está ahí
Organizaciones de búsqueda de personas desaparecidas y de derechos humanos presentaron este 18 de febrero dos escritos al director del Centro Penal La Esperanza, más conocido como Mariona: uno para que se permita las visitas de familiares de privados de libertad y otro para confirmar si el joven desaparecido, Carlos Ernesto Santos Abarca, está en dicho centro.
Eneida Abarca, madre de Carlos, pide al director de dicho penal que le confirme si en algún momento su hijo estuvo recluido ahí, luego que personas bajo anonimato le han dicho que lo vieron internado.
Exigimos el derecho al acceso a la información, verdad y justicia (…) Hay comentarios de que Carlos ha ingresado a este penal, no lo sabemos y por ello presentamos un escrito formal para que verifiquen en los registros si Carlos está acá o estuvo acá. No lo encontramos nosotros en la ruta de búsqueda que hemos realizado en más de 40 municipios”, dijo Eneida.
La madre expuso que una persona bajo anonimato le escribió directamente que Carlos se encuentra en el penal de Mariona. “Queremos verificar si esto es cierto ante la falta de respuestas de la Policía y Fiscalía ante mi dolor de tres años. Son negligentes”, afirmó.
El de Mariona es el tercer centro penitenciario al que llega Eneida, tras consultar en el Centro Penal de Quezaltepeque, en La Libertad; así como en El Penalito, las bartolinas ubicadas en el centro de San Salvador.
Carlos desapareció el 1 de enero de 2022 y desde entonces su madre ha estado en su búsqueda, denunciando también la falta de apoyo de instituciones del Estado como la Policía Nacional Civil (PNC) y la Fiscalía General de la República (FGR).
Piden habilitar visitas de familiares
Roxana Cardona, abogada y vocera del movimiento Justicia Social y Contraloría Ciudadana, mencionó que recientemente el director del centro penal de Mariona afirmó que en ese lugar ya no se encontraban pandilleros. Por ello piden que se permita el ingreso a familiares de los privados de libertad y que puedan verificar el estado en que se encuentran.
Pedimos que los privados de libertad que son parte de las víctimas colaterales del régimen de excepción, que las familias puedan verlos. Ya pasó un tiempo prudencial de tres años. ¿Por qué no dejan ver a los familiares, qué pasa, qué esconden? Hay mucha jurisprudencia y tratado internacional para que las familias puedan verlos. El director de este penal dijo que acá no hay pandilleros, entonces que levanten las medidas extraordinarias”, dijo Cardona.
La abogada agrega que ante las denuncias de torturas y muertes en el interior de los centros penales en el marco del régimen de excepción, es importante que se permitan las visitas a los internos, además que es un derecho que les asiste.
Los escritos fueron recibidos sin firma ni sello de parte del centro penitenciario, lo que Cardona calificó como “informal”. El personal de dicho centro se excusó diciendo que no utilizan firma, ni sellos institucionales.
LA PRENSA GRÁFICA pidió la versión de la Dirección General de Centros Penales (DGCP), a través de su unidad de comunicaciones, sobre los dos escritos presentados al director del penal de Mariona; sin embargo, al cierre de esta nota aún se esperaba su respuesta.
