Three construction workers from San Miguel Tepezontes, in the department of La Paz, could be charged in the coming hours with the crime of public disorder after being arrested last Thursday morning for staging what they claim was a peaceful and orderly protest to demand payment of their wages for work performed on a project for the Municipal Works Directorate (DOM).
The men, identified as Jorge Alberto Vásquez Aparicio (46), Nelson Alirio Escobar Aparicio (43), and Juan Carlos Duarte Mejía (32), were arrested by officers from the San Miguel Tepezontes police station at around 9:00 a.m. on December 26. On Saturday, El Diario de Hoy inquired at the police station, and an officer stated that although other officers made the arrests, the crime they would be charged with is public disorder.
According to relatives of the detainees and people who were dismissed that same day—apparently for taking part in the protest—it all started when the engineer in charge of the project, who they identified as Marvin and who works for the company Ingeniería y Desarrollo, S.A. de C.V., arrived at the start of the workday and informed them they would not receive either their wages or year-end bonus because the DOM had run out of money, which meant the contractor could not pay the workers’ salaries.
Outrage was almost universal among the workers, and some decided to place rocks on the road they were repairing to block vehicle traffic, in an effort to compel DOM personnel to come and resolve the issue.
“You know that if a person works, it’s because they need money. Most of us here are poor people who plan our budgets around the little money we earn day to day. When they came to tell us we weren’t going to get paid, it made us feel awful,” said a woman who worked on the project.
“We protested because first thing in the morning we were told that there would be no payment this year-end, that we’d only get paid in January of next year. The majority of us, maybe 45 or 50 people, started to ask ourselves what we should do—keep working or not—and we decided to protest because we need the money; there are single mothers among us, older people…,” said a female worker, who also claimed that after the arrests, around 40 or 50 people were dismissed from the project.
Another source stated that upon hearing they would not get paid until mid-January, they asked the project’s lead engineer, who repeated the same response: there would be no payment; those who wished to stay could stay, but they would not receive any pay, as the DOM had given them no answer.
Given that situation, the workers decided “to block the street with some rocks.” As a result, the three construction workers were arrested, and those who stayed on site to support the protest were threatened with dismissal. Multiple sources say that threat was carried out the same day.
4.8 km for $3.1 Million
“Those detained are three foremen, but there are a lot of affected people. At that very moment they told us that whoever stayed behind to support the protest would be fired… In my case, I was fired, but I need them to pay me the money I’ve already earned and to compensate me for the dismissal, as well as deposit my year-end bonus. It’s a huge injustice,” said another affected woman.
On Saturday, El Diario de Hoy confirmed that many of the project’s workers are women from the same municipality, San Miguel Tepezontes.
In addition to obstructing the small number of vehicles passing on that road, those present at the protest say there was no damage to anything and no actual public disturbance, contrary to what certain people are claiming.
All three construction workers were working on the project known as “Road Improvement toward Playa Poza Verde, Lake Ilopango, Municipality of San Miguel Tepezontes,” which has a budget of $3,092,476.68, according to a posted sign indicating that the work is to be completed in 300 days, or roughly 10 months.
However, some neighbors and project workers say the project began in November 2023, which means it is already four months behind schedule. “They’re supposed to fix five kilometers of road, but there’s still a lot left to finish,” said one construction worker.
Indeed, the protest took place right at the spot where asphalt has been laid. From that point back toward the urban center, they are still doing earthworks and building walls and pipelines. In the area that’s already been asphalted, work continues on the construction of curbs and drainage.
One Employee and Two Subcontractors
Based on information gathered on-site from laid-off workers and relatives of the detainees, among those arrested is one employee of Ingeniería y Desarrollo, S.A. de C.V. (Duarte Mejía) and two subcontractors, each of whom had between seven and nine people working for them.
Vásquez Aparicio and Escobar Aparicio are said to be well-known construction workers in town, hired by the company to build the concrete gutters in the section where the asphalt has already been laid. The company contracted by the DOM subcontracted them for that construction, and they hired their own teams. Duarte Mejía was also doing the same work with a crew of construction workers employed by the company, according to various sources who asked not to be identified for fear of reprisals.
After Escobar Aparicio and Vásquez Aparicio were arrested, the people working under them automatically lost their jobs, and the workers under Duarte Mejía were also dismissed.
$3.1 MILLION
That is the cost of improving 4.8 km of road connecting the urban center of San Miguel Tepezontes with Playa Poza Verde on Lake Ilopango. The work was supposed to take 300 days, but locals say it is several months behind schedule, having started in November 2023.
Sources told El Diario de Hoy that there are minors among the project workers, and they do not know whether these minors have the necessary legal permits to be part of the crews doing the DOM project. El Diario de Hoy confirmed that at least one of the people who took part in Thursday’s demonstration to demand their wages was underage.
This Thursday, El Diario de Hoy went to the offices of Ingeniería y Desarrollo, the company hired by the DOM, seeking their version of events surrounding the arrest of the three construction workers, but an employee said the project’s lead engineer was not available.
Around midday, they managed to get the phone number for Marvin Vicente, whom multiple sources have identified as the engineer in charge of executing the DOM-contracted project. Contact was established and the reason for the visit and phone call was explained. However, he said he was very busy and would be available later, between 2:00 and 3:00 p.m. When called again at around 3:00, he said he was still busy and asked to be called again in 30 minutes, but did not answer the phone after that.
An attempt was also made to reach the DOM for comment, but as of press time, there had still been no response.
Tres albañiles serían acusados de desórdenes públicos por reclamar pago de salario en proyecto de la DOM
Tres albañiles originarios de San Miguel Tepezontes, departamento de La Paz, serían acusados en las próximas horas del delito de desórdenes públicos, tras ser capturados el pasado jueves en la mañana, cuando hicieron un acto de protesta pacífica y ordenada, para reclamar el pago de sus salarios por trabajos realizados en un proyecto de la Dirección de Obras Municipales (DOM).
Jorge Alberto Vásquez Aparicio, de 46 años, Nelson Alirio Escobar Aparicio, de 43, y Juan Carlos Duarte Mejía, de 32, fueron arrestados por policías del puesto de San Miguel Tepezontes, aproximadamente a las 9:00 a.m. del pasado 26 de diciembre. Este sábado, El Diario de Hoy consultó en el referido puesto policial y un agente dijo que, aunque las capturas fueron realizadas por otros agentes, el delito que les imputarán es desórdenes públicos.
De acuerdo con familiares de los detenidos y con personas que ese mismo día fueron despedidas, aparentemente por participar en el acto de protesta, todo comenzó cuando el ingeniero, a quien identifican como Marvin, encargado de la obra, ejecutada por la empresa Ingeniería y Desarrollo, S.A. de C.V., llegó al inicio de la jornada laboral y les dijo que no les pagarían ni sueldo ni aguinaldo porque la DOM se había quedado sin dinero y, consiguientemente, la empresa contratista no podía cancelarles los salarios.
El descontento fue casi generalizado, entre los trabajadores, y algunos decidieron colocar unas piedras en la calle que están reparando, para impedir el paso vehícular y forzar así a que llegaran los de la DOM a resolverles el problema.
“Usted sabe que si uno trabaja es porque necesita dinero, la mayoría aquí somos gente pobre que hacemos cuenta con ese dinerito que uno gana día a día y que nos vengan a decir que no nos iban a pagar nos hizo sentir feo”, afirmó una mujer que trabajaba en el proyecto.
“Nosotros nos manifestamos porque en la mañanita nos dijeron que no iba a haber pago este fin de año, sino que hasta enero del otro año. La mayoría de la gente, unas 45 personas o 50, empezamos a decir qué hacemos, si seguíamos trabajando o no, y decidimos protestar porque tenemos necesidad, habemos madres solteras, gente mayor…”, aseguró una trabajadora, quien también afirmó que después de las capturas, unas 40 o 50 personas fueron despedidas, es decir, que ya no continuarán trabajando en el proyecto.
Otra fuente aseguró que ante el anuncio de que hasta a mediados de enero les pagarían, preguntaron al ingeniero encargado de la obra, quien les volvió a dar la misma respuesta: que pago no habría, que el que quisiera quedarse que se quedara, pero que pago no habría, porque en la DOM no les habían dado respuesta.
Ante tal situación fue que decidieron “tapar la calle con unas piedras” y por eso fue que capturaron a los tres albañiles y amenazaron con despedir a quienes se habían quedado en el lugar apoyando la protesta. Esta amenaza, afirman varias fuentes, la cumplieron el mismo día.
4.8 km. por $3.1 millones
“Los que están detenidos son los tres, caporales, pero personas afectadas somos bastantes; en el mismo momento nos dijeron que los que nos quedamos apoyando esa situación seríamos despedidos… En mi caso estoy despedida pero yo necesito que me den el dinero que ya me gané y que me indemnicen por despido, y que el aguinaldo debe ser depositado…. Es una gran injusticia”, afirmó una mujer afectada.
Este sábado El Diario de Hoy comprobó que entre los trabajadores del proyecto hay muchas mujeres que son originarias del mismo distrito, es decir, de San Miguel Tepezontes.
Además de obstruir el poco tráfico de vehículos que hay en esa calle, algunos que estuvieron presentes en el acto de protesta afirman que no hubo ningún daño a nada ni desorden público, como lo quieren hacer ver algunas personas.
Los tres albañiles trabajaban en el proyecto denominado “Mejoramiento de calle hacia playa Poza Verde, lago de Ilopango, municipio de San Miguel Tepezontes”, cuyo monto de ejecución es de $3,092,476.68, según un rótulo colocado, en el cual también se indica que el plazo de ejecución sería de 300 días, es decir, 10 meses.
Sin embargo, el proyecto comenzó en noviembre de 2023, aseguran algunos vecinos y trabajadores del mismo, por lo cual ya tiene un retraso de cuatro meses. “Son cinco kilómetros de calle que se van a reparar pero hace falta mucho por terminar”, afirmó un albañil.
De hecho, la protesta fue realizada en el punto hasta donde ha sido asfaltada. Desde ese punto hasta llegar al casco urbano aún se están haciendo trabajos de terracería y construcción de muros y tuberías; en el tramo donde ya fue colocada la capa de asfalto, aún están trabajando en la construcción de cunetas y desagües.
Un empleado y dos subcontratistas
De acuerdo con información recabada en el proyecto de mejoramiento de la calle, despedidos y familiares de los detenidos, entre estos hay un empleado de la empresa Ingeniería y Desarrollo, S.A. de C.V. (Juan Carlos Duarte Mejía) y dos subcontratistas, cada uno de ellos tenía empleadas entre siete y nueve personas.
En el caso de Vásquez Aparicio y Escobar Aparicio, son dos albañiles muy reconocidos en el pueblo, afirman diversas fuentes, a quienes la empresa los había contratado para que construyeran las cunetas de cemento hidráulico en el tramo donde ya fue colocado el asfalto.
La empresa contratada por la DOM los subcontrató para tales construcciones y ellos contrataron a su propia gente; Duarte Mejía también realizaba la misma labor con una cuadrilla de albañiles contratados por la empresa, aseguraron diversas fuentes que pidieron no ser identificadas por temor.
Tras el arresto de Escobar Aparicio y Vásquez Aparicio, las personas que trabajaban con ambos también quedaron automáticamente sin trabajo, así como los empleados de la contratista que estaban a cargo de Duarte Mejía también fueron despedidos.
$3.1 MILLONES
Será el costo del mejoramiento de 4.8 km de la calle que conecta el casco urbano de San Miguel Tepezontes con la Playa Poza Verde, en el lago de Ilopango. El plazo de ejecución era de 300 días, pero lugareños afirman que lleva varios meses de retraso, pues comenzaron en noviembre de 2023.
Fuentes de El Diario de Hoy afirmaron que entre los trabajadores del proyecto también hay menores de edad, de quienes ignoran si tienen el permiso legal respectivo para que sean parte de las cuadrillas que ejecutan el proyecto de la DOM.
El Diario de Hoy corroboró que al menos una de las personas que el jueves participaron en la manifestación para exigir el pago de su salario, era menor de edad.
Este jueves, El Diario de Hoy se presentó a las oficinas de la empresa contratadas por la DOM (Ingeniería y Desarrollo) para obtener la versión sobre los hechos tras los cuales tres albañiles fueron capturados por la policía, pero una empleada dijo que el ingeniero encargado del proyecto no estaba.
Al mediodía se logró obtener el teléfono de Marvin Vicente, a quien diversas fuentes señalan como el encargado de la ejecución del proyecto por parte de la empresa contratada por la DOM, se estableció contacto, se le explicó el objeto de la visita a la oficina y de la llamadas telefónica a él propiamente, sin embargo dijo que estaba muy ocupado, que podría atender más tarde, entre las 2:00 y 3:00 pm. Al llamarlo al filo de las 3:00 dijo que aún estaba ocupado y pidió que se le llamara 30 minutos después, sin embargo, ya no contestó el teléfono.
También se intentó obtener la versión de la DOM, pero al cierre de esta nota tampoco hubo respuesta.
