A total of 3,169 public employees have been laid off without due process as of December 17 of this year, according to a complaint by the Movimiento de Trabajadores Despedidos (MTD) as part of their documentation of human rights violations during Nayib Bukele’s second presidential term.
According to data recorded by the MTD, as of September 7, 2,250 workers had already been dismissed, including 450 from the municipalities of San Salvador Centro, San Salvador Sur, and La Paz Este. Additionally, 900 were laid off from the Ministry of Culture, as well as another 900 from the Legislative Assembly.
On September 24, the movement also warned about layoffs affecting 400 employees of the Procuraduría General de la República (PGR) (Office of the Attorney General) across the institution’s 18 offices nationwide. The affected individuals stated that the job cuts were justified by the elimination of positions targeting employees over 60 years old and those who were already retired.
Following that, the group reported additional layoffs: 33 at the Ministry of Health, 13 at the Ministry of Education, five at the Instituto Salvadoreño de Bienestar Magisterial (ISBM) (Salvadoran Institute of Teachers’ Welfare), 14 at the Ministry of Agriculture and Livestock (MAG), and three at the Ministry of Finance.
Moreover, the numbers include 95 layoffs at the Tribunal Supremo Electoral (TSE) (Supreme Electoral Tribunal), 60 at the Corte Suprema de Justicia (CSJ) (Supreme Court of Justice), and 16 at the Comisión Nacional de la Micro y Pequeña Empresa (CONAMYPE) (National Commission for Micro and Small Businesses).
The 33 layoffs occurred around the same time the 2025 General Budget of the Nation was presented, following the October 19 “white march.”
“In a retaliatory move, 84 workers were notified of their dismissal under the guise of position elimination included in the 2025 budget, even though it had not yet been approved by the Legislative Assembly,” MTD representatives declared in a press conference.
They further stated that “No head official can justify dismissals based on regulations that do not exist. Thus, these actions are illegal and arbitrary.”
Additionally, on Monday and Tuesday of this week, 230 people were laid off from the Ministry of Health (MINSAL) and 50 from the Consejo Nacional de la Judicatura (CNJ) (National Judicial Council).
During President Nayib Bukele’s first term, MTD estimates that approximately 21,000 layoffs occurred. This figure includes 14,000 workers removed across 46 governmental departments, 4,444 employees let go at municipalities governed by Nuevas Ideas, and 2,550 dismissals from the Legislative Assembly and Public Prosecutor’s Office.
Demands
In response to the situation, the Movimiento de Trabajadores Despedidos has called upon the Ministers of Health, Education, and Agriculture, as well as the president of the ISBM and the president of CONAMYPE, to immediately reinstate workers who were unjustly laid off.
The group denounced the “arbitrary and illegal” layoffs of thousands of employees and called upon judges and magistrates from the CSJ and the Civil Service Tribunal to act lawfully in response to the claims of amparo and annulment submitted by the affected workers.
“We demand respect for the right to work, the cessation of dismissals, and adherence to due process. Moreover, we call for the respect and application of the Salary Escalation Law for the Health and Education sectors,” the MTD concluded.
Denuncian 3,169 despidos del sector público en 2024
Un total de 3,169 empleados públicos despedidos sin el debido proceso han ocurrido hasta el 17 de diciembre de este año, según la denuncia del Movimiento de Trabajadores Despedidos (MTD) que hacen como parte de las violaciones a derechos humanos en el segundo mandato presidencial de Nayib Bukele.
De acuerdo con los datos registrados por el MTD, hasta el 7 de septiembre pasado hubo 2,250 trabajadores despedidos, entre los que figuran 450 de las alcaldías de San Salvador Centro, San Salvador Sur y La Paz Este. Además, 900 en el Ministerio de Cultura y otros 900 en la Asamblea Legislativa.
El 24 de septiembre pasado, el Movimiento de Trabajadores también advirtió sobre el despido de 400 empleados de la Procuraduría General de la República (PGR), de las 18 sedes que la institución tiene a nivel nacional. En esa situación los afectados señalaron que el recorte fue justificado con la supresión de plazas dirigida a empleados mayores de 60 años y los que ya estaban jubilados.
Posterior a ello, denunció 33 despidos más en el Ministerio de Salud, 13 en el Ministerio de Educación, cinco en el Instituto Salvadoreño de Bienestar Magisterial (ISBM), 14 en el Ministerio de Agricultura y Ganadería (MAG) y tres en el Ministerio de Hacienda.
También suman otros 95 despidos en el Tribunal Supremo Electoral (TSE), 60 en la Corte Suprema de Justicia (CSJ) y 16 en la Comisión Nacional de la Micro y Pequeña Empresa (CONAMYPE).
Esos 33 despidos ocurrieron en el marco de la presentación del Presupuesto General de la Nación 2025 y posterior a la marcha blanca del 19 de octubre.
“En un acto revanchista, le notificaron a 84 trabajadores su despido bajo la figura de supresión de plazas contenida en el presupuesto 2025, aún cuando este no estaba aprobado por la Asamblea”, denunció el MTD, en conferencia.
Sentenció que “ningún funcionario titular puede justificar despidos amparados en una normativa que no existe, por lo tanto son acciones ilegales y arbitrarias”.
Mientras que entre el lunes y martes de esta semana, hubo 230 despidos en el MINSAL y 50 en el Consejo Nacional de la Judicatura (CNJ).
En el primer periodo gubernamental de Nayib Bukele, el MTD sostiene que hubo 21,000 despidos, los cuales incluyeron 14,000 en 46 dependencias de Gobierno; 4,444 en alcaldías de Nuevas Ideas y 2,550 en la Asamblea y el Ministerio Público.
Demandas
Ante la situación, el Movimiento de Trabajadores Despedidos demandó a los ministros de Salud, Educación, Agricultura, a la presidenta del ISBM y al presidente de CONAMYPE, el reinstalo inmediato de las personas despedidas de forma injustificada.
Denunció los despidos “arbitrarios e ilegales” de miles de trabajadores e instó a los jueces y magistrados de la CSJ y al Tribunal del Servicio Civil a actuar en apego a derecho con base a las demandas de amparo y de nulidad interpuestas por los empleados afectados.
“Demandamos respetar el derecho al trabajo, detener los despidos y seguir el debido proceso. Además, respetar y aplicar la Ley de Escalafones para Salud y Educación”, sentenció el MTD.
