Families of victims of the state of exception from communities in Bajo Lempa filed 66 complaints with the Inter-American Commission on Human Rights (IACHR) in March of last year. Their cases are progressing with information requests to the Salvadoran state and interviews with relatives, aiming to implement precautionary measures for protection and release.
According to Salvador Ruiz, spokesperson for the ecclesial communities of Bajo Lempa and the Committee of Relatives of Victims of the State of Exception of Bajo Lempa, the Salvadoran state responded but “lied” by claiming that families have seen the detainees and have access and communication with their attorneys, “which is a farce.” Afterward, the CIDH interviewed the families again, who refuted the official version.
“The cases are with the Commission. We know the state provided false information, lied, and we hope the case moves forward. We are pleased because the CIDH issued a favorable statement for the victims, even if the state refuses to acknowledge it. We have no other choice but to keep insisting,” said Ruiz.
To date, 174 people have been detained in Bajo Lempa under the state of exception, and families have made all possible efforts to secure their release. They have filed 66 cases of individuals with no ties to gangs before the Attorney General’s Office (FGR) and submitted 134 habeas corpus petitions to the Constitutional Chamber of the Supreme Court of Justice (CSJ), yet they have received no response.
According to the human rights organization Cristosal, which is handling these cases before the CIDH, they are awaiting decisions from the international body based on the complaints, testimonies, state responses, and later interviews with the victims’ families.
Abraham Ábrego, Director of Strategic Litigation at Cristosal, mentioned that they turned to the CIDH after presenting the cases at the national level without receiving a favorable response. Regarding the Constitutional Chamber, he stated that it only issued procedural preventions, which the organization deemed inadequate, ultimately rejecting the filings and not appointing executing judges to verify the conditions of the detainees.
“Approximately 200 people from the Bajo Lempa communities have been arrested, most affected by arbitrary detentions, as often happens under the state of exception. They have also faced deaths, cases of torture, and restrictions on visiting relatives, among other violations. These individuals’ rights to liberty and physical integrity have been severely affected,” Ábrego stated.
He also emphasized that the CIDH notified the state about this complaint and gathered information. The cases of these 66 individuals are being processed in hopes that the requested precautionary measures will be granted.
The Case of Duval
José Duval Mata Alvarado was arrested on April 18, 2022, and has received two release orders: one from the Specialized Instruction Court of San Miguel dated September 21, 2022, and another from the Second Organized Crime Tribunal of Santa Ana dated June 12, 2023. However, he remains in custody, and the latest information received by his family indicates that he has been confined at the Center for Confinement against Terrorism (CECOT), making him, in their view, effectively disappeared.
“My son was arrested, and since then it has been a long and painful struggle for me and our entire family. He left his partner when she was four months pregnant. I’ve proven my son’s innocence in many places and presented documents. I have two release orders issued over a year ago. The hardest part is not knowing about my son or whether he is even alive,” said Marcela Alvarado, Duval’s mother.
Regarding this, Ábrego stated that the state of exception has caused great suffering for families, and they seek CIDH intervention to grant precautionary measures.
“There are individuals doubly punished by the lack of guarantees for due process. For example, the case where prison authorities refuse to comply with release orders even under substitute measures. This is why Cristosal supported the communities last year in reporting violations of the right to liberty, physical integrity, life, due process, among other rights, requesting precautionary measures,” he added.
La Prensa Gráfica contacted the presidential commissioner for human rights and freedom of expression, Andrés Guzmán, regarding these cases. He stated that the CIDH has not recently requested information but affirmed that any future formal requests would be processed accordingly.
“If formally submitted, a corresponding analysis will be conducted to ensure compliance with legal provisions and the fundamental rights of the individuals involved. We reiterate our commitment to respecting and promoting human rights,” said the official.
Denuncias de capturas en Bajo Lempa avanzan en CIDH
Familiares de víctimas del régimen de excepción de las comunidades del Bajo Lempa interpusieron 66 casos de denuncias ante la Comisión Interamericana de Derechos Humanos (CIDH), en marzo del año pasado y sus casos avanzan con la solicitud de información al Estado salvadoreño y entrevistas a los familiares, en el cual buscan que se otorguen medidas cautelares de protección y libertad.
Según externó Salvador Ruiz, vocero de las comunidades eclesiales del Bajo Lempa y del Comité de Familiares de Víctimas del Régimen de Excepción del Bajo Lempa, el Estado salvadoreño dio respuesta en la cual “ha mentido” pues indicaron que los familiares han visto a los detenidos, que cuentan con acceso y comunicación con sus abogados “lo cual es una farsa”. Tras esto, la CIDH entrevistó nuevamente a las familias quienes desmintieron la versión oficial.
Los casos están ahí en la Comisión. Sabemos que el Estado dio información falsa, han mentido y esperamos que el caso vaya por buen camino. Nos sentimos satisfechos porque la CIDH ha dado un pronunciamiento favorable para las víctimas, aunque el Estado no quiere reconocer. No nos queda otro camino que seguir insistiendo”, indicó Ruiz.
Hasta la fecha, en el Bajo Lempa se han detenido a 174 personas bajo el régimen de excepción y las familias han realizado todas las gestiones posibles que sean liberadas. Han presentaron 66 casos de personas que no tienen vínculos con pandillas, ante la Fiscalía General de la República (FGR), además interpusieron 134 habeas corpus ante la Sala de lo Constitucional de la Corte Suprema de Justicia (CSJ), pero hasta la fecha, no han tenido respuesta.
De acuerdo con la organización de derechos humanos y que lleva el caso de estas denuncias ante la CIDH, Cristosal, están a la espera de las decisiones que tome el organismo internacional en base a las denuncias, testimonios, respuesta del Estado y posteriores entrevistas a las familias de las víctimas.
Abraham Ábrego, director de Litigio Estratégico de Cristosal, mencionó que se buscó a la CIDH tras exponer los casos ante las instancias nacionales y no obtenerespuesta favorable. De la Sala, dice que solo hizo prevenciones que a juicio de la institución no eran adecuadas, pero que finalmente no admitió, tampoco nombró jueces ejecutores que verificaran la situación de los privados de libertad.
“Las personas que han sido capturadas dentro de las comunidades del Bajo Lempa son aproximadamente 200 y la mayoría fueron afectadas por detenciones arbitrarias como ha pasado con el régimen. Han tenido también afectaciones de muertes, de casos de torturas, restricciones para visitar a los familiares. Diríamos que las personas han sido afectadas en su derecho a la libertad e integridad física”, externó Ábrego.
Sostiene además, que la CIDH informó al Estado sobre esta denuncia y generó información. El caso de esas 66 personas está en proceso para que se tramite, esperando que pueda resolver las medidas cautelares solicitadas.
El caso de Duval
José Duval Mata Alvarado fue capturado el 18 de abril de 2022 y ha recibido dos cartas del libertad, uno de parte del Juzgado Especializado de Instrucción de San Miguel, con fecha de 21 de septiembre de 2022, y otro del Tribunal Segundo contra el Crimen Organizado de Santa Ana con fecha del 12 de junio de 2023. Sin embargo, sigue detenido y la última información dada a su familia es que ha sido recluido en el Centro de Confinamiento contra el Terrorismo (CECOT), por lo que para ellos está en calidad de desaparecido.
“Mi hijo fue capturado y desde ahí ha sido una lucha grande y dura, tanto para mí como para toda su familia. Dejó a su compañera de vida cuando tenía cuatro meses de embarazo. He demostrado la inocencia de mi hijo en muchos lugares, he presentado documentos, tengo dos resoluciones de libertad desde hace más de un año. Lo más duro es no saber de mi hijo, ni saber si está vivo”, dijo Marcela Alvarado, madre de Duval.
Sobre esto, Ábrego indicó que el régimen ha dado mucho dolor a las familiares y buscan que la CIDH pueda otorgar medidas cautelares.
“Hay personas que han sido doblemente castigadas con la falta de garantías al debido proceso. Por ejemplo, el caso donde a pesar de tener órdenes de libertad con medidas sustitutivas, la dirección de centros penales se ha negado a cumplirlas. Por eso, es que el año pasado Cristosal acompañó a las comunidades a esta denuncia por violación al derecho a la libertad, a la integridad física, a la vida, al debido proceso, entre otros y se solicitaron las medidas cautelares”, agregó.
LA PRENSA GRÁFICA consultó al comisionado presidencial de derechos humanos y libertad de expresión, Andrés Guzmán, sobre estos casos, y manifestó que la CIDH no ha vuelto a realizar solicitud de información, pero que de recibirlo la tramitarán.
“Si llegase a plantearse de manera formal, se realizará el análisis correspondiente para garantizar que se cumplan las disposiciones legales y los derechos fundamentales de las personas involucradas.Reiteramos nuestro compromiso con el respeto y la promoción de los derechos humanos”, indicó el funcionario.
