The appointment of seven new magistrates to the Supreme Court of Justice (CSJ), all aligned with the government, consolidates the control of the Nuevas Ideas party over the Salvadoran judicial system. This assertion is shared by three experts consulted by FOCOS, who also warn of attacks on judicial independence and “terror” within the legal community.

In this interview with FOCOS, Úrsula Indacochea, Program Director at the Due Process of Law Foundation (DPLF), Judge Antonio Durán from Zacatecoluca, and constitutional lawyer Enrique Anaya discuss the implications of the latest selection of CSJ magistrates, which includes former employees of the Presidency and judges aligned with the government.

According to Úrsula Indacochea, DPLF has documented that attacks on judicial independence in El Salvador started “long before” May 1, 2021, when the Legislative Assembly dismissed the five magistrates from the Constitutional Chamber and appointed lawyers sympathetic to the Presidential House.

“The attacks began even during Nayib Bukele’s presidential campaign and then manifested in the public arena, using public discourse to attack the magistrates in a permanent and consistent manner, creating a favorable environment so that when they were dismissed, the public would not react,” she said.

After unconstitutionally appointing the five magistrates, she noted, Nuevas Ideas filled another five vacancies out of the 15 total in the CSJ in October of that year. The remaining five were elected on September 23, completing Nuevas Ideas’ total representation in the Court.

A Questioned Election

Constitutional lawyer Enrique Anaya claimed that the candidates elected by the Legislative Assembly “are magistrates of the dictatorship” because “both the election process and the decision-making seem to me unconstitutional, anticonventional, and politically disastrous.”

“The election of the CSJ magistrates was through an opaque, politically cynical procedure, as lawmakers claimed they were complying with the Constitution and constitutional jurisprudence, while in reality, they were violating it,” he stated.

Anaya stressed that lawmakers are “obliged to document not only the compliance with requirements but also to verify and motivate why they select this person” despite their failing to meet prerequisites.

However, he mentioned, the election was made “solely and exclusively based on political conveniences,” appointing magistrates who “have demonstrated loyalty to the regime, whether through actions or words.”

Among the magistrates elected by Nayib Bukele’s party are judges, CSJ officials, and advisers close to the Presidency. Óscar López Jerez, former CSJ president now magistrate of the Civil Chamber, endorsed Bukele’s presidential reelection, and others like Alejandro Antonio Quinteros Espinoza, former magistrate of the Criminal Chamber, implemented the state of exception.

A “Climate of Terror” Among Judges

For Judge Antonio Durán from Zacatecoluca, this “capture” of the Judicial Branch by the government has resulted in a “climate of terror” among lawyers and judges, who fear being removed or persecuted for their stances.

“The current legal reality is that we are living under a dictatorship, with the removal of the Constitutional Chamber and previous attacks (…) There is a breakdown of constitutional order, not only due to the unconstitutional appointment of magistrates but also the subsequent removal of a third of the judges,” he stated.

A reform to the Judicial Organic Law, approved in September 2021, pushed for the mass dismissal of judges over 60 years old with 30 years of service. The remaining judges were put “at the disposal” of the Court, and many have already been arbitrarily dismissed or transferred, Durán noted.

Thus, while “many judges have been appointed through connections, by phone calls,” others are persecuted. “A climate of fear, a climate of terror has been created over the judiciary. Judges are even afraid to express their opinions in private spaces,” he indicated.

«Se ha creado un ambiente de terror sobre la judicatura”: Juez Durán

La elección de siete nuevos magistrados de la Corte Suprema de Justicia (CSJ), todos afines al oficialismo, afianza el control del partido Nuevas Ideas sobre el sistema judicial salvadoreño, según coinciden tres expertos consultados por FOCOS, quienes advierten, además, ataques a la independencia judicial y “terror” entre la comunidad jurídica. 

En esta entrevista con FOCOS, la directora de Programa de la Fundación para el Debido Proceso (DPLF), Úrsula Indacochea; el juez de Sentencia de Zacatecoluca Antonio Durán, y el abogado constitucionalista Enrique Anaya, analizan las implicaciones de la última elección de magistrados de la CSJ, que incluyó a exempleados de la Presidencia y jueces afines al oficialismo.

De acuerdo con Úrsula Indacochea, DPLF ha documentado que los ataques a la independencia judicial en El Salvador iniciaron “mucho antes” del 1 de mayo de 2021, cuando la Asamblea Legislativa destituyó a los cinco magistrados de la Sala de lo Constitucional y nombró a abogados afines a Casa Presidencial. 

“Los ataques iniciaron incluso desde la campaña presidencial de Nayib Bukele, y luego se manifestaron en el uso de la palestra pública, del discurso público, para atacar a los magistrados de una forma permanente, constante, y crear un ambiente favorable para que al ser destituidos, la ciudadanía no reaccionara”, afirmó.

Luego de nombrar inconstitucionalmente a los cinco magistrados, recordó, Nuevas Ideas eligió en octubre de ese año otras cinco vacantes de las 15 que totalizan la CSJ. Los cinco restantes fueron electos este 23 de septiembre, completando la representación total de Nuevas Ideas en la Corte.

Una elección cuestionada

El abogado constitucionalista, Enrique Anaya, aseguró que los candidatos electos por la Asamblea Legislativa “son magistrados de la dictadura” porque “tanto el procedimiento de elección como la toma de decisión me parecen inconstitucionales, anticonvencionales y políticamente nefastas”. 

“La elección de los magistrados de la CSJ fue mediante un procedimiento opaco, políticamente cínico, en tanto que los diputados decían que estaban cumpliendo con la Constitución y jurisprudencia constitucional, y en realidad la estaban violando”, indicó.

Anaya señaló que los diputados están “obligados a documentar no solamente el cumplimiento de los requisitos, si no también verificar y motivar por qué selecciona a esta persona” a pesar de incumplir requisitos, indicó.

Pero la elección, dijo, “se hizo única y exclusivamente en razón de conveniencias políticas”, colocando a magistrados que “han demostrado la lealtad al régimen, ya sea con hechos o con palabras”. 

Entre los magistrados electos por el partido de Nayib Bukele se encuentran jueces, funcionarios de la CSJ y asesores cercanos a la Presidencia de la República. Óscar López Jerez, expresidente de la CSJ ahora magistrado de la Sala de lo Civil; avaló la reelección presidencial de Bukele, y otros como Alejandro Antonio Quinteros Espinoza, exmagistrado de la Sala de lo Penal, implementaron el régimen de excepción.

Un “ambiente de terror” entre jueces

Para el juez de Sentencia de Zacatecoluca, Antonio Durán, esta “captura” del Órgano Judicial en manos del oficialismo ha resultado en un ambiente de “terror” entre abogados y jueces, que temen ser removidos o perseguidos por sus posturas. 

“La realidad jurídica actual es que estamos viviendo una dictadura, con la remoción de la Sala de lo Constitucional y los ataques previos (…) Hay una ruptura del orden constitucional, no solo por el nombramiento inconstitucional de magistrados, si no la posterior remoción de la tercera parte de los jueces”, afirmó. 

Una reforma a la Ley Orgánica Judicial aprobada en septiembre de 2021, impulsó la destitución masiva de jueces mayores de 60 años de edad y con 30 años de servicio. Los jueces que quedaron, además, fueron puestos “a disposición” de la Corte, y muchos han sido ya cesados o trasladados de forma arbitraria, indicó Durán. 

Así, mientras “hay muchos jueces que han sido puestos por cherada, por llamadas telefónicas”, otros son perseguidos. “Se ha creado un ambiente de miedo, un ambiente de terror sobre la judicatura. Los jueces tienen hasta temor de opinar en los espacios privados”, indicó.
