The reform to the Cultural Heritage Protection Law, approved by the Legislative Assembly on June 26 but still pending executive sanction, has been criticized by historian and academic Carlos Cañas Dinarte.
In an interview with YSUCA radio, Cañas stated that the reform “puts all of the country’s heritage assets at risk” and listed various scenarios that could occur due to the wording of the reform.

“If the municipal palace of Santa Ana, which has had structural problems for years, submits a request to the Ministry of Culture, and to this new body to approve constructions; and both the body and the ministry deem it a building that can be intervened and demolished, they can certainly do it,” he pointed out.
He also indicated that the Historic Center could be subject not to more renovations but to what he called “aggressive interventions.”
“It could happen that they lift the restrictions that much of the Historic Center of San Salvador has had and they could demolish entire blocks; just as it happened with block 6, south of the national palace, and demolish it overnight,” he added.
The reform to the law was approved without undergoing the proper legislative process by Nuevas Ideas and allied parties, without any of the 57 lawmakers forming part of the ruling party explaining the content of the reform or justifying why it was necessary. As of the June 27 edition of the Official Gazette, the reform had yet to be published.

La reforma a la Ley de Protección del patrimonio cultural, aprobada por la Asamblea Legislativa el pasado 26 de junio, pero pendiente aún de ser sancionada por el órgano ejecutivo, fue cuestionada por el historiador y académico Carlos Cañas Dinarte.
En entrevista con la radio YSUCA, Cañas aseguró que la reforma “pone en peligro todos los bienes patrimoniales del país”, y enumeró diversos escenarios que podrían ocurrir dada la redacción de la reforma.

“Si el palacio municipal de Santa Ana, que lleva años con problemas estructurales, somete una petición al ministerio de Cultura, y ante ese nuevo organismo para aprobar construcciones; y ese y el ministerio opinan que es un edificio que pueda ser intervenido y demolido, lo pueden hacer perfectamente”, indicó.
Asimismo, señaló que el Centro Histórico puede ser objeto no de más remodelaciones sino de lo que denominó “intervenciones agresivas”.
“Puede ocurrir que le levanten restricciones que ha tenido gran parte del Centro Histórico de San Salvador y que puedan demoler manzanas enteras; así como pasó con la manzana 6, al sur del palacio nacional, y de la noche a la mañana demolerla”, apuntó.
La reforma a la ley fue aprobada con dispensa de trámite por parte de Nuevas Ideas y partidos aliados, sin que ninguno de los 57 legisladores que forman parte del oficialismo explicará el contenido de la reforma, o justificará el porqué era necesaria la misma. Hasta la edición del Diario Oficial del 27 de junio, la reforma no había sido publicada aún.
