Attorney Lucrecia Landaverde has made public that she faces a disciplinary process for alleged “notoriously immoral professional or private misconduct,” which is currently being carried out by the Professional Investigation Section of the Supreme Court of Justice (CSJ).
The process, according to Landaverde, began after she gave statements to LA PRENSA GRÁFICA on March 15 about the death of former government advisor Alejandro Muyshondt. That day, she denounced that she was being intimidated with a file in the same Section for alleged anomalies in another judicial process, but this did not proceed.
“The purpose is to silence me. According to the evidence of the falsehoods and fraud committed in the first process against me, which they had to archive, they want to silence me so that the irregularities committed by the same authorities who judge us are not known,” explained Landaverde to LA PRENSA GRÁFICA.
This media outlet sought the version of the Professional Investigation Section yesterday through the CSJ’s communications department, but there was no response to the email sent by the time of this note.
Landaverde claimed that the basis of the accusation, defining whether her statements fall into the “notoriously immoral,” has no legal basis, since a ruling by the Constitutional Chamber on June 1, 2022 determined that this concept, contained in Article 8 of the Notary Law, is an “insufficient regulation” and therefore ordered the Legislative Assembly to “establish parameters to determine when a behavior fits into any of those concepts”, which has not yet been done.
Landaverde said that although she fears the process may already be “rigged,” she will not remain silent and will take the case to other instances in case she is suspended from her profession.
“The population needs lawyers who raise their voices without fear and who defend them from all these abuses and arbitrary arrests. Cowards will only help convict all the innocents,” she opined. “What is the role of CSJ officials, administering justice or punishing those they choose as their ‘enemies’ for not remaining silent? Do we have freedom of expression and opinion or are we obliged to silence all injustices and illegalities? What judicial independence is there?” added the attorney, who once again highlighted the silence of the current government and the Prosecutor’s Office regarding Alejandro Muyshondt’s death.

La abogada Lucrecia Landaverde hizo público que enfrenta un proceso sancionatorio por supuesta “mala conducta profesional o privada notoriamente inmoral”, el cual es realizado actualmente por la Sección de Investigación Profesional de la Corte Suprema de Justicia (CSJ).
El proceso, según explicó Landaverde, inició después que ella brindó declaraciones a LA PRENSA GRÁFICA el 15 de marzo sobre la muerte del exasesor gubernamental Alejandro Muyshondt. Ese día ella denunció que estaba siendo intimidada con un expediente en la misma Sección por supuestas anomalías en otro proceso judicial, pero este no prosperó.
“El propósito es silenciarme. Según la evidencia de las falsedades y fraude cometido en el primer proceso en mi contra, que tuvieron que archivar, me quieren callar para que no se conozcan las irregularidades cometidas por las mismas autoridades que son quienes nos juzgan”, explicó Landaverde a LA PRENSA GRÁFICA.
Este medio buscó ayer la versión de la Sección de Investigación Profesional a través del departamento de comunicaciones de la CSJ, pero al cierre de esta nota no hubo respuesta al correo enviado.
Landaverde afirmó que la base de la acusación, la de definir si sus declaraciones caen en lo “notoriamente inmoral”, no tienen sustento legal, pues una sentencia de la Sala de lo Constitucional del 1 de junio de 2022 determinó que ese concepto, contenido en el artículo 8 de la Ley de Notariado es una “regulación deficiente” y por ello ordenó a la Asamblea Legislativa a “fijar parámetros para determinar cuándo un comportamiento encaja en alguno de esos conceptos”, lo cual no se ha hecho aún.
Landaverde dijo que aunque teme que el proceso ya esté “amañado”, ella no callará y llevará el caso a otras instancias en caso la suspendan de su profesión.
“La población necesita abogados que alcemos la voz sin miedo y que les defendamos de todos estos abusos y capturas arbitrarias. Los cobardes solo ayudarán a que condenen a todos los inocentes”, opinó.
“¿Qué función cumplen los funcionarios de la CSJ, la de administrar justicia o la de ajusticiar a quienes eligen como sus “enemigos” por no quedarse callados? ¿Tenemos libertad de expresión y de opinión o estamos obligados a callar todas las injusticias e ilegalidades? ¿Qué independencia judicial hay?”, añadió la abogada, que volvió a remarcar el silencio del actual gobierno y la Fiscalía por la muerte de Alejandro Muyshondt.
