On Monday, April 22, the Unit for the Defense of Human and Community Rights (Unidehc), along with relatives of the young man Javier González, filed a penal notice against the National Civil Police (PNC) for the crimes of torture and arbitrary acts, and against Commissioner Mauricio Arriaza Chicas, director of the institution, for the crime of noncompliance with duties.
According to the arguments of Rudy Joya, legal representative of González and spokesman for Unidehc, Javier’s arrest was arbitrary and illegal, and they have submitted evidence to the Prosecutor’s Office, because the young man had experienced harassment from police officers within the framework of the state of exception.
The lawyer detailed that his client suffered psychological torture and arbitrary acts by the officers for linking him to gangs, who arrested him on April 8 of this year, which is why he filed the notice with the Prosecutor’s Office, as he claims that his client does not belong to gangs and that the police have no evidence to the contrary.
“This reflects not only that the arrest is arbitrary, the police themselves know they have no evidence or evidence to say that Javier is part of any criminal structure, they even invented that he manages the finances of the gang in the area,” said Joya.
Joya said that Javier had in his possession a document that the Prosecutor’s Office had given him in March of this year, which stated that he has no active criminal investigation records. The lawyer pointed out that it was possible that after his arrest, a few weeks after the document was issued, he now already has a criminal record.
“It is necessary to carry out all these legal actions to pressure the authorities, not only to investigate but also to demand what we have been doing with the family, which is freedom for Javier,” stated Joya.
Javier’s mother, Ana Chávez, called for justice for her son and for his case to be investigated so that he can be released.
“What I want is freedom for my son and for so many innocent people. Today, as we are living through this, we realize that there are so many innocent people and even some who have died inside, it is outrageous that the president, the first lady are not aware of all this. How can they say they have the law for the child, if the children are traumatized by living through all these kinds of situations? What we want is justice for my son, for them to open the cases, to review them well and to give the opportunity for people to get out,” stated Ana.
Rosa Bonilla, Javier’s wife, said they gave him an alias when he is not even a gang member, and that the authorities have even asked for the deeds to their house.
“They have denigrated him, they even gave him an alias, they changed his name. I feel that this is not right, in the system he has no criminal record, he has nothing to owe to the law,” she stated.

Presentan aviso penal contra la Policía Nacional Civil y contra su director, Mauricio Arriaza Chicas
Este lunes 22 de abril la Unidad de Defensa de Derechos Humanos y Comunitarios (Unidehc), junto a familiares del joven Javier González, presentaron un aviso penal contra la Policía Nacional Civil (PNC) por los delitos de tortura y actos arbitrarios, y contra el comisionado Mauricio Arriaza Chicas, director de la institución, por el delito de incumplimiento de deberes.
De acuerdo a los argumentos de Rudy Joya, representante legal de González y vocero de la Unidehc, la captura de Javier fue arbitraria e ilegal, y constan de pruebas que han entregado a la Fiscalía, porque el joven había recibido acoso por parte de agentes policiales en el marco del régimen de excepción.
El abogado detalló que su cliente sufrió tortura psicológica y actos arbitrarios por parte de los agentes por vincularlo a las pandillas, que lo capturaron el pasado 8 de abril de este año, por ello intepone el aviso ante la Fiscalia, ya que asegura que su cliente no pertenece a pandillas y que la policia no tiene pruebas de lo contrario.
“Esto refleja no solo que la detención es arbitraria, la misma policía sabe que no tiene ningún indicio, ni elemento probatorio para decir que Javier es parte de alguna estructura criminal, Incluso han inventado que dirige el tema de las finanzas, de la pandilla de la zona”, señaló Joya.
Joya dijo que Javier tenía en su poder un documento que la Fiscalía le había entregado en marzo de este año, en el que constaba que no tiene ningún expediente de investigación penal activo. El abogado señaló que como era posible que luego que lo capturaron, unas semanas después de emitido ese documento, hoy ya tenga un expediente criminal.
“Es necesario realizar todas estas acciones legales para presionar a las autoridades, no solo para que investiguen, sino exigir lo que venimos haciendo con la familia que es libertad para Javier”, aseveró Joya.
La madre de Javier, Ana Chávez, pidió justicia para su hijo y que se investigue su caso para que lo liberen.
“Lo que quiero es libertad para mi hijo y para tantos inocentes. Hoy que estamos viviendo esto nos damos cuenta que hay tantas personas inocentes y hasta han muerto ahí adentro, que barbaridad que el presidente, la primera dama no estén pendientes de todo eso. Como es que dicen que tienen la ley para el niño, si los niños están traumados viviendo todo este tipo de situaciones. Nosotros lo que queremos es justicia para mi hijo,que abran los casos, que revisen bien y que den oportunidad de que salga la gente” aseveró Ana.
Rosa Bonilla, esposa de Javier dijo que le pusieron un alias, cuando ni siquiera es pandillero, y que las autoridades han llegado hasta pedirles las escrituras de su casa.
“Me lo han denigrado, hasta me le han puesto un alias, le cambiaron el nombre. Siento que no está bien, en el sistema él no tiene ningún antecedente penal, no tiene nada que le deba a la ley”, aseguró.
