Assistant District Attorney Earnie Israel G. S. was arrested on charges of aggravated documentary falsification and ideological falsification. The Attorney General’s Office (FGR) reported briefly on its social media channels.

“The detainee was serving as an assistant attorney in Usulután and took advantage of his position to add false information in official documents of the institution, which were presented in judicial instances,” the post states.

The Public Ministry maintains that the acts attributed to Earnie Israel were committed in August 2022 but provides no further details.

The arrested prosecutor is one of four assistant prosecutors who acted in the initial hearing against five boatmen captured on May 23, 2022, on Isla Espíritu Santo, in the jurisdiction of Puerto El Triunfo.

At the initial hearing, the five boatmen were sent to prison. Subsequently, the Center for Exchange and Solidarity (CIS) reported some irregularities in the process.

Among these irregularities, the prosecuting entity accused the boatmen based solely on the arrest report made by police officers and soldiers, which, according to family members, differed from how the arrests were actually made.

In a public complaint, CIS stated that the first arrestee was detained at a gas station while buying fuel; the second, when finishing a trip with tourists on his boat; the third, was returning with his family from purchasing construction materials in Usulután; and the other two were detained on the island, not at the port, as reported by the police authorities.

The prosecution’s accusation, based on the police report, indicates that the police were informed at the tourist terminal of the malecón that several suspicious people were gathered, and it was presumed they were planning criminal acts because they were collaborators of the 18 Sureños gang.

One of the detainees is Néstor Edgardo Hernández Guzmán, 45 years old, who is still in prison.

Leslie Schuld, director of CIS, explained that Néstor was arrested when he was returning to the malecón after making some construction material purchases in Usulután. He was accompanied by his mother, brother, life partner, son, and stepson.

At the malecón, a soldier approached him and whispered something in his ear, asked him his name and instructed him to step away from his family and head towards the group of people being checked.

The family members questioned the soldier about what was happening, but he told them that Néstor was being taken for an investigation for fifteen days, and after that, he would return to them.

The CIS representative stated that although the defense presented documents during the initial hearing, proving the boatmen owned the vessels and had other ties such as bank accounts and sworn statements, they were not taken into account.

At the second hearing to review the measures, prosecutor Earnie Israel had requested a body examination of Néstor to check for any tattoos and the testimony of several witnesses. However, Schuld explained that the results of the examination and the testimonies of the witnesses were not added to the case file.

Fiscal capturado por falsedad participó en acusación contra cinco lancheros de Isla Espíritu Santo

El fiscal auxiliar Earnie Israel G. S. fue capturado por el delito de falsedad documental agravada y falsedad ideológica, informó de manera escueta a través de sus redes sociales la Fiscalía General de la República (FGR).

“El capturado se desempeñaba como fiscal auxiliar en Usulután y se valió de su cargo para agregar información falsa en documentos oficiales de la institución, los cuales fueron presentados en instancias judiciales” señala el post. 

El Ministerio Público asegura que los hechos que se le imputan a Earnie Israel fueron cometidos en agosto de 2022, sin embargo no detalla más al respecto.

El fiscal detenido es uno los cuatros auxiliares fiscales que actuaron en la audiencia inicial contra cinco lancheros capturados el 23 de mayo de 2022, en  la Isla Espíritu Santo, jurisdicción de Puerto El Triunfo.

En la audiencia inicial los cinco lancheros fueron enviados a prisión, tras ello, el Centro de Intercambio y Solidaridad (CIS) denució algunas irregularidades en el proceso.

Entre esas irregularidades está, que el ente fiscal acusó a los lancheros basándose solamente en el relato de la captura consignada por los policías y soldados, lo cual, según los familiares difería de cómo realmente habían sido las detenciones. 

En una denuncia pública, el CIS manifestó que el primero, fue detenido en una gasolinera mientras estaba comprando combustible; el segundo, cuando finaliza un viaje con turistas en su lancha; el tercero, regresaba con su familia de realizar una compra de materiales en Usulután; y otros dos, fueron detenidos en la isla, no en el Puerto como consignaron las autoridades policiales. 

La acusación fiscal, basada en el reporte policial, indica que los policías fueron informados en la terminal turística de el malecón se encontraban reunidas varias personas sospechosas y se presume que estaban planeando hechos delictivos, porque se trataba de colaboradores de la pandilla 18 sureños.

Uno de esos detenidos es Néstor Edgardo Hernández Guzmán, de 45 años de edad, quien aún se encuentra en prisión. 

Leslie Schuld, directora del CIS, explicó que Néstor fue detenido cuando regresaba al malecón de hacer una compras de materiales de construcción en Usulután y era acompañado de su madre, hermano, compañera de vida, su hijo, y su hijastro. 

En el malecón se le acercó un soldado y le habló al oído, le preguntó su nombre y le indicó que se alejara de su familia y se dirigiera al grupo de personas que estaban revisando. 

Los familiares cuestionaron al soldado sobre qué pasaba, pero este les dijo que se lo llevaban a investigación por quince días y que luego de esto Néstor regresaría con ellos

La representante del CIS manifestó que apesar que en la audiencia inicial la defensa presentó los documentos que demostraban que los lancheros eran dueños de las embarcaciones y otros arraigos como cuentas bancarias y declaraciones juradas, no fueron tomados en cuenta. 

En la segunda audiencia de revisión de medidas, el fiscal Earnie Israel había solicitado un peritaje corporal de Néstor para comprobar si tenía un tatuaje y el testimonio de varios testigos, pero Schuld explicó que el resultado del peritaje y los testimonio de los testigos, no fueron anexados al expediente.
