There are disparate positions between two magistrates of the Supreme Electoral Tribunal (TSE) in statements to radio YSKL regarding ballots that have appeared with votes marked with a marker or pen, and not with the crayons that were delivered to each Election Monitoring Board (JRV) during the past presidential and deputy elections on February 4, 2024.
Magistrate Noel Orellana indicated, according to statements collected by YSKL on Thursday, that there are no regulations against Salvadorans marking their vote with another item besides the crayon provided by the Electoral Organization Directorate to each JRV.
“There are countries where people even bring their own pens. There is no provision that explicitly tells voters that they must cast their vote with the crayon that goes in the respective box,” said Orellana.
Conversely, electoral official Julio Olivo warned on Friday that “those ballots that have appeared, which are not even folded and which I pointed out, and it has been pointed out on the net, that they had marked them with a marker… That’s not normal. I have asked that we can investigate those cases, on our own, that we investigate cases of manipulation or alteration, in fact, we would have to ask how many ballots could appear with that type of information.”
Olivo pointed out that he has a hypothesis about what could have happened: “It may happen that (the receiving table) did not receive the crayon” on election day, which could lead to using another item for people to cast their vote.
For Orellana, “they are exceptional cases that obviously (we must) know about, analyze; and I imagine that the table will discuss it with the collegiate body, and we will determine what the law establishes for that purpose.”
Orellana conceded, however, that for the TSE “the crayon is safer.”
Suspicious ballots
Regarding the “ironed-out” ballots, that is, those that have appeared without any marks of having been folded or introduced into the ballot box, Olivo said that the TSE is obliged to investigate. He also proposed another theory about what could have happened.
“One hypothesis about those crisp ballots: it could be that they are leftover ballots, which at the end of the process you have to tear up or destroy, that you are not going to use,” Olivo mentioned as a possibility.
In any case, Olivo stated that “I would like to see one of those unfolded ballots. The ballots have security marks, I can request and have the code of each magistrate. I’m not going to give mine to anyone. We would have to see if the ballot is legitimate, there must be a whole expertise.”
If it were proven that members of the JRV have manipulated the ballots, marked them with a marker, or if there has been any forgery, Olivo warned that “there is an electoral crime because the members of that table, if you locate them, would have to see if they marked the leftovers. That is indeed altering the popular will.”
Olivo said he “would expect a reaction from the collegiate body, and those ballots should be the first” thing to be examined by the Tribunal. He also said that in this case a complaint is not necessary, neither from citizens nor political parties, but “on our own initiative we could carry it out, besides there are cameras” in the “Adolfo Pineda” Gym, where this final count is taking place.
“That’s what I’ve asked for: any case of manipulation, or incident, the TSE should be meeting to know about those cases. And it hasn’t been done,” regretted the magistrate, who took the opportunity to send an international message: “Organizations like the OAS (Organization of American States) have learned about this situation, they still have a representation that is watching. We should pay attention to this situation.”
Votos con plumón: choque de opiniones entre magistrados del TSE
Hay posiciones dispares entre dos magistrados del Tribunal Supremo Electoral (TSE), en declaraciones a radio YSKL, en cuanto a las papeletas que han aparecido con votos marcados con plumón o lapicero, y no con los crayones que fueron entregados en cada Junta Receptora de Votos (JRV), durante las pasadas elecciones presidenciales y de diputaciones del 4 de febrero de 2024.
El magistrado Noel Orellana indicó, según declaraciones que recoge YSKL este jueves, que no hay normativas en contra de que los salvadoreños marquen su voto con otro artículo que no sea el crayón entregado por la Dirección de Organización Electoral a cada JRV.
“Hay países en que inclusive las personas llevan sus bolígrafos. No hay una disposición que expresamente le dice que los votantes deberán emitir su voto con el crayón que va en las respectiva caja”, señaló Orellana.
El también funcionario electoral, Julio Olivo, alertó el viernes en cambio que “esas papeletas que han aparecido, que no están ni dobladas y que señalaba, y se ha señalado en la red, que las habían marcado con plumón… Eso no es normal. He pedido que se pueda investigar esos casos, de oficio, que los investiguemos casos de manipulación o alteración, de hecho habría que mandar a pedir cuántas papeletas podrían aparecer con ese tipo de datos”.
Señaló Olivo que tiene una hipótesis de lo que pudo haber ocurrido: “Puede suceder que (la mesa receptora) no haya recibido el crayón” el día de las elecciones, lo que pudo llevar a ocupar otro artículo para que las personas ejercieran su voto.
Para Orellana, “son casos excepcionales que obviamente (hay que) conocerlos, analizarlos; y me imagino que la mesa lo hablará al organismo colegiado, y determinaremos lo que para tal efecto establece la ley”.
Aceptó Orellana, sin embargo, que para el TSE “el crayón es más seguro”.
Papeletas sospechosas
En cuanto a las papeletas “planchadas”, es decir, las que han aparecido sin marcas de haber sido dobladas ni introducidas a la urna, Olivo dijo que el TSE está obligado a investigar. También lanzó otra teoría de qué pudo haber ocurrido.
“Una hipótesis de eso de las papeletas que estaban nítidas: podría ser que son papeletas sobrantes, que al final del proceso usted las tiene que rasgar o destruir, que no las va a utilizar”, mencionó Olivo, como posibilidad.
En todo caso, Olivo expresó que “quisiera ver una de esas papeletas sin doblar. Las papeletas tienen marcas de seguridad, puedo mandar a pedir y tienen clave de cada magistrado. La mía no se la voy a dar a nadie. Habría que ver si la papeleta es legítima, tiene que haber toda una experticia”.
Si se llegara a comprobar que miembros de las JRV han manipulado las papeletas, que las han marcado con plumón o que ha habido alguna falsificación, Olivo avisó que “ahí hay un delito electoral, porque los integrantes de esa mesa, si usted las ubica, habría que ver si marcaron las sobrantes. Eso sí está alterando la voluntad popular”.
Olivo dijo que “esperaría una reacción del organismo colegiado, y sobre esas papeletas debería ser lo primero” a conocer por el Tribunal. Así mismo, dijo que en este caso no es necesaria una denuncia, ni ciudadanía ni de partidos políticos, sino que “de oficio lo podríamos realizar, además hay cámaras” en el Gimnasio “Adolfo Pineda”, donde se desarrolla este escrutinio final.
“Eso es lo que he pedido: cualquier caso de manipulación, o incidente, el TSE debería estar reunido para conocer acerca de esos casos. Y no se ha estado haciendo”, lamentó el magistrado, quien aprovechó para lanzar un mensaje internacional: “La organizaciones como la OEA (Organización de Estados Americanos) se han enterado de esta situación, todavía tiene una representación que está observando. Habría que ponerle atención a esta situación”.
