Magistrate Noel Orellana of the Supreme Electoral Tribunal (TSE) admitted the failure of organizing the recent general elections to the Electoral Supervisory Board (JVE). Factum Magazine obtained an audio recording of this closed-door meeting, where Orellana also mentioned that they blindly believed in the technical teams and acknowledged that they detected logistical problems one day before the elections.

“It was crazy for us that day (…) I feel frustrated because we have tripled our efforts to make this process go well. I told my colleagues: ‘we made a mistake, and we must accept it, because we were so confident in the national vote that we prioritized the vote abroad'”, said Orellana, at a meeting the night of February 7 at the Hilton Hotel, where the final count is taking place.

On February 4, when the presidential and legislative elections were held, the preliminary count failed and there were logistical problems. To date, there are no official results for the election of deputies. Following a process plagued by irregularities, the TSE announced that it would establish between 300 and 400 tables to count each vote for the legislative election.

This year, El Salvador introduced electronic voting from abroad, but the process had several gaps. According to TSE data, more than 300,000 people living outside the country voted.

The JVE, which Orellana met with, oversees TSE activities and is made up of representatives of political parties. Its powers include monitoring the organization, installation, and training of electoral bodies and observing the entire counting process, according to Article 135 of the Electoral Code.

“All those bosses are fine, we (the magistrates) are the ones being attacked at this time (…) It puts us in not only uncomfortable situations but also in danger because we are not exempt from being investigated tomorrow thinking that we have participated in this not working”, said Orellana to the members of the JVE, adding that there will come a time when responsibilities will be determined.

This statement contrasts with the public statements of the magistrates to the media. He had said that the elections “have been carried out normally, it is obvious that contingencies may exist within these processes”. The president of the TSE even called the event successful on Sunday night.

On February 8, Factum contacted Orellana by phone about the statement he made to the Board, and he first denied having said it, but when told that this medium had the recording of the meeting, he limited himself to saying: “Publicly we have expressed that there were problems”.

They knew before the election

The TSE magistrates knew in advance of some logistical problems that led to the failure in transmitting the results. In the meeting with the JVE, magistrate Orellana explained that the blue boxes containing the technological equipment (computer, printer, scanner, mouse, and a hub) were not properly labeled, even though the “head of the corresponding unit” was ordered to do so, which was detected one day before the elections.

“One blindly believes in the technical team, but history is showing us that they did not work. First, the head of the corresponding unit was ordered to remove the label from that blue box, because it was for the 2021 election, but the person did not want to do it”, said Orellana, who said that after they ordered to place the 2024 label on top, they detected that it was not done.

Orellana also noted that the TSE requested security paper to print the necessary records to equip the polling centers, but the person in charge did not place it in the boxes and that this resource is in the Electoral Organization Directorate (DOE).

“The person in charge did not place that paper in each of the 8,562 packages. The paper is there, in the DOE, but they didn’t (include it in the boxes)”, said the TSE magistrate.

Orellana reported that when transportation arrived for the boxes, they did not want to transport them to the polling centers because they were labeled with the year 2021. He mentioned that the DOE director noticed the lack of paper in these boxes.

Factum Magazine published an audio of a meeting held on February 6 between magistrates and representatives of political parties, in which the head of the Computer Services Unit (USI) Ignacio Villagrán said that the failure was due to the lack of use of the contingency system in the Vote Receiving Boards (JRV) and the lack of security paper to print the records.

However, the instruction for the use of the TSE’s Registration and Transmission system for the 2024 elections indicates that the responsibility for coordination and execution of contingency management for transmission lies with the institution’s support managers.

“If the team cannot transmit due to connectivity issues, it will be the person in charge of the venue who will take care of that step when the equipment returns to the venue”, says the instruction.

Magistrado del TSE: “Cometimos un error, priorizamos el voto en el exterior”

El magistrado del Tribunal Supremo Electoral (TSE) Noel Orellana admitió ante la Junta de Vigilancia Electoral (JVE) el fracaso de las organización de las pasadas elecciones generales. Revista Factum accedió a un audio de esa reunión a puerta cerrada, donde Orellana también mencionó que creyeron “a ciegas” en los equipos técnicos, y además reconoció que detectaron problemas logísticos un día antes de las elecciones. 

“Era de locos para nosotros ese día (…) Me siento frustrado, porque hemos triplicado esfuerzos para que este proceso saliera bien. Yo le decía a mis compañeros: ‘cometimos un error, y eso hay que aceptarlo, porque estábamos tan confiados con el voto nacional que le dimos prioridad al voto en el exterior’”, dijo Orellana, en una reunión la noche del pasado miércoles 7 de febrero en el hotel Hilton, donde se desarrolla el escrutinio final.

El domingo 4 de febrero, cuando se celebraron las elecciones presidenciales y legislativas, fracasó el escrutinio preliminar, hubo problemas logísticos, y hasta esta fecha no hay resultados oficiales sobre la elección de diputados. Después de un proceso plagado de irregularidades, el TSE anunció que conformaría entre 300 y 400 mesas para contar voto por voto de la elección legislativa.

Este año, El Salvador estrenó el voto electrónico desde el exterior, pero el proceso tuvo varios vacíos. Según los datos del TSE, votaron más de 300 mil personas que viven fuera del país.

La JVE, con la que se reunió Orellana, fiscaliza las actividades del TSE y está conformada por representantes de partidos políticos. Entre sus facultades está vigilar la organización, instalación y capacitación de organismos electorales y observar todo el proceso de escrutinio, según el artículo 135 del Código Electoral.

“Todos esos jefes están bien, los atacados somos nosotros (los magistrados) en este momento (…) Nos pone en situaciones no solo incómodas, sino en riesgo también porque no estamos exentos de que el día de mañana se nos investigue pensando que tenemos participación para que esto no haya funcionado”, dijo Orellana a los miembros de la JVE, y añadió que iba a llegar el momento en el que se iba a deducir responsabilidades. 

Esta afirmación contrasta con las declaraciones públicas de los magistrados ante los medios de comunicación. Él había dicho que las elecciones “se han desarrollado dentro de lo normal, es obvio que dentro de estos procesos puedan existir contingencias”. La presidenta del TSE, incluso, calificó la jornada como exitosa el domingo por la noche.

Este jueves 8 de febrero, Factum consultó a Orellana vía telefónica sobre la afirmación que hizo ante la Junta y, primero negó haberlo dicho, pero cuando se le dijo que este medio tenía la grabación de la reunión se limitó a responder: “Públicamente hemos expresado que hubo problemas”.

Sabían antes de la elección

Los magistrados del TSE conocían de antemano algunos problemas logísticos que provocaron el fracaso en la transmisión de los resultados. En la reunión con la JVE, el magistrado Orellana detalló que las cajas azules que contenían el equipo tecnológico (computadora, impresora, escáner, mouse y un hub) no iban debidamente rotuladas, a pesar de que se le ordenó  “al jefe de la unidad correspondiente” hacerlo, lo cual fue detectado desde un día antes de las elecciones. 

“Uno cree a ciegas en el equipo técnico, pero la historia nos está demostrando que no funcionaron (…) Primero, se le ordenó al jefe de la unidad correspondiente que le quitara la viñeta a esa caja azul, porque era la de la elección 2021, pero la persona no lo quiso hacer”, aseguró Orellana, quien aseguró que después de que le ordenaron colocar encima la viñeta de 2024, detectaron que no lo hicieron. 

Orellana también señaló que el TSE solicitó el papel de seguridad para imprimir las actas necesarias para equipar los centros de votación, pero que el encargado no lo colocó en las cajas y que este recurso se encuentra en la Dirección de Organización Electoral (DOE).

“El responsable no colocó ese papel en cada una de los 8 mil 562 paquetes. El papel ahí está, en la DOE, pero no lo hicieron (incluirlo en las cajas)”, afirmó el magistrado del TSE.

Orellana relató que cuando el transporte llegaba por las cajas, no querían trasladarlas a los centros de votación porque iban rotuladas con el año 2021. Mencionó que al director de la DOE le llamó la atención la inexistencia de papel en esas cajas.

Revista Factum publicó un audio de una reunión realizada el pasado 6 de febrero, entre magistrados y representantes de partidos políticos, en la cual el jefe de la Unidad de Servicios Informáticos (USI) Ignacio Villagrán dijo que el fracaso se debió a la falta de uso del sistema de contingencia en las Juntas Receptoras de Votos (JRV) y la falta de papel de seguridad para imprimir las actas. 

Sin embargo, el instructivo para el uso del sistema de Registro y Transmisión del TSE para las elecciones 2024 indica que la responsabilidad en la coordinación y ejecución del manejo de contingencia de la transmisión está en los jefes de soporte de la institución. 

“Si el equipo no puede transmitir por problemas de conectividad, será el personal responsable de sede que se encargará de realizar ese paso cuando los equipos retornen a la sede”, dice el instructivo.
